    I spoke with ***** ******(I probably spelled that wrong). He was extremely unprofessional and condescending. I tried to get the business website and any kind of file number or something that they have for me, so that I could verify this was legitimate and not a scam. I also asked again for a debt validation letter as required by law. He started acting extremely childish and demanding I set up a payment plan over the phone, immediately. I simply want that debt validation letter, so that I know this is legit. I even offered to set up payments through their website, but I would need some more information from him, which he refused. He threatened me with criminal prosecution for a felony, which is not a possibility here. He was extremely unprofessional, agressive, and rude. He kept repeating over and over again that I would go to court if I didnt pay $200 today, over the phone. Despite refusing to provide me any documentation that he was actually legitimate and not a scam.

    Today, at roughly 5:15pm EST, a man named ******* called from Berkshire Capital Services asking about our coworker. Which is fair, everybody has a job and I don't begrudge him that. This coworker is on vacation this week, and he was being condescending to start with. Apparently I had a "voice change" and ******* started accusing me of being my coworker. He threatened that BCServices would be coming to "get her", which is a threat. I was completely out of wits, and immediately called back the number on the BCServices website. ******* answered, pretending at first like he hadn't just spoken to me. I was, of course, upset that he had been so verbally abusive to me, someone who has never owed anything besides mortgage payment. For a company that touts "professionalism" and customer service, I was shown the exact opposite. Its even worse because I genuinely tried to be polite to the man before his behavior switched to being accusatory and threatening. Still not my coworker, by the way. The company should really train their staff better, because with people like *******, I don't see them being able to make many collections.

We have attached screen shots of the search in our database for the phone number as well as the name and located no records so the phone calls received did not come from Berkshire Capital Services .     Being called by a VOIP number ************, Said they were Berkshire location services. When I called the original number listed they stated that this was an ongoing problem for their company. I was threatened with a law suit and told that I'd be liable for breach of contract, fraud, etc. I have never dealt with this company and do not like the fact that 3rd party debt collectors get to act rude and negative on the phone with no validation whatsoever. They caused me panic attacks and almost caused me to pass out at work due to the run around and see if I had a lawsuit filed on me. You do not have any right to contact me, my family, or my job. You do not have the right to contact me any further unless it is in writing.

    We have reviewed the complaint filed by R, Lei-yen   complaint #********.  We did a search in our data base for this phone # and we have no records of this customer in our database. Also the phone # that as listed in the complaint does not belong to Berkshire Capital Services.  There has been complaints filed against our company due to calls from another company called Berkshire . They are not Berkshire Capital Services LLC.

    I have received several missed calls from different numbers several times a day in the past 2 weeks. They are all from this business. I spoke with a *** ******** who was very hostile and condescending. He stated that I have a pending fraud case against me in a specific county. He proceeded to say that he didnt see any previous concerning history on my record and attempted to scare me into paying something he couldnt even give a clear description of. He named one business and called again saying a completely different name. He corrected my English on the call and raised his voice in a very threatening manner. I said I was not interested in paying as I knew it was a scam and he some more nasty little comments before saying he would push it through to the court. I called the county court in question and they indeed said not to pay anything and this is not legitimate. She said several calls have been made today about this business threatening a civil case.

    Someone from this company called me and was incredibly aggressive and unprofessional. After I hung up due to his rude, confusing, and hostile behavior, he called my wife to ask where I was. I am very close to filing a police report for harassment, as I am furious about this behavior. This situation makes me sick. I have a very personal issue with this individual contacting my wife in an attempt to reach me. I hope this person faces appropriate consequences for their actions.

    An individual called my boyfriend's number today asking for me. He tokd the man that was not my number. And he asked the name of the person. The *************** up. I ran a search on the phone number: ************. I called this number and asked who they were and why were they calling my boyfriend. I asked who they were. The individual was very rude talking about he called my bank, was going to *** me. I hung up. I then got a call from another number: ************. Very ignorant individual like the first. Telling me they were Berkhire Capital and they sent me correspondence of which I never received. I asked again what he was calling about. He then said they were trying to collect for Cashnet USA and I was being ***d and I was goingvto be served. They are scam artists that threaten people and break the law. These people need to be shut down.

    This place has called me and left 2 voice-mails. First on 4/15/24 by Mrs. ******** or something to that effect. Saying a possible case being filed against me in *******. I disregarded. Then called me again on 4/24/24 by the same person. More demanding and mentioned ****** and *******. Neither voice-mail letting me know it's an attempt to collect a debt or a debt collector. So, I called back same day to inquire.They speak on a debt 7 years old. Which, in ******, after 5 years is illegal to use such tactics. She said it was on my credit report, which is false. I had it removed due to being beyond the statute of limitations. I asked if it will remove my trade line, and she got really nasty with me. "I'm tired of people asking us to remove the trade line, you don't want that.. blah blah." Very nasty response. I asked how long I had to pay, again she got nasty with me. Very intimidating language.

