I purchased used vehicle (3/1) that I never started nor test drove from the owner, Mr ********************* He told me the car needs a battery maybe a starter. Under duress, he had me sign papers and I told him that I wanted to wait until Monday(3/3), but he said its best to sign them now. I notified him the very same and next day that I didnt want the vehicle. And I have witnesses that can attest to that. So on Monday, after ignoring my calls and texts, all weekend, he drops the car off at a local mechanic, Andys without confirming with me nor giving him any written or verbal consent. I repeatedly told him that I didnt want the vehicle and he seemed to be unwilling to work with me to get something else prior to dropping the vehicle off at the shop. The owner ***** called him twice and told him that he scammed me and misrepresented the condition of the car and to come and get the vehicle off of his property. I then returned the title and key to the vehicle to his shop. I also disputed the charge on my card. This dealer is not ethical, lacks integrity and Im a woman and disabled veteran with PTSD and didnt know what I was doing. I hope he goes to get the car but so far he hasnt! He also texted me derogatory words after I asked him not to text me anymore and if he doesnt get the vehicle, Id see him in court.

I purchased a 2007 Ford F-150 from Batista Autos for over $12,500 (plus the $600 warranty). While I purchased the truck "as is," the vendor, Carlos, told me when I purchased the vehicle that it was in great running condition, had passed all requisite inspections, and was "a great truck". The day after I drove the truck off the lot, the check engine light went on. I immediately took it to a mechanic, who did an initial inspection and identified a number of issues with the vehicle, especially the engine (see attached) and the brakes. I then spoke to the dealer, voicing my frustration that he had misrepresented the condition of the vehicle and requested to return it. While the dealer refused to take the vehicle back, he conceded to replace the brakes and told me that any issues I had with the engine should be covered by the warranty. The mechanic did a thorough breakdown of the engine and submitted documentation to the warranty company totalling over $13,000 in needed urgent repairs, telling me that it was very clear that the truck had been extremely poorly maintained and that the vehicle needed a complete engine replacement, among many other things. I waited to file this claim until I heard back from the warranty company, which I learned today denied the claim. I believe Batista Auto's actions to be in direct violation of Florida Statute 501.976, "Actionable, unfair, or deceptive acts or practices, FL (4) Represent(ing) the quality of care, regularity of servicing, or general condition of a vehicle unless known by the dealer to be true and supportable by material fact." While I understand that I bought the vehicle "as is," I did so based on the dealer's representation of the vehicle to be in excellent working condition and with the added trust of the dealer being accredited by the BBB. I also just realized that the dealer did not complete the transfer of title by seller.

before ******* ******** purchased the 2007 Ford F150 she went for a long test drive, she like it and she purchased the truck AS IS( no warranty)no one force her to purchased the truck under those conditions.

After her mechanic thorough breakdown the truck a part she came with a big list of repairs in my opinion overcharge and Exaggerated. I told her to bring the truck to check it, after We check it We find in fact a lot of those claims was over Exaggerated.
the fact is she drove the truck and she like the condition of the truck at that moment, she make a decision of purchased sing a AS IS purchased agreement by her own will, next day ******* change her mind and started making all kinds of excuses to return the truck, we said no you own the truck, two day after she took the truck to her mechanic and her mechanic over exaggerated everything and now things got worse. they put a claim with car protection plus and the claim was denied, in my opinion the claim was denied because probably they have no evidence that the vehicle needed a complete engine replacement otherwise they would have approved the repair.
We never misrepresented ours product conditions that way all vehicle are sell As Is, we encourage our costumers to take for a test drive and base on they experience make a decision.
I have never see a 10 year plus used vehicle in excellent condition that is the primary reason they are sold As IS. But in more 20 year of Experience I have seen many clients have a buyer remorse do and say anything to get out of their agreement.
I personally gave the title to ******* ********.

(The consumer indicated he/she DID NOT accept the response from the business.)
The initial documentation I submitted spells out all of the reasons that I do not accept their response: I believe Batista Auto's actions to be in direct violation of Florida Statute 501.976, "Actionable, unfair, or deceptive acts or practices, FL (4)
Representing the quality of care, regularity of servicing, or general condition of a vehicle
unless known by the dealer to be true and supportable by material fact."

While I understand that I bought the vehicle "as is," I did so based on the dealer's representation of the vehicle to be in excellent working condition and with the added trust of the dealer being accredited by the BBB.

We understand your frustration and we are sorry that you feel that way, unfortunately we can not do anything. As you said, you understand that you purchased an As Is vehicle and the only representation Batista Auto Sales has made are the documents you signed on the day of sale including the NOT DEALER WARRANTY (As Is).
