Home and beyond services in ******, ******* was to do 2 bathroom renovation and paint the whole house. He wanted 50% down to start job, then after completing 2 bathrooms, I was to give him 25% more and then the rest at completion of the job. The amount of deposit was $6750 to start. Batu (owner) sent a worker *** to start. After a couple of days they had a disagreement and *** walked off the job so Batu had to find someone else and that took about 3-4 days. Now he sent **** and that **** is one of his best worker and that he was going to get the job done. Now I had to go back home to ** and that my neighbors were going to let him in the house and make sure he's doing the work. Then my neighbor had to go home to NY and **** agreed to continue to do the work and send me pictures daily to show me the progress of the job. But no pictures was sent because his phone was not working and his worker was going to send the pictures. Never did. I got sick and was going back on May 17 but **** said you're sick and this is still a construction site so it's not good for you to return in this mess. So I decided to delay my flight until May 24. When I returned the bathrooms still not done and my walls were compounded but not sanded but painted over unfinished walls. I asked **** who made this mess on my walls and asked him were some of my stuff. He said he didn't know. I said what do you mean I left you the key you're responsible. He said he had a couple of guys to finish so he didn't know. I called Batu to tell him about the mess, he said he would come and take a look. He agreed and would fix it. **** was going to continue to finish bathrooms but he was alone and taking to long so I asked Batu to send someone to fix the paint job so things can move along faster. He said he needed more money, I said but you need to fix the damage before I can give you anymore money. He said we are out of here. He called **** and told him to leave the job.

Tell us Thank you for the opportunity to address the recent complaint filed by Ms. ***** *******. We take all concerns seriously and appreciate the chance to clarify the circumstances surrounding this matter.

Cathay ******* engaged four other contractors to perform work on her residence, all of whom proved to be problematic, according to *****. We submitted an estimate several months ago, which she declined in favor of another contractor. Subsequently, one month later, she contacted us again, expressing a strong desire for assistance due to her dissatisfaction with the previous contractor's work. In response, I dispatched one of my team members (*****) to provide a new estimate; however, she declined this estimate as well. It was reported to me that she attempted to circumvent our company by hiring my team member directly, an offer that he refused. Another month passed when she reached out once more, pleading for assistance. I reminded her that she had consistently declined our estimates and opted to hire other contractors. She responded, acknowledging her previous decisions and imploring for our help once again. Once more, I arranged for another estimate and sent my guy, Derik, who she subsequently negotiated to cut our company out and hired the individual directly. Unfortunately, this gentleman was later terminated, and shortly thereafter, he absconded with her funds without completing the project. Soon after, she contacted me again, pleading for assistance. I consequently dispatched my employee *** to the site once more. *** initiated the project; however, two days into the work, *** failed to report without notice. ***** subsequently contacted me, expressing her frustration. I proposed to either reassign the project to **** or refund her full deposit, allowing her to seek another contractor. She acquiesced to the deposit being refunded. Shortly thereafter, her brother, residing out of state, called to inquire about the situation and to discuss our willingness to complete the project. I confirmed that we were indeed eager to proceed, but noted that she had agreed to reclaim her deposit. He requested to speak with her, and ultimately, all parties agreed to continue the project. The terms of our contract stipulated a 50% deposit to procure materials and establish a precise project date, which she paid. Upon completion of the two bathrooms, an additional 25% draw was due, after which we would proceed with painting the remainder of the condominium. In our efforts to ensure timely progress for her residence, I inquired if we could commence work on the rest of the apartment prior to completing the bathrooms. She was quite appreciative and consented. I informed her that, due to the expanded scope of work, we would require the subsequent 25% draw sooner than outlined in the contract. She agreed to this adjustment. However, a few days later, upon her return to town, I requested the next draw; she declined, asserting that we had caused "damages" to her home. I clarified that any oversights were simply missed spots rather than damages, assuring her we would rectify these issues without dispute. I indicated that we would revert to the original contract, fully complete the bathrooms, collect the requisite draw, and then continue with the remainder of the condominium. She insisted that she would not disburse any additional funds until the alleged damages were remedied. I sought clarification, asking if she was indicating that upon completion of the bathrooms, she would refuse to pay as stipulated in the signed contract. She affirmed this position. Consequently, I instructed my team to pack up their equipment and leave the site. This client has presented challenges from the outset and imparted a valuable ****** on the importance of discerning which projects to accept. Having engaged five different contractors, she claims they have all wronged her; the unifying factor in this scenario is her behavior.

