    We were assured of a square footage price during multiple conversations. After receiving such assurances we received a bid in excess of 15% or $225,000. The vendors implied price caused us to select the vendor to rebuild our hurricane destroyed home. After providing $25,000 in deposits the vendor provided a poorly developed budget far in excess of our discussed cost he denied access to our plans and created an unapproved bill for unnecessary work at our home. We provided a deposit of $10,000 for the future demolition of our home. We advised the provider on multiple occasions that actual demolition was only necessary upon execution of a contract to build a new home on our lot. The provider stated on multiple occasions that demolition would be in late spring at the earliest. We by no means approved any work on demolition of our home. We provided a deposit for a future event predicated on an agreed event.

    To Whom It May Concern;

    In response to the complaint filed and referenced herein.  This person is completely fabricating what truly transpired.  He was quoted on the Design Build Agreement $500-$600 per square foot and he signed and agreed to this, and the preliminary budget came in at $614 per square foot for a home that was far different and considerably larger than what he originally expressed that he wanted.  During the Design process, my team communicated to him that the choices he was making would cause this design to exceed his desired budget, which he acknowledged and instructed us to proceed.  When the budget came in 2% over his original request, not 15%, we reminded him of the conversation and his directive to continue.  He denied that conversation ever happened, but we have witnesses that were in the very meeting.  I communicated a couple ideas that could potentially reduce the budget, but advised I did not think changing the design was necessary as in my extensive experience, I felt we could reduce the number to get within the quoted range if we proceeded to the next phase of design which would include more building details.  In addition, I offered to pay for the next round of design development if I could not reduce the initial budget and get it within the $500-$600 as stated on the contract, and he was agreeable at that time. He later became combative and belligerent, to which I responded the same way.  I simply told him we are probably not a correct fit for his new home.  He pleaded with me to continue to the next step in an effort to reduce the budget, only to later call me names and attempt to personally insult me and ask for a full refund on the design.  The Design Contract clearly states the deposit is "non-refundable".  I, however, went above and beyond by offering him a refund of the unused portion of his deposit, which I had no obligation to do.

    As far as the demolition goes, once a contract is signed there is much preparation work to do prior to demolition.  He never verbalized to me that he did not want the home demolished until late spring, he merely said he wanted to settle with the insurance company first.  We proceeded in marking trees and installing erosion control barriers and submitting for a permit application.  It takes 4-8 weeks to obtain a demolition permit, so it is a given we would commence the pre-start phase immediately.  Again, I went above and beyond and offered a refund of the unused portion of the deposit.

    He then asked if he could proceed with our trade partners absent of our representation, and that request was obviously declined.  

    Both refunds were accepted in writing and have since been returned to him. I find this a complete waste of time and energy, and should it continue, I will engage my legal team to pursue performance under the terms of both signed agreements.
