    Amount Paid: $3,625 (Paid on 9/9/2024)Service Dates: 9/11/2024 - 9/14/2024 I am filing a complaint against Haskell Pest Control for property damage caused during the fumigation of my home due to their gross negligence in protecting my property and improper use of equipment.Failure to Protect Property:Haskell failed to take proper precautions to safeguard my homes exterior during the fumigation process. As a result, my gutters were crushed due to improper ladder placement, with no support provided while loading. There are several evenly spaced supports available that should have been used, but were ignored.Negligence with Equipment:Additionally, a worker carelessly used a ladder, causing visible scratches and further damage to the gutters. No protection was used between metal surfaces while carrying tents to the roof, resulting in additional scratches and damage to the exterior.Efforts to Resolve:Despite multiple attempts to contact Haskell, they have been unresponsive and have not accepted responsibility for the damage. I have submitted an estimate to repair the damaged area totaling $1,609.68.Requested Resolution:I seek full compensation for the necessary repairs to my property. The agreement signed by Haskell explicitly states they are not responsible for damages unless caused by gross negligence, which is clearly the case here.

    The tenting of the home would not cause damage during the normal course of the work. There was not gross negligence on our part to cause the damage. In addition, the customer signed a release indicating that we are not responsible for any damages incurred. The release acknowledged that fumigation is heavy work by nature and gutters are specifically mentioned.

    I am rejecting this response because I spoke to your company representative who visited the site to review the damage after I called to complain. **** (at Haskell) confirmed with me on the phone that the damage was due to the Haskell team's installation, and that Haskell would take full responsibility for paying for the damage to be fixed. Haskell's stance on this topic only changed once they saw the cost for the repairs.

    I am rejecting this response because:
    The damaged gutters were brand new. They had been replaced just prior to our going north to visit family. The only work done on the house after us leaving was the tenting. Neighbors called and notified us that the winced the damage the day the tenting was removed. The full cost of the repair should have been received.

In addition, the customer signed a release indicating that we are not responsible for any damages incurred. The release acknowledged that fumigation is heavy work by nature and gutters are specifically mentioned. In this case, we did provided the customer a goodwill $400 refund.
