I hired Com-Res Property Services, LLC, a licensed general contractor CGC1513581 to perform a complete renovation of the exterior and interior at my property located at ***********************************. A contract was signed on July 1st 2024, and we agreed to a total of $93,000 for all materials and labor to renovate the property in preparation for listing it on the MLS. After change orders I paid a total of $120,282.93 for renovations to Com-***** The owner **** **** of Com-*** kept adding more expenses and change orders as the work proceeded. Despite receiving payments, the contractor failed to complete the work as outlined in the contract. **** **** has left most of the job undone, no kitchen was completed, missing cabinets, no counter tops installed, no backsplash, no fixtures, just bare walls. Bathroom configured poorly so door could not be opened without hitting the toilet if it were installed. Plumbing has not been completed, no toilets, no sinks, tile was never finished on bathroom floors or tub surrounds. Master bathroom was never even started, no trim kits, no electrical power to the house at all and unfinished electrical wiring, roof he installed is leaking, soft spots in flooring, entire back deck was missing, front porch untouched with broken stucco and missing hand rails. As of June 2025 , the contractor has not returned to the site. I had to hire another general contractor to finish the job. This behavior has caused significant financial and emotional stress, and I believe it may constitute contractor misconduct, possible fraud, or abandonment of a project. I am requesting that the **** investigate this matter and take appropriate disciplinary action against the contractor.Business Response

My name is **** ****, Iam the General Contractor of Com-Res ********************** Services****. I would like to respond to this unjustified claim. ********** made a proposal to Mr. **** to renovate his property, but initially, we sent him a proposal with a partial estimate of what this project would be, and we clearly told him that this would not be the final price of the project because we needed to see the condition of the floor and ceiling trusses. As it turned out, the trusses were in poor condition, and we had to change the agreed price. They never wanted to sign a contract, so the project was done on a verbal agreement and not with a signed contract. I agreed to carry out this project without a signed contract because I had already worked with **** many years ago and trusted him, and we never left a job unfinished.
Like I said is not legal contractor was signed betewen *** and Com-Res ********************** Services,LLC..Was only a proposal it was never signed by me and was never notarized in my presence.
The scope work was done was total different at the proposal.
1- Demo: Complete interior demo,everything out for new City of ***** Approve Plan.
2-Electric: More extra work because the home had a Demo Permit.
3-Plumber: The new floor plan change for plumber,relocate the kitchen,a new master bath and hall bath.Relocate the water heater ( everything new ).
4-Door and Windows: All neccesary windows and ********* framing ,Relocate 2 windows.
5-Roof: Install new single Roof,Replaced about 75% of plywood and we already fixed the leaks in the vent for microwave and A/C.
6-The kitchen: New floor plan relocated the kitchen and kitchen cabinets ( the kitchen cabinets do not install)
7-The baths: Install the 2 new by new floor plan (missing install the wall tile in one on the cabinet)
8-The floor: New floor by plan,new everything,replace all the plywood.
9-All Framing: a- Fixed the home trusses system
b- Install new framing around the whole house by new floor plan
c- Install all necessary insulation by plan only walls
d- Ceiling Drywall
e- All interior walls install drywall
f- Apply texture whole house
i-Interior and exterior paint
10-Fixed the exterior walls to install new ***** **** Siding and molding around the house.
11- A/C System: Remove the old one ,relocated and install all new A/C ducts,harness in the attic ( not install the compressor but is ready)
This incluides all office time for operations,City Permits and inspections,Architect fees ( and time).
-The proposal for $93,000

- The total expenses for Com-Res ********************** Services,LLC to do this work $123,065
- *** ****** owes this amount to Com-Res ********************** Services,LLC $3,065.
The house is about 90% of completation.We want to finish it but *** not interested in pay $50,000 more.
When appropriate,we have documents and pictures to support everything previously stated by us..
While the project was moving forward, we agreed that they would make regular payments for the continuation of said project, payments that were made correctly until one day they decided that they would no longer pay until the project was finished. Since that was not our agreement, I told them that in order to continue, they had to make the agreed payments. Since they did not want to reiterate our services until they decided to pay what was agreed, we did not abandon the work; we simply stopped going to the property until the payment issue was resolved, which never happened. Suddenly, I saw in the city's Accela system that they had replaced me as the General Contractor of that property without consulting me or notifying me of the change. Several change orders were made for this project because the property was heavily damaged, and we saw the bad conditions at every step of the project, and we informed them each time about the changes and they were always in agreement as we had several meetings on the property to show them what we found as we progressed.. ********** never abandoned the project, we were simply waiting for them to continue with the established payments so we could continue.Therefore, I want to make clear that this claim is unjustified.Customer Answer

