      I purchased a home from Gemini Development LLC on June 2019. I was given a 1 year builders warranty. 11 months in we had a full inspection done. One of the issues reported in the inspection was the vinyl flooring needed to be replaced as it was beginning to come up in certain spots of the home on the first floor. These issues were turned over to the builder, they denied to come out to look at the home or remedy any of them as the builders warranty only covers structural items.

      Then on January 2021, we experienced water/glue oozing up through the vinyl flooring in the first floor of the home. After discovering this, we were easily able to pull up approximately 25% of the vinyl flooring as it had water/wet glue underneath and we were concerned about mold issues. We reached out to Gemini Development with the request that they please come look at the home. They declined and would not assist with any repair as they claimed the issue was not caused by negligence on their part.

      We then hired multiple inspectors and engineers to help determine the root cause of the issue after not having any assistance by the builder. An engineer determined the 100% moisture found in the slab as well as the water underneath the flooring was due to improper installation of the vapor barrier underneath the slab. We sent a demand letter to the builder and they filed a claim with their insurance company in July 2021. Since this claim has been filed, I have had to personally following up with the insurance company and have received very limited communication from them. No communication from Gemini Development or assistance to resolve the issue and this has been going on for over 2 yrs. We've been living with half concrete/vinyl floors in our home and it's been an extreme inconvenience for my family. I'm pregnant and reaching out to try to get a resolution to our flooring issue prior to brining a newborn into a home with inadequate flooring. I've not been able to get any help from the builder.

      All new constructions inspections were completed and approved, prior to the issuance of a certificate of occupancy.

      This area has experienced increased development which may have created drainage issues after the home was completed.

      This claim has been forwarded to our liability insurance provider and we have been advised to refrain from additional comments.

      I am rejecting this response because: I find it unsatisfactory due to the length of time in which this issue has been present and the lack of communication from the builder to assist in a resolution in a timely manner. It has now been over 2 years since this occurred and is still ongoing today. To my knowledge there has been no working with the liability insurance company to come to a resolution to this issue that has been deemed as being due to insufficient work done during the building process which should ultimately fall on the builder as their responsibility.

      We are sympathetic to the plight of this homeowner but rest confidently upon the inspections completed during the construction process. The increased development in the area has created drainage issues for many, which falls outside of our purview.  We also are insured as required, and have referred the matter to our liability insurance carrier.  This is standard industry practice for this type of complaint.  We do not control over the speed in which they complete investigations or render determinations.

      I am rejecting this response because: although Gemini Development has turned this matter over to their insurance company I, the resident, did not purchase the home from their insurance company. I purchased the home from the builder and therefore the resolution should come from Gemini Development rather than mandating that I communicate directly with an insurance company that is not my own. Furthermore, after learning the claim has been dragged out for over 18 months, I would expect in good faith Gemini Development would want to do whatever is in their power to resolve or help to resolve this issue. Instead of leaning on the insurance company or inquiring about the claim Gemini Development seems to be passing the blame. It is not customary for the resident to be in contact with the builders liability insurance company. I am only respectfully requesting the builder remedy the issue which was found to be due to a building defect when the home was built.
