As of the date of this complaint, Servicemasters by PWF has had a contract to build out my ice cream shop since February of 2023. They started working in July (after a huge delay with obtaining permits) and assured me they would complete the job within 90 days. They have collected over $140,000 for the job and are still not complete. Every single week they make promises to complete the job and still have not completed. They are refusing to return my phone calls, text messages and emails. I have attempted to reach them in person at their shop and it was locked up at 10AM. I simply want them to finish my job and move on. They also have not paid multiple subs and they are contacting me for payment. At this point they have just a few more items left to complete - counters, glass, sinks/plumbing, trim/painting & inspections. I would like to be communicated with immediately and the job finished as promised.

      Business Response

      Date: 01/11/2024

We have collected what the contract states we are owed for our services based on milestones. We have not refused to return any calls or text messages. We respond at minimum of once per day and most days and far more often on others. Often times more than one of us replies. I agree there have been delays but it is the cause and nature of the delays that we continue to disagree on.

We were given a set of plans that were in complete or erroneous. There were doors marked to swing one way and the customer wanted them another so we had to install them twice and remove once after install. We had to stop the job while the customer contacted the architect about the lack of sprinklers in the design. Once it was confirmed they were actually needed, we had to hire a firm to design the system and install them per the plans. The customer purchased and provided a walk in freezer that was the wrong size and it had to be taken down and rebuilt. The sprinkler head that was already installed inside the freezer had to be taken out and reinstalled. The customer turned on the freezer with the charged sprinkler head inside of it which could have been a huge problem. The insured has tried to pay sub contractors behind our backs to do extra or unforeseen tasks which completely violates our agreement and jeopardizes insurance and more.

We have completed the job and passed all inspections and are eagerly awaiting final payment so we can complete our obligations to our subs.
