    On October 31, 2023, my roommate and I, Summer ********** toured a unit at "*******************" in ******, **, owned by AGA Properties. Though we toured a different unit, the agent ensured us that our apartment would be the same, only a bit bigger, so we signed the lease.On July 8th, the date we expected to move in, my roommate and I received a move-in report that included images of our unit, in which one of the bedrooms did not include a window. Naturally, we contacted AGA Properties to resolve the issue, as we would not have signed the lease if this was disclosed to us prior.AGA Properties' property manager, *********************, was of no help at all and responded, "We feel the units are similar enough that this does not constitute a concern that would cause us to change the terms of the lease" and over the phone, proceeded to describe the concern as "our fault" despite being promised an identical unit. I communicated to **** my concern regarding the legality of the issue, given Georgia's rule that states "Each bedroom or private living space must have at least one window opening through an exterior wall of the home." **** ignored this concern. It must also be mentioned how difficult it has been to contact ********************* and principal/broker, ***********************************, given their slow responses and failure to return calls.Upon expressing that we would like to terminate our lease and be refunded our security deposit, July's rent, and non-refundable fee. **** replied that, in the case we terminate our lease, we would be responsible for rent and utilities until the day before an AGA Properties approved tenant occupies the property, despite providing false information to us.*The 1st 2 images are of the unit we toured which included windows in each bedroom. 2nd 2 show the windowless bedroom we received, as well as the features the room is meant to include ('Window ********* * ********************* both marked as satisfactory despite being absent). Last 2 are emails.*

       Thank you for bringing this issue to our attention. We are sorry for any inconveniences that you may have experienced relating to your move-in to the Cotton Exchange Unit #***. When you and your roommate toured The Cotton Exchange Unit #*** in October 31, 2023, you toured a different unit than the one for which you signed a lease for Unit #***. On July 8, 2024 your move into date for Unit # *** you were upset that the 2 units were not identical in floor-plan.  At this time, you stated that an *** representative who toured you in October 2023, assured you that the units were exactly the same. The *** representative that toured with you stated that she did not make such a statement to you. 
       You entered a binding contract with AGA Properties on November 13, 2023 for Unit #*** in The Cotton Exchange.  The complaint was filed with BBB on July 9, 2024. *** didnt receive email communications with you about your issue until July 9, 2024. The meeting to discuss these issues with *** was scheduled for July 10, 2024. During this meeting, we did offer you the option to terminate the lease. We provided to you our early termination policy.  
    Per your complaint you stated you asked AGA Properties to terminate your lease, refund your security deposit, Julys rent and non-refundable fee. At the time of the meeting on July 10, 2024, you had only paid the non-refundable fee and half of the security deposit. You had not paid rent for July nor the other half of the security deposit. 
       After the meeting, you left the office and stated that you still wanted to move in. At this time, you paid the prorated rent online, the security deposit was later remitted to our office. Because you moved into the property and fulfilled your responsibilities to pay rent and the security deposit, we were of the opinion that you were accepting the property and were not choosing to terminate the lease. As such, we were surprised to receive this letter from BBB on July 16, 2024. 
       Throughout this process we have offered to you that you could terminate the lease. If at any time during your lease you would like an early termination, you need only to notify our office in writing that you and your roommate wish to terminate the lease early. If such a notification it provided to our office, we will begin the process of terminating your lease via our early termination policy. 
       We respectfully request that you withdraw your compliant with BBB. If you have any further questions or concerns, please contact us directly.
