Good morning, my name is REMOVED. This e-mail serves to generate a formal complaint. In doing so, I hope to have this matter resolved. I am a customer of REMOVEDService, REMOVED, REMOVEDManager is Mrs. REMOVEDI have an auto loan with this branch. In July, I totaled my vehicle. REMOVEDpaid their portion and I was told that the REMOVEDI have with Lendmark will pay the remainder. I was told by the branch manager, REMOVED, that I would not be able to have my GAP claim submitted until I made another payment. Well, I made another payment expecting for the REMOVEDclaim to be filed in September. We are now in the late month of November and I was told that my claim was not submitted until 11/18/2026. I spoke with supervisor REMOVEDwith REMOVEDand was told that I did NOT have a REMOVEDpolicy, but a credit property policy which is work $10,085. My payoff was worth $7,217 from the day of the total loss on July 26, 2025. Months have gone by and the negligence of the REMOVEDoffice has caused my account to accrue interest to where I owe a balance on a totaled car that I no longer own. Ive spoken with Mr. REMOVED, branch managers supervisor, dealing with this matter and has not gotten any help or assistance to resolve this case! My counsel is attempting to reach out with no success. This cannot be lawful. I hope this second complaint reach whom it should. I have been given the run around for months and treated with such lack of respect from this office. A customer should not be placed on speaker where others can hear specifics of something as personal as finances. Those are the types of behaviors the branch manager performed. I have been very patient, but now I am being financially held responsible for the lack of professionalism in this office. Thank you for bringing this matter to our attention. Lendmark had the opportunity to review the complaint and will address each of your concerns as follows.
Lendmark completed an investigation into your dispute and can confirm your tradeline is reporting correctly with the REMOVED(CRAs). As of the date of this letter, your account is reporting as a Charge-Off with an outstanding credit reporting balance of $9,978.50. Your date of last payment was in March 2024, the date of first delinquency occurred in July 2023, and your account became a charge-off in March 2024. Lendmark has mailed a copy of the fully executed loan agreement to you as well as a copy of the account statement to show records of the payments and their delinquencies.
Additionally, we understand that you have requested that Lendmark remove certain information associated with the tradeline for the Lendmark loan account referenced in your complaint that was furnished to the credit reporting agencies (CRAs) by Lendmark. Lendmark reports tradelines to the REMOVEDfor the required 7 years from the date of last activity or date of first delinquency, whichever is older. After that date, it is the responsibility of the REMOVEDto delete your tradeline. The Fair Credit Reporting Act requires that Lendmark accurately report information to the REMOVED. As the information reported to the REMOVEDregarding your account was accurate, REMOVEDis unable to accommodate your request.
If Lendmark Financial Services was forgiving the loan balance, you would be receiving a 1099-C but since you are still responsible for the loan, you will not be receiving a 1099-C. As the loan progresses, should the collection activities merit this process, Lendmark Financial Services will send you a 1099-C.
Lastly, Lendmark is in receipt of your claim of fraudulent activity and identity theft but at this moment we are unable to verify or substantiate your claim. if you believe you are a victim of identity theft, Lendmark asks that you please provide: 1) a certified copy of the police report or a completed signed copy of the REMOVED(REMOVED)identity theft report, with the account number listed and 2) A copy of the customer's government issued identification document such as a driver's license or state issued ID. On January 16, 2024, you obtained a direct consumer installment loan secured by consumer goods. As fully disclosed on the Disclosure Statement, Promissory Note, and Security Agreement,(the Loan Agreement) the original amount financed was $2,278.57 with an interest rate of REMOVED% for a total of payments of $3,225.96 to be repaid over 36 months in $89.61 monthly payments. You made two payments on this account with the last successful payment being made on April 9, 2024. You have failed to make timely payments as required to satisfy the terms of the installment loan and as a result the account was charged off on February 25, 2025.
Further, this is a charged-off account which is considered a delinquent occurrence and can remain on your credit report for 7 to 10 years from the first date of default. With that being stated, we can confirm the information reporting to the credit reporting agencies regarding your account as accurate and under The Fair Credit Reporting Act Lendmark are obligated to accurately report this information.

Lendmark has completed an investigation into your dispute and submitted a request to each of the three credit reporting agencies ("CRAs") in which we report to, to update your tradeline associated with the above-referenced loan account. The tradeline will be updated to reflect an account status of Charge-Off with no outstanding credit reporting balance as this debt was sold. Your date of last payment was in September 2023, the date of first delinquency occurred in November 2023, your account became a charge-off in May 2024 and the date closed was in October 2024. In the last 24 months of the loan, your account has reported delinquencies of 180+ days past due in April 2024, 150+ days past due in March 2024, 120+ days past due in February 2024, 90+ days past due in January 2024, 60+ days past due in December 2023, and 30+ days past due in November 2023. Lendmark has included a copy of the account statement to show records of the payments and their delinquencies before the debt was sold.

My father was a long standing account holder with the company, Lendmark. Upon his sudden passing in August of this year, he owed on one of his accounts. After providing his death certificate, along with notarized documents that list his heirs, Lendmark refused to relinquish the title to the 1982 truck. Lendmark refused to take the multiple settlement offers provided, which the loan amount far exceeded the value of the car due to their predatory borrowing practices. Due to my father's death the loan was going to be discharged, which is rightly so, considering he has been an account holder with REMOVEDfor ten years and their interest rate is 35 percent, per account. The vehicle was repossessed today, without notification or communication. I had been calling, leaving voicemails, and emailing the company and they failed to respond.Business Response

I got this 2015 GMC terrain and I got it 3/24/2025. The vehicle is now sounding loud as I push the gas to go won't shift gears right and it's loud when I slow down like really loud to where I'm embarrassed for buying a car and it sounding like this a few months later I don't have money to repair this and why should I have to I should have a reliable vehicle for a certain amount of time but the cars in main had them finance me and I believe they know the issues with the vehicle I want a new vehicle.Business Response

Excessive calling , Ive spoken to a representative on 10/31 @ 4:32 pm and advise I cant make a payment at the moment because of personal reasons and advised I will call back on nov 3rd for resolution end of call. We have reviewed the calls placed in reference to your account and can verify they were made within Lendmarks policy. The calls were being made to contact you to bring your installment account current. We can confirm as of November 6, 2025, that we have notated your account to limit the number of collection calls to be placed on your account. We have also restricted your employers telephone number to no longer being used to contact you.
Further,your account is past due without a future payment arrangement set up. If you are experiencing financial hardship, please reach out to REMOVED,Branch Manager of Mt. May 2025 my auto lien was satisfied, and Lenmark Financial Services has failed to release the hold with the Department of Motor Vehicles. I have contacted the local branch since June 2025, both via telephone and in person, and they continue to state the release has been submitted. They provided a letter that REMOVEDdoes not recognize and requires a notary. DMV states there is an electronic hold that has not been released. This is outside of Regulatory compliance and needs to be resolved as soon as possible. The Company needs to address the issue with REMOVEDand provide a valid title. On May REMOVED, you made the final payment to pay off your installment loan with Lendmark, as agreed. During the lien release process,there was an issue with the Electronic Lien and Title system which delayed the lien release process. This system is managed by the local REMOVED. As a result, on August 22, 2025, the branch provided you with a lien release letter and payoff documents to provide to your local DMV to have the lien released.
We have confirmed with your local DMV that Lendmarks lien was released on September 5, 2025.
