    Sept 28: My home was hit by ***. I need a new roof and other repairs. Dec 21: I gave Roofing Engineered Trusses a call and ********************* from Pegasus Builders came out and did an assessment.Dec 22: ***** a licensed structural engineer with an established business who claimed to be helping hurricane victims. He told me his new truss company could build all new trusses for me in a week and that I could get the vaulted ceilings I wanted. I signed contracts for the roof, trusses and plywood, lanai and interior remodeling. He said he could get all the money I needed to pay for the repairs from my insurance company. Dec 22: I gave him a $15,000 deposit for materials and roof demo. His crew was supposed to start right after Christmas 2022. Nothing happened.January 23,2023: **** asked for $24,000 as a deposit to get the trusses started, which I sent right away.February 13: It had been almost two months since they were supposed to start work on my home and nothing had been done. I confirmed with a Pegasus employee on February 13 that no trusses had been built which made sense since **** said there was a bust in the calculations and he needed to measure my home again. February 14: I canceled the contracts. **** said he would refund my money less any work completed and cancel my permit and contracts. I havent received any money back and the roof permit was not canceled.February 15,2023 I checked with the ******************* to see what permits Pegasus had pulled. The only permit was for a re-roof. Per the *******************, Pegasus should have filed a truss permit including building materials, an engineered drawing and installation instructions. **** told me he does his own roof and truss inspections. Is this acceptable?I want the $39,000 in deposits returned to me so I can get a new roof. I can provide more documentation.

    I have attached my response and attachments. I had to zip a few files so teh attachments could fit into 5 files all under 5MB. Part 1 of my response starts with ******************* complaint and my response in red after each of her issues. Part 2 of my response is my account  of what happened with documentation referenced throughout my explanation of what transpired. Part 3 of my response is what I think is a fair resolution to the case.

    The contract for $62,000 on December 23, 2022 was for new trusses as well as plywood. The contract Pegasus attached to this complaint was edited. I've attached the fully executed document here.
     
    Ive spoken with ***** at the **** and they are prepared to do a full investigation. Filing a complaint with her is my next step.
     
    Pegasus Builders is taking advantage of hurricane victims who are only looking for a capable and decent contractor. Going through a natural disaster is difficult enough without being taken advantage of by dishonest contractors.

    I'm sorry if there was some confusion on my response. The document folders in my response are limited to 5 MB.Therefore, in attachment # 6 of my previous response you will see that there are three contracts in a compressed file. One contract for a new standing seam metal roof for $43,050.00 with a 50% deposit due on signing. This contract was signed on December 23, 2022. The second contract was for new trusses and new plywood.This contract was also signed on December 23, 2022. It also had a 50% deposit due on signing. The final contract which was also signed on December 23, 2022 with a 50 % deposit due on signing was for the Lanai at a cost of $27,500.00.Pegasus was due a total deposit of $66,675.00 on December 23, 2022.Pegasus Builders received $15,000.00 on December 22, 2022. This check was labeled  "roof deposit" in the memo section by the owner(see attachment) and was intended to be used to put a deposit down on the standing seam metal for the roof that was currently a concrete tile roof. The $15,000.00 payment made on December 23, 2022 was still $51,675.00 less than the amount due on all three contracts(see attachments) which were signed on December 23, 2022. I am certainly willing to have the three contracts put under any kind of scrutiny that the Owner deems necessary to certify that all three contracts are authentic in every way and that nothing on them has been altered.
    I paid for four men and a box truck to move furniture and other items out of the house at ******************* On or about December 27, 2022, I attempted to get a set of existing plans from the *************************. in order to design trusses which would now be vaulted per follow up discussion with the Owner. As documented in my previous response, I was unable to do so because the building ***** did not have a copy of the plans for that house. I would not be made aware of this until January 5, 2023 per my previous response.  I then began to measure by hand, in order to design the vaults for the entire house. I did all of this before I even received a deposit on the trusses which I received on January 23, 2023 as shown in attachment. I then produced working shop drawings by February 11, 2023 as documented and shown in my previous response. I also produced almost half of the trusses by February 14, 2023. This is all documented in my previous response with pictures, texts, dates and documents.

    I am simply responding to the Owners claim that I Illegally altered contracts in order to defraud her and respond to her threat to report me to the state for taking advantage of hurricane victims. In fact, to this date, the owner is still in breach of contract for failing to abide by the agreed payment terms since I have still never even received the total deposits due on the signing of the contracts. Nevertheless, I am willing to take only the basic costs of my material and labor off of what she had paid me and reimburse the rest back to her. The pricing on all of my contracts was below the market price for each contract. I do not know how anyone could interpret anything I did as fraudulent or deceptive in any way. I believe that reimbursing the owner for all undone work or labor as stated in my previous response as long as she retracts the things she has accused me of is more than fair. I still don't even see what I did wrong here.

    Pegasus Builders is a dishonest contractor that is taking advantage of hurricane victims. They did not obtain the necessary truss permit as required in the contract. This could have been a catastrophic problem for me if the new house trusses weren't up to code or failed during a hurricane.