How dare Home And Beyond say that Its my behavior. All-of his the workers mentioned left. Because he does not pay them so they walk off the job. The photos I provided shows that 2 bathrooms were not completed which I paid $6700 to complete 2 bathroom.  Its in contract. He wants more money when he didnt do what he was supposed to do with the first deposit, but instead, he made a mess of my walls and floors. Then tells his worker to leave. Leaving the job site indicates that you are no longer interested in binding to the contract, therefore the deposit should be returned.

    Dear Better Business Bureau,
Re: Complaint filed by ***** *******

We appreciate the opportunity to respond to the complaint filed by ***** ******* regarding our construction project. We take all allegations seriously and would like to set the record straight.

Contrary to the client's claims, we did not request payment before completing the bathrooms. Our communication with the client clearly stated that the next draw would be collected upon completion of the bathrooms, as per our contract. However, after we informed her of this, she stated that she would not provide another payment even upon completion of the bathrooms, which is a clear breach of contract.

We take pride in our work and ensure timely payment to our workers. The workers did not "walk off the job" due to non-payment, but were ordered by me to stop work due to breach of contract by the client.

The photos provided by the client do not accurately represent the project's status. We have documentation and records of the work completed, and we are confident that our work meets the contractual agreements. However, after ***** pointed out a few issues, we removed the vanity and toilet to make some additional repairs to satisfy her. After that, she stated that she is not going to pay us, so we ceased work due to a breach of contract by *****.

At this point, we do not feel comfortable going back into Cathys residence, as we believe it is a liability for our company and workers on-site due to the hostile work environment created by *****.

We appreciate your attention to this matter and look forward to a resolution.

    Sincerely,
    Batu Tonaroglu

I received a letter from Home and Beyond indicating that they will proceed with legal action based on defamation and damages to his business. Let me be clear that there is nothing in my complaint that was false, all photos and contract that was submitted are facts. All statements and complaints made on **, yelp and other social media platforms about Home and Beyond are true. I will not retreat any statements and will continue to post more facts about Home and Beyond in the future. The only way that I will stop any further comments from continuing is to compensate me from my financial burden that Home and Beyond caused me by not completing the job he was paid to do but instead leaving me with unlivable conditions. Now, I have to hire a new contractor to fix damages caused by Home and Beyond which is costing me more money than I have to. As I mentioned in my complaint Batu told his workers to walk off the job leaving me in a messy condition. He did not abide to his share of the contract, therefore the monies paid to Batu as a deposit should be given back in whole or in part so that I can pay a new contractor to finish the damages on my walls and floors caused by no one but Home and Beyond.

This is an unfortunate turn of events, and I appreciate the BBB for taking the time to review this matter.

From the outset, it is clear that this client was aware of her obligations and was complicit in a premeditated effort to avoid fulfilling her financial commitments. Despite our willingness to assist and our commitment to customer satisfaction, Ms. ***** ******* engaged in actions designed to undermine our work and evade payment for services rendered.

Ms. ******* paid approximately $6,700 for two bathroom remodels, drywall repairs, painting, and baseboard installation throughout her condo. The bathrooms were completed to a professional standard and in accordance with her specifications. However, the rest of the home still required touch-**** which had not yet been finalized. Before we had the opportunity to conduct a final quality control review or request only a partial payment in accordance with the contract, she identified minor issues and exploited them as a pretext to withhold the next payment. Her actions appear to be a calculated attempt to avoid paying what was owed.

While she has left negative reviews on other platforms, we stand by the integrity of our work and remain committed to conducting our business ethically. We will continue to focus on doing the right thing and providing quality service, regardless of efforts to unjustly tarnish our reputation.

    Thank you.

I am deeply disturbed on how a person can deny the damages caused by his workers. Batu was invited to see all damages on walls and the incompleted bathroom that he physically saw with his own eyes and agreed that it needed to be fixed. All photos sent to BBB are the actual photos taken of the work that he claims was complete. He agreed that the work done by his workers needed to be address to a better standing but he wanted a second payment before it was fixed which is clearly against the contract signed by both him and myself. View photos which was posted for your viewing. Also, photo submitted of the contract clearly states that 2 bathrooms have to be completed before another payment is paid. Batu knows the damages that 3 of his workers caused but refuses to take full responsiblity in correcting this situation. As mentioned I am requesting half of $6750 which was paid to him due to the extra expenses his workers caused me to have these damages fixed. All reviews that I posted in various media are true and people should not be swayed by his false comments made on the BBB claim. Please take this complaint seriously. I will retrieve all comments if Batu does the right thing. ******

I am rejecting this response because: Batu didn't make any effort to resolve this fairly. Instead he wants to distort the true to his convenience.
