      My boyfriend and I filled out an application for a rental house with Palm Island Realty on Friday after being encouraged on the phone to fill out an application by their rental agent. We payed $75 each to apply. On Monday the company told us they would get back to us quickly with a decision. They told us Tuesday that they moved forward with another tenant. We asked my boyfriend's mother to call and inquire about the same property and Palm Island Realty encouraged her to fill out an pay to apply. It seems they just want application money from people and I believe a tenant was chosen and the unit was unavailable when *** encouraged us to apply. This violates consumer protection laws. I also believe that our application was never truly processed: Some states require that application fees only cover the cost of background/credit checks, and if they arent doing that, it could be illegal. Not disclosing that the unit was unavailable when we were encouraged to apply should be deemed fraud or deceptive business practices. We only ask that our application fees of $75 be returned to me (****** *****) and my boyfriend (**** *******) and that some policy is put in place at Palm Island Realty to protect prospective tenants from deception.

      We are in receipt of the attached complaint. At the time that this applicant ****** ***** and her co-applicant applied for the property, there were no other pending applications for the home that they chose. Shortly after this applicant applied, another applicant group also applied. Per our policy, we did process ******** grouped application first, since it was received first, however the information provided in ******** grouped application was incomplete. We did reach out to ****** and her group to request the missing information, but we did also begin to process the next application in line, since ****** and her group did not provide a complete rental application with all required information. It is clearly outlined in the "Before You Begin" section of our online application that tenants MUST provide all information required at the time that they apply, or they are subject to an automatic denial of their rental application. ****** and her group agreed to this policy at the time that they submitted their online application. The second application in line behind ******** group was a complete application, and those tenants qualified and were approved for the home. We did notify ******** group of this, but did also let them know that we would be happy to reopen their application and transfer it to another rental property if they were able to provide the missing information. ****** and her group were not satisified with this, and requested a refund. However, it is outlined in our policy and agreed to by ****** and her group at the time that they applied that the application fee is not refundable. Since ****** and her groups applications were not approved due to their failure to provide complete information requested at the time that they applied, we did inform Hannh's group that we were unable to authorize a refund. Please see attached screenshot, which outlines our policies and is displayed prominently for all applicants to read before they begin the application process with us.

      As the owner of rental property ****************************************************** I was made aware at the last minute that the tenants were not to renew their contract which has at least a 30 day notice advancement of tenanta renewal or not, and then the tenants leave on August 25th, 2023. I recieved an inspection report of home in which there is numerous repairs to be made by independant contractors that I as the owner is willing to pay out of pocket and TILL THIS DAY there has not been any type of reach out or response by our property manager **************************, who can be reached at the ********* Office which we used at ************ as to this property management company finishing out their stated contract on September 21st, 2023 and also taking care of tenanta deposit. Their office address is *********************************************************************************************, we did not use ***** office. There should be contact individually to companies with contractors that need specific different home repairs so that home can be fixed asap as per contract. My lawyer has been contacted.

      The statement provided by this indivdual is false. Palm Island Realty has been openly communicating with this individual almost daily and several times a day since the middle of August. Palm Island Realty is not in breach of contract and have performed all duties and responsibilities as outlined in our management agreement, as demonstrated in the many attached email and text chain coorespondance between Palm Island Realty and this individual. We have provided this individual with rental comps, rental advertising, a full and detailed inspection report of their property, a breakdown of all deficiencies noted from said inspection, an explanation of the process surrounding the tenants security deposit disposition, details on utilities for the property, as well as multiple quotes for various items. This individual has made no such complaint or claim to us directly, so we were very taken aback by this open complaint. We respectfully request that this complaint be closed, as it was opened without merit. Palm Island Realty has already terminated their management agreement with this individual, which will end on September 21, 2023.
