Builder failed to place pieces of siding on home when built which had resulted in water damage. Damaged was not discovered til recently.Business Response

This home was closed in 2019. The builder provides a 1 year workmanship warranty on the home which has expired. Additionally, it appears that someone else has worked on this home after closing as the corner board in the attached photo has been broken off. The builder is lying and thats the issue. No one has worked on the home, the builder failed to place siding where theyre saying its broken. I know this because when I observed the leak and had someone come out, this why the leak occurred and no one else had any reason to work on my house. There are so many issues with this house that Im now responsible for due to the builders area. They need to be shut down because its ridiculous.

Regardless of the situation, the house closed on 2/28/2019. The builder had a 1 year warranty on workmanship which expired on 2/27/2020. This is not covered under warranty and is the responsibility of the homeowner.Initial Complaint

This home closed in November 2023 and is due for the paint/sheetrock touch-up which can be scheduled now. We will review the other items when this is scheduled. In reviewing this complaint and the previous warranty requests, I have the following comments. 1. The deck is not warranted against boards splitting or warping. The nature of the product and the need for ongoing maintenance by the homeowner prevents this from being warranted. 2. Door k**** loosen from use. Tightening screws is a homeowner maintenance item. 3. During the paint/sheetrock touch-up the painter will repair nail pops and re-caulk trim that has shrunk. However, caulking of tubs, countertops, windows, etc. is an ongoing maintenance requirement for which the homeowner is responsible.Customer Answer

I purchased a home from Heatherland Homes, LLC in 2021. I have attempted to have the issue resolved. The builder attempted to fix the issue immediately after I moved into the home and discovered the issue. The builder did not properly grade the yard and/or lay the foundation. When it rains, my garage is filled with water. The water seeps in along the wall and comes up through the foundation (which has caused the garage to crack excessively). The water that puddles in the driveway runs into the garage with heavy rains. The issue started a few months after I moved in and the Supervisor over the subdivision supposedly resolved it, however a little over a year later, the water issue reoccurred. I have reached out to Heatherland Homes's CEO via social media only to receive no response. Heatherland Homes does not post a phone number or any direct way to reach the company. Attempting to reach them will only lead to the real estate company who sells for them. The address and phone number for the business listed on this site is not directly to Heatherland. This is the real estate company that is of no help! I would like Heatherland Homes to take accountability for this poor workmanship and fix the issues that are causing water damage to my home. Although it has been almost 3 years, I have been dealing with the issue and attempting to reach someone to resolve it. The *********'s warranty that came with the home will not assist, so I need Heatherland to take action to resolve this issue that is destroying the integrity and structure of my home.Initial Complaint

Dear Better Business Bureau,I am writing to formally lodge a complaint against *********************** Homes regarding their failure to properly grade my property, which I purchased on December 18, 2023. Despite their obligations, the builder did not perform the necessary grading of my home, leading to severe flooding and sogginess in my backyard after even minimal rainfall. The backyard has consistently been filled with mud, rendering it unusable and posing significant inconvenience and frustration.Upon reporting this issue to *********************** Homes, I was met with dismissive and unsatisfactory responses. The builder attributed the flooding and sogginess to dog urine, which is both unreasonable and untrue. This explanation disregards the evident grading issues and the persistent problem that arises after every rainfall.Furthermore, *********************** Homes has violated their warranty agreement, as detailed in the attached pages 20 and 30 of the warranty document. The warranty explicitly covers proper grading and drainage, and their failure to address this matter constitutes a clear breach of their contractual obligations.I have also attached pictures showing the poor grading conditions and the resulting state of my backyard. This yard was installed properly including drain pipe to properly direct the water both away from the house and in a manner that prevented it from flowing over the modular wall behind the house. The grading was checked by the City inspector prior to issuing the ** for this house. The homeowner complained of some dead spots in the sod in the backyard which were replaced by the landscaper that installed the sod originally. At that time he noted the large amount of dog waste in the yard. We were also notified on a separate occasion by the landscape maintenance company that maintains all of the yards that they had been unable to mow this backyard on several occasions due to the large amount of dog waste in the yard. The homeowner is responsible for maintenance of his yard aside from mowing which is included in the *** costs. However, this will not be done if the yard is covered with dog waste.Customer Answer