Definition of *********************start="372" data-end="375">To abandon means to intentionally and permanently give up, surrender, leave, desert, or relinquish all interest or ownership in property, a home, or other premises.
Background and **************************start="584" data-end="587">At the property located at *******************, a final price for the remodel was agreed upon, and a formal contract was signed and notarized.
A copy of this executed agreement is attached for reference.
Mr. **** was provided with a defined scope of work, which he accepted and agreed to complete under the terms of this contract. However, the work outlined was never completed as promised.
Mr. ***** statement that the house is about 90% complete is inaccurate and misleading. Upon inspection and subsequent contractor review, it was determined that the home was far from completion.
Scope of **************************************************start="1271" data-end="1274">When Realnet assumed responsibility for the property and engaged a new licensed General Contractor, the following tasks were identified as incomplete or improperly executed and required completion:

Install tile flooring in hall bathroom

Install baseboards throughout home
Purchase and install kitchen cabinets
Purchase and install granite countertops

NO power present at the property at all. NOT connected to TECO
Exterior Work Remaining:
Complete rear porch installation
Install 6 x 6 wood railing on front porch

"NEW" roof actively leaking, hired licensed roofer to repair and replace as needed.

Mr. Moya knowingly ceased work on the project after realizing that the agreed-upon scope could not be completed within the contracted budget, even after we paid $40,000 more and were willing to pay more upon completion. Following this, he stopped reporting to the job site and discontinued all communication, including multiple phone calls and text messages from ******* seeking updates and resolution.
This pattern of conduct demonstrates a clear abandonment of the project, leaving ******* no reasonable alternative but to hire a new licensed General Contractor to complete the remodel at significant additional expense.
Conclusion:
Based on the above facts, Realnet asserts that Mr. ***** actions constitute abandonment under the definition provided. The evidence supports that ******* acted in good faith to complete the project responsibly and in accordance with contractual and professional standards.Sincerely,

I am rejecting this response because **** ***** statements are false and misrepresent the facts of this project.
First, I have clear video evidence from my office security cameras showing Mr. **** signing the proposal on the day the project began. This signing took place in the presence of a licensed notary, Mr. ***** ******. Therefore, his claim that he never signed or did so outside of a notarys presence is categorically untrue.
Second, Mr. ***** claim that we stopped making payments is completely false. In fact, we paid more than $30,000 over the agreed-upon budget. Despite receiving these payments, Mr. **** stated that he was out of money and refused to return to the property. His own supervisor confirmed on multiple occasions that Mr. **** was deceiving usand would instruct his crew to leave immediately after our meetings, despite claiming progress was being made.
I have also provided the Better Business Bureau with copies of our text message exchanges, which clearly show that I offered additional payments to Mr. **** to complete the project. He ignored every one of these offers and never responded.
Furthermore, Mr. ***** claims of ongoing communication are demonstrably false. His communication was minimal throughout the project, and in the end, he ceased all contact and abandoned the job site entirely. Several of his workers and supervisors later confirmed that he instructed them not to return to complete the work.
In summary, the evidenceincluding notarized documentation, video footage, payment records, and written correspondenceclearly shows that Mr. **** failed to act in good faith and did not fulfill his contractual obligations. His attempt to shift blame is unsupported by fact. This claim against him and Com-Res Property Services, LLC is fully justified.

I am a single mother. I ran away from home with my three children because I was afraid of my boyfriend. He stayed on the property for over four months. According to him, he made several repairs to the property. This company supposedly made all the repairs since I bought the house, which is not true. Now, this company produced false payment vouchers to prove that my ex-boyfriend paid for the work, to claim that he has a right to the property.
