      I have written lendmark Financial several times expressing my concern for the violations reported to the credit agencies. This final letter has not been responded to in 19 business days which they were given 15 days. They have the account charged-off closed and still furnishing payments on the account and I havent never received a 1099-C form and I have made them well aware. Other violations have been made. I have went also through the credit agencies and they, instead of reading, decided to send lendmark verification information which I never asked for. This has damaged my reputation, mode of living and character. Also they are still looking to collect money from me after charging off the debt and closing the acoount

      Lendmark has completed an investigation into your dispute and can confirm your tradelines are reporting correctly with the ************************* (CRAs). As of the date of this letter, your account, ***********, is reporting as a charge-off with an outstanding balance of $2,144.18. Your date of last payment was in April 2021, the date of first delinquency was in June 2021, and the date of charge-off was in December 2021. As for the other account, ***********, it is reporting as charge-off with an outstanding balance of $2,955.98. The date of last payment was in October 2022, the date of first delinquency was in April 2021, and the date of charge off was in October 2021. Lendmark has processed a request to reinsert the tradeline with all three 3 CRAs as it was not showing with all CRAs.

      We understand that you have requested that Lendmark remove certain information associated with the tradeline for the Lendmark loan account referenced in your complaint that was furnished to the credit reporting agencies (CRAs) by Lendmark. The Fair Credit Reporting Act requires that Lendmark accurately report information to the ****. As the information reported to the **** regarding your account was accurate, ****************** is unable to accommodate your request.

      Additionally, if Lendmark Financial Services was forgiving the loan balance, you would be receiving a 1099-C but since you are still responsible for the loan, you will not be receiving a 1099-C. As the loan progresses,should the collection activities merit this process, Lendmark Financial Services will send you a 1099-C.

      Lendmark Financial of ****************, WV keeps sending letters addressed to my wife's late father of almost 1 year. Additionally, the last time he lived at that address was over 8 years ago. I contacted Lendmark Financial and was told my address was placed on a do not mail list around 1 month ago, but received the same letter yesterday. I just want Lendmark Financial to stop sending mail to my address.

      I have disputed this account several times due to. It's inaccuracy on my credit report and asked removal. All they did was update it and remainsto my credit report still challenging my credits tarnishing my credit since his reporting as a charge off I have requested a 1099C they have failed to provide numerous times if they get to write it off at the tax deduction then I should receive my 1099C

      I am submitting this complaint regarding Lendmark Financial Services due to aggressive and excessive collection contact despite my proactive communication about a late payment. In summary, I clarified that I was not requesting a holdonly communicating my intent to pay several times on multiple engagements with this representative and others; however, each time ********* chose to negate this proactive communication and consumer rights. On July 2, I received a call and voicemail from *********. When I returned her call, I recorded the conversation. During the call, ********* stated directly that she would continue to call me every day unless I set up an immediate payment. I reminded her that I had already communicated my payment date and referenced my rights under the Consumer Financial Protection Bureaus guidance. She restated her intent to continue daily calls going forward until payment was made, and I ended the call. According to federal guidelines, a servicer is not required to initiate live contact or issue delinquency notices if the borrower makes a late payment within the specified delinquency period. My communication on June 23rd, confirming a July 7th payment, was well within that window and should have been honored. Additionally, I was offered a hardship plan during my call with ********* today July 2nd, which I respectfully declined and thanked her for the offer, as I do not need assistanceonly the opportunity to make my July 7th payment without ongoing harassment. I have submitted my compliant to other available regulators as well to include CFPB and the GA Attorney General.

      Thank you for your written response regarding my complaint. While I acknowledge your efforts to restrict future communication per my request, I am writing to emphasize that my primary concernthe violation of the Fair Debt Collection Practices Act (FDCPA)has not been addressed or acknowledged in your reply.
      Specifically, the threat made by your representative to call me daily unless I made an immediate payment or arranged one, despite having already communicated a payment plan within 30 days of the due date, constitutes coercive and unlawful behavior under the ****** The recorded exchange clearly documents this behavior.
      I understand that internal steps may have been taken, but the absence of any mention of the improper conduct and the legal implications of such a threat raises concern about whether Lendmark is truly committed to ensuring compliance with federal consumer protection laws.
      To reiterate:
      I was not requesting forbearance, hardship, or any special treatmentonly acknowledging a delayed but timely payment.
      I communicated my payment date in good faith, and it was within the 30-day delinquency grace ******* making repeated collection contact both unnecessary and inappropriate.
      The representatives insistence on continued daily calls until payment, despite my communication, is not only unprofessional but a direct violation of FDCPA Section 806 (Harassment or Abuse).
      Thank you for restricting further contact as requested. However, I have already submitted this complaint to the Consumer Financial ***************** (****), the ********************************, and the Better Business Bureau. While I do not intend to resubmit, I am willing to provide a copy of the recorded call as supporting evidence directly to these regulatory agencies, should they need it to complete their review.
      I expect that this matter will be properly reviewed, not simply closed as an internal branch concern. I trust that the appropriate oversight will address this, and I remain open to any formal clarification you wish to provide regarding how this behavior was reviewed in accordance with the ****** As I am sure you are well aware this violation is the top violation that occurs in practice, and I am sure that Lendmark would not support the behaviors that would place them out of compliance with this regulation as any lender would have concern.