    ****** Made a payment the march 29th of ****** Had another one scheduled for 12th of 200 and the 26th for 200. I called the 10th of April to make sure the payment was scheduled for the 12th and to ask about paperwork getting sent to me via mail or email after both last payments were made to show it was taken off my record. When I called the 10th the number was disconnected so I had to go back through the chain of commands to get a new number to reach them on. Going through the chain I talked to advanced America and they told me that it could be a scam they never heard for such a thing and to double check the company number and name on ****** followed by getting more information on the company since they had a lot of information.I ******d the first number I was given and it came up as a possible scam number which didnt help my concern. When I looked the company name up I didnt get any information not even I phone number to call back while made me go back and call all the chain debt collection numbers to reach them.I eventually got ahold of the company and got transferred to my case manager ****** who I was trying to get more information on the company to make sure it was legit. I got told we dont have to tell you this and that when I explained my concern about my money going somewhere legit and all I needed was paperwork or something to show proof of this court case I got well Ill just take off your card number and well see you in court I then explained I had no problem making ANY payment I just wanted to make sure I wasnt scammed and then ****** said you paid ****** thats all you think were going to take only that much if it was fraud and I said ok whos your supervisor, because your being very unprofessional he then stated Im no longer talking to you and your not talking to anyone else either, were taking your card off file and youll get your paperwork to be in court then hung up on me. When I called back to hopefully get someone else he answered again and was saying youre harassing the company I then said ****** just trying to make sure my money isnt going to waste or to some scam that all and he said I told you about youd get an email after the payments were made I told him I didnt get told that, so I will get an email stating that its off my record after? He then said regardless if you have recollection of this I did tell you this and it was recorded so youll hear it in court I then said ***** never said I wasnt going to make the payments I just wanted so sort of comfort in me giving my money to someone else and he hung up like three more times and I called back because I again wanted to talk to his manager was or something. When he said ** taking your card off file I asked how can you choose that when I did t say too? And when I never said I wasnt going to make the payments and he then said because I have that option its in manager review Im ended it the call I didnt call back because I dont want to argue with someone whos not giving me any respect or reason to this mess? Ill just wait to go to court and Ill make my payments then.After the phone call I ******d the company and find it pulled up a one page website with no contact information and gave an address in ***** fl that when ******d it was to the post office. Phone calls happened the 10th of April at 11:36am and after being hung up on 4 times the phones were done at 11:55am

I have attached two search shots showing the search and the NO results located both highlighted in yellow. It would be my recommendation  to contact your bank and have them provide you the name of the company and phone number so you can log your complaint via the BBB to the correct Company.  Since the account is not in our office as you can see via the screen shots I provided I would like to request you retract your complaint to the BBB.

    This company called me. They gave me an individuals first and last name. They gave me their social and how much debt they are in and which company the debt is for. They didnt even know who I was which I find highly concerning due to someones personal information being given out

    In response to complaint ID ******** . I have searched by Name and  Phone number in our system and we have no account with that phone # or Name. It may be another company calling customer. We are ****************** and we only go by our Full Name. We have had a few calls recently from customers saying they are getting calls from a Berkshire all of our employees are trained to go by the full name of company. 

    I wish there was more I can do but we are not the party calling . I have attached screen shots of our search results

    I received phone call from customer service agent on 11/13/23 on my work phone. She asked to confirm my identity, in which I responded by asking who she was and what the call was referencing. Stated she didn't "want to cause problems" and was only "trying to help me." Agent was aggressive in tone and demanded I speak to her. I asked the agent to remove my work phone number from her contact listing and she stated she couldn't unless I gave her an alternate number. I then asked for her name and number (which I received), then was ordered to call her within 24 hours. I then received a phone call and voicemail on my cell phone 11/13/23 around 7pm from the same agent requesting that I call. Again, tone was very argumentative and demanding. Agent called my work phone AGAIN on 11/14/23 at 11:59am, even after being asked to remove my work number. I did not speak. She repeatedly called my name and I chose not to respond. She then stated she knew I could hear her and that she knew I was listening to her, followed by remarking my behavior was "unacceptable" and she thought I was a person of "dignity." She also asked did she need to send me an e-mail. When I asked for a supervisor's name and contact number, she hung up in my face.
