      Good morning,My name is ****** ***** and I am the owner of **** ****** **. Sarasota Fl property. In 2021 we hired Commercial Pool/Spa Contactor – Split Rock Associates, Inc450 S Tamiami TrlOsprey, FL *************** License Numberto build our pool, including everything around, like pool, paver and pool cage. 
      During this project, Split Rock hired his own subcontractors. One of them was Bianque's Solutions (**********) to build our pool cage. They have done their job on October 2023. 
      Recently, during Hurricane Milton, our cage collapsed due to incorrect construction and installation of the entire frame. After that I wanted to check the status of the permit. Unexpectedly, I discovered not only the Permit is open but also is under a different company name. The company is called: T & M Aluminum176 James StVenice, FL ***************** License NumberI have had reached the company above but they are not interested to cooperate and rebuild the cage. Please see attached supporting documents. 1st is the note of  City of Florida Inspector who stated, the cage was installed improperly and the other from Guy Nir - the owner of T&M Aluminum.

      As T&M told the
      homeowner before the filing of this complaint, while T&M is sympathetic to
      the homeowner’s situation, we did not perform any physical work related to the installation
      of this cage, and this issue will have to be resolved with the contractor, and/or the
      subcontractor who actually performed the work.

      T&M was initially
      hired by the homeowner’s contractor. The contractor later indicated that the
      scope of work for the project would need to be changed and expanded, and T&M
      submitted a new proposal for that work. The contractor declined to accept the
      new proposal, the existing contract was terminated, and T&M had no further
      involvement in the project. It appears, including from the homeowner’s
      complaint, that the contractor then hired another company to install the cage.  

      Through an oversight, the
      referenced permit was not immediately withdrawn by T&M, and the new
      subcontractor did not apply for its own permit. However, T&M has now
      withdrawn the referenced permit and it has been noted as “Closed-Withdrawn” by
      Sarasota County.

      We had no contract with
      the homeowner, and received no payment from them, so there is no refund to be
      made by T&M to the homeowner.

      *** Aluminum installed our pool cage several years ago. We were very pleased with their work and recommended them to many friends. During Hurricane ********************* from a neighbor's tree broke and came down on our pool cage in the corner resulting in a dented and slightly bent beam. Of course this is not the company's fault. We have tried contacting them multiple times over the past year to have them replace the dented beam. And we are fully prepared to pay for it. They asked me to email them a picture of the damaged area which I did. But no one will respond to us and will not call or email us back for weeks now. Other aluminum companies are all (I've called about 5-7 other companies) refusing to help us because they did not install the pool cage. So we are stuck with a damaged pool cage since *** will not respond to us and other companies refuse to help.

      We had a signed written estimate in November of 2021 for 10 new windows, 2 doors and an added screen room. We put down $6,000 for the projects. Unfortunately the permitting was delayed and hurricane *** destroyed our house. We never received any product or service. We have been trying since the hurricane (currently 7 months) to get our deposit back. The company apparently had purchased the materials and will not return our deposit until all the materials have been used on other projects. The installer said he had already used one *********** windows and the roof panels. This practice seems very unfair and they appear willing to refund our deposit only when all of the materials are used on other projects.Looking for other suggestions to resolve this.

      At this time we have received $4000.00 refund and still waiting for the remaining $2000.00. Business stated that once they sold a window they purchased for our home we would be given that refund. At this time we have not received.

      T&M Aluminum in ******, ** was contracted to build a new pool cage at our home. The cage was built, but we never signed off on the finished product.The cage was completed around September 20, 2020 and then we had a hurricane come through our neighborhood approximately a week later. While a majority of the cage had no issues with the high winds, one cross section angle support dislodged and this company refuses to support their finished product and honor their warranty.I would like the builder to repair this problem to insure the integrity of the cage is still viable.

      My company is T&M Aluminum and is a totally separate company with different EIN and contractor license. Please route this complaint to the appropriate business and remove from my records. BBB are fully aware of the different ownership and companies between T&************** and T&M Aluminum.