      From the original loan that I had with this company in regards to a utility vehicle from the original purchase back in February has been nothing but problems. I spoke with the representative after doing my loan. Getting everything approved of a 2 week process to do that, then was given multiple tasks to also complete before even being able to pick up my unit that I had just paid for with down payment and financed. I make the first payment on this loan on the 31st of the month due, the due date is the first of the month. I called the branch to confirm that this would be okay. And I would not face late fees, no charges, no nothing of that nature, and I was told as long as it is in before the 31st or last day of each month it is due, it is okay and you will not face any fees or charges. Alright, then get a phone call today. July 2nd saying that my payment is late. I had just reached out to the company on June 30th in regards to this to confirm that it was okay to do it, how it was done for the last loan. And it was told to me twice that it would be okay that I do that. I was then even transferred to another gentleman that I called and spoke to on the 30th, the same gentleman, and he proceeded to tell me that everything was perfectly fine and hung up the phone. I then get a call from the gentleman who then transferred me to *******, who claims to be the assistant to the vice president of the company for florida he then decided to take an aggressive manner towards me. When I started disputing things that he was saying due to the fact of the false information relayed by his staff at his branch, the gentleman then also began to ask intrusive questions regarding my finances. Asking as to why I couldn't pay it And that I needed to pay them by this week, even though the loan has a 10 day ***** period And on top of that, I was also just told from their representatives 2 days prior that I am able to do this payment on the 31st I have run out of room to type, please contact me.

      I currently have a loan through this company which is paid every month.       I bought a vehicle from blacksburg auto sales in ************** va and use Lendmark Financial services, LLC to help with funds for the purchase. After everything was finished about a year and a half later I found out that the car was a salvage and was worth was the loan was for. I call them and they said they don't do loans on vehicles with a salvage title but you can look up the cars history and see it was total and is a salvage. I want to be made whole in this situation and I have loan canceled.

      You obtained an interest-bearing direct consumer installment loan on to purchase a 2013 **** Focus from Blacksburg Auto Sales (Dealership) the dealership of your choice on February 13, 2023. As fully disclosed on the Disclosure Statement, Promissory Note, and Security Agreement, (the Loan Agreement) the original amount financed of $7,570.53 interest rate of 33.97%,a total payment of $16,138.80 to be repaid over 60 months in $268.98 monthly payments (Loan 1). Lendmark has perfected its lien for the collateral used to secure the installment loan and have received no indication from ************************************* that there is any branding/salvage indication on the title.

      On September *******, you refinanced Loan 1. As fully disclosed on the Disclosure Statement,Promissory Note, and Security Agreement, the original amount financed was $7211.84 at a *****% interest rate, for a total of payments of $15,631.80 to be repaid over 60 months in $260.53 monthly payments (Loan 2).  The amount paid on Loan 1 was $6444.92 and an additional $250.00 was given directly to you in cash proceeds.

      Further, Lendmark has no knowledge of the transaction between you and the dealership or vehicle of choice beyond providing financing therefore any issues concerning the vehicle should be brought to the attention of the dealership at the time of the occurrence.

      On January 16, 2024, you obtained a direct consumer installment loan secured by consumer goods. As fully disclosed on the Disclosure Statement, Promissory Note, and Security Agreement, (the Loan Agreement) the original amount financed was $2,278.57 with an interest rate of *****% for a total of payments of $3,225.96 to be repaid over 36 months in $89.61 monthly payments. You made two payments on this account with the last successful payment being made on April 9, 2024. You have failed to make timely payments as required to satisfy the terms of the installment loan and as a result the account was charged off on February 25, 2025.

      Further, this is a charged-off account which is considered a delinquent occurrence and can remain on your credit report for 7 to 10 years from the first date of default. With that being stated, we can confirm the information reporting to the credit reporting agencies regarding your account as accurate and under The Fair Credit Reporting Act Lendmark are obligated to accurately report this information.

      I am making this complaint because the harassment has got to stop. I have already contacted this company once via their website to ask them to stop, and it still goes ***** wife and I have already made a payment arrangement on the company's app. The app accepted the payment arrangement, which means the company accepted the payment arrangement. But I still get calls from the local Mentor Ohio branch trying to get me to pay sooner. At one point telling me that their legal department will have to get involved.After doing some research, I have found that this is likely a violation of the Fair Debt Collection Practices Act.I used to work for a title loan company, and when a customer made a payment arrangement we would stop contacting them until the day after the arrangement was made if they did not make the payment as arranged.If this continues, I will send the written letter asking to cease and desist. Other actions will follow if necessary.We are not in default, though we feel we are being treated as so. While the associates are friendly and courteous, we still feel like we're being harassed. All of our payments have been made, some late, but a payment arrangement has always been made on those occasions.I would prefer that all future correspondence be via mail or email.Thank you.
