I contacted Attorney Davis via email ( *********************************** on September 22. 23 to adjudicate the child support arrears from my children's child support case and pursue child abandonment charges against my ex-husband *************************. On 09.25.23 Attorney Davis called me from his cell phone number **************. We discussed case details; legal fees, a payment plan, and the documents he would need. After our call, he texted me with his contact information, his retainer fee of $3000 with $1000 of it to be paid upfront and the remaining balance to be paid in payments. He also provided e-payment options that included his Zelle.November 10th I received a call from Attorney Davis, we discussed that I would be sending the initial payment later that day. I sent the initial payment of $1000 to his Zelle and texted him a screenshot of the payment confirmation. He replied confirming that the payment was received and requested I email him the documents discussed prior, and that he would turn around and send me a contract the following day. I replied to his text message that I did not have all of the documents and gave him the contact information for the case manager over the child support case. After I replied to his text message he called me to let me know that the child support office would not give him the case file and that I would need to request it first. He also let me know that as long as I was able to get him the documents by the following week, he would be able to get back to me by Nov 16 or 17th. November 15th I emailed him the child support case file that included court-certified copies of my divorce decree, child support order, custodial agreement of my two children, and the child support arrearage affidavit. Attorney Monte Davis never sent the contract for his legal services. Nov 30th I sent him a text message asking for my initial payment to be refunded. On Dec 2 he replied that he did not answer calls/texts on weekends or holidays and to try again on a business day. On Dec 5th I advised him that I would flag the payment. He replied that he just had a mild heart attack. On Dec 21, I called Attorney Monte Davis. After he did not answer, I sent another message requesting my payment be returned and received no response. Dec 22, Monte Davis called me irate and would not stop yelling. He is refusing to refund my initial payment. Stating that we had a verbal agreement and that reviewing my case was 6 billable hours and his rate is $300 per hour. This is not what he discussed with me before receiving my initial payment. His website's legal disclaimers also contradict his statement. He is avoiding refunding my initial payment, and in addition to his negligence, it has delayed the child support process as the district attorney's office was waiting to hear back about the private legal action I was taking to move forward.