The pictures showed a yard drain with the top grate removed which appeared to be clogged. Maintenance of the drain pipe if the responsibility of the homeowner. The pictures also showed holes that were holding water. There were no holes in the yard when the house was turned over to the homeowner so I have to assume that they were dug by the homeowner's dog. Below is a portion of the email I sent in Nov 23:I must express my deep disappointment and growing concern regarding the unresolved issues pertaining to our home, which were highlighted during our 11-month walk-through in March 2022.The majority of the issues identified during the walk-through remain unaddressed. This includes matters of utmost significance relating to the foundation and structural integrity of our property. In light of these concerns, we have sought the expertise of Aqua Guard, who have conducted an evaluation of our home. Their findings validate our apprehensions, as they confirm that the porch steps are separating, the porch itself is sinking, the driveway is showing signs of sinking, and the garage is displaying cracks.In accordance with the floorplans, it has come to our attention that the basement bathroom plumbing has been installed incorrectly. I have engaged in a discussion with the Spalding permit authority, and they have indicated that they are unable to grant ******** based on the original plans submitted by the builder. This builder set a walk-through on or around two weeks prior to closing... the quality of work was so terrible that the walk-through took hours. The final walk-through was scheduled a few hours before closing which the work was still not complete and all tags were just removed as if it was completed. The superintendent is rude and unprofessional and acts as if it's the consumer's fault and refuses to stand behind the workmanship in the interior and exterior. Additionally, there is chocolate mold in the front and backyard because they have refused to come out and address the soggy grass, irrigation leak and standing water although I have asked multiple times in person, via email and over the phone. It has been over 90 days since my closing and no response from anyone regarding a resolution.Business Response

I spoke with both the builder and the landscaper. First, there is no such thing as chocolate mold. There is a spot in the sod that is scheduled for replacement due to cleaning materials used on the driveway. The "chocolate mold" was supposedly identified by the owner's surveyor. I would suggest that the owner reach out to ************************* Extension Service. They will come out and look at the yard and let the owner know if they see any problems. In regard to the walk through, I was told by two separate individuals that the owner scheduled a conference call for the same time her walk through was scheduled and was therefore not focused on reviewing the house. The only email received was at the end of last week stating she had "chocolate mold" and threatening that she would engage her attorney. I am rejecting this response because:There is mold throughout the yard because the mud breech was never corrected and that has nothing to do with a walk-through. There are multiple bald spots in the yard because it was not done correctly and you can clearly see that with a simple walk-through the yard
As far as a conference call goes I am not sure how two individuals can confirm anything when there was only one individual that was there and extremely combative because of the poor quality work that was done. This walk-through took hours and it had nothing to do with a call and more to do with the poor quality as you can see on the walk-through sheet.
I have waited over 90 days for Heatherland to come back and complete half done work. It is clear that this is something that has occurred with other consumers as well. I have asked *** multiple times for a date to come and complete the work and I have an email trail that he acknowledges that work needs to be done. Heatherland has refused to stand by their workmanship. I have a very long email thread that shows *** acknowledged the yard needs to be done and not a patch. Yet he has not provided a date nor has Heatherland proactively contacted me to resolve issues that they put in writing would be resolved.

I sent a complaint on 9/2021 regarding ongoing complaints noted on your complaint section.This is regarding the water flow when it rains. Cedar Grove ******************** Heatherland Homes Issues:1. Closing contract list of items that were signed off by *******, home purchased 7/19/2021. The flooring basebords not connected 2. 1 year walk thru punchlist items outstanding (a) front yard landscaping sinking (this is NOT a sink hole. This is due to plumbing contrator negligence after completion of landscape.) (b) exterior door k**** not properly fitted, falls off continuously (c) front door seals broken causing water to accumulate inside and outside; door sticks when closing and warped from excessive water runoff (d) water leaking from porch roof (e) caulking compromised between front porch and garage.It is also fustrating to learn from the **** **************** that the ****** did NOT file the final closing walkthrough punch list and is no longer employed with Heatherland Homes. I need Heatherland Homes to rectify these issues immediately.
