      Mr. ******** home is currently under contract and due to close early June.   He received a full price offer on his home, which he accepted.  Unfortunately, the home didn't appraise for the contract price which I understand Mr. ****** was not happy about, and understandably so.   He was explained his options as far as proceeding with the current contract to which he agreed to move forward with and signed an addendum agreeing to the new terms. Mr. ****** has reached out to the Grant **** including **** the agent in direct contact with him as well as ***** who processes the files. They have both explained to Mr. ****** multiple times each step along the way as well as provided him with documentation and financial breakdowns of what he can expect to pay for to complete the sale as well as what he will receive once it has closed, all to which he has agreed to in writing.  It appears **** and ***** have been extremely patient and accessible to Mr. ****** and explaining and answering all of his questions.   It is my understanding he has called into the office and been extremely irate to ***** and **** and very accusatory when everything he has agreed to have been acknowledged in writing and explained at great length to ensure he understood the process on multiple occasions.   I see no grounds or understand Mr. ******s request for any type of reimbursement as he has signed a listing contract and a sales contract agreeing to all terms and conditions.  RE/MAX Anchor Realty and its agents have performed based on the obligations of the agreement with Mr. ******.

      they are leaving out the parts where when questioning charges about closing cost being told to except offer or move on and being told to shut the F___k up! So is second time speaking with ********************* with outcome. In several months.

      also giving ultimatum by them hope you dont sign so can take legal actions which would cost thousands in losing sale my legal fees are covered and next step Have printed voice mail from ********************* if needed. 
      these are serious ethics issues. Leaving me choice but to sign ********************* commission of ,$10,047.00 should be adjusted to cover the $2,344.30 was never told there was option for buyer to pay only that was part of closing at that point during explanation was told by ********************* to shut the F___k up at point I ended call.

      We listed property with ********************* Team of ReMax Anchor Realty effective 2/7/24 thru 6/1/24. The agent we were working with stated that he would market the property via a broker's open house offering incentives to attend said open house (sunset cruise tickets), on international website/s, ReMax website/s, weekly reports would be received on activity occurring that week. A few weeks in, we asked ReMax to offer a $1,000 bonus to selling agent. This bonus wasn't offered and did not appear on MLS to best of our knowledge. The listing agent hasn't returned calls/emails the last couple of weeks except on Good Friday, a holiday. We have received the weekly emails which all indicated no showings. but no evidence of other marketing other than a yard sign, MLS listing, and a few flyers inside house. We were approached to reduce the price to a level we felt wasn't warranted or in our best interest but simply for ReMaxs benefit. We have kept up with the comparable properties in the community & the price is where it belongs. We feel that ********************* Team of ReMax is not in compliance with its listing agreement in using its best efforts. We contacted ********************* 4/3/24 to request cancellation of the listing agreement. ************** asked why we wanted the cancel. We have scoured the listing agreement for a clause that requires we give a reason; we didn't find a requirement to give reason and told him so. ************** simply stated: denied. No documentation of ReMax "best efforts" have been provided other than weekly report. His last email stated that he would not be responding to any further emails. There are approx. 8 weeks left in this contract. It is reasonable that if ReMax really wasn't marketing our house prior it really won't now that we have made this request and complaint with BBB.

      I am rejecting this response because  reject ***************** responses as they are generic and unsubstantiated. He provided no supporting documentation of any of his claims either here or in any other manner.
      It is important to note that it was the ********************* Team that first brought up the list price of our house.  The ********************* Team was eager to secure a listing agreement.  This Team quickly started talking about price reduction.  Given they strongly feel that the house is not priced appropriately, the ethical choice for the ********************* Team would have been to decline the listing during our only in-, person meeting. Instead, they began trying to pressure and try to manipulate me to reduce the price in my opinion so that they could rack up a quick sale for their firm. 


      Regarding ***************** recommendation for a list price of $299,000, my research shows there have been 5 sales in the ****************** since 11/7/23, within the maximum 6 month period recommended by real estate professionals.

      Sold prices range from $280,000 at lowest to $389,000 and price per sq. ft. ranges from $199 to $265 per sq. ft.
      Realtor.coms ,Real Estimate of my home is $316,346. 
      A spreadsheet with information from Realtor.com, the most well known tool available to the public and Realtors and summary is attached.
      When information was requested of the listing agent that he substantiate his claim that other homes in the neighborhood are priced below ours, a list of 10 pending or sold homes were sent.  None were in our ******************* Among the inconsistencies of industry standards for comparable market analysis, most properties were further than the half mile distance and many  very much exceeded the 5 years age difference guidelines.
      The remedy I seek is release from the listing contract.  I continue to maintain Re/Max Anchor Marina Realty, *********************, has not provided professional quality services, used comparables that are not consistent with industry standards to propose a list price, nor has he provided documentation of his best efforts per the contract other than the **** yard sign, and flyers inside of the house.

      I contacted ******************* about possibly listing my home for sale as he was just starting out and a former fianc of my oldest daughter. I thought I was helping him out not knowing the complete nightmare I had created. **** and ********************* both came to my home on Aug 15. I thought they were letting me interview them to possible sell my home. Neither ***** nor **** walked though my entire home nor did they walk around my back yard. They basically brought comps of what ***** had sold in the past. ***** felt I should list my home at $435,000.00 given what he felt the comps were and the fact a home that is the exact same model has been listed for $469,000.00 with absolutely zero offers. I feel the reason that home hadnt sold was because they have a neighbor who legit has a junk yard in their front, side and back yard. ***** and **** both disagreed they felt it was because the house was over priced. The paperwork I signed I had zero clue as neither told me it was a exclusive listing contract with them. They didnt go over their commission rate or the length of the contract. I never received a copy of what I signed until 48 hours after signing the paperwork. I have found out they are required to leave a copy of what I signed at the time of signing as well as a copy within 24 hours. They did neither to make sure both were full filled in that time frame. After telling them I did not want my home put on the *** they did it anyways. They listed it then quickly pulled it off the market. They never took pictures of the inside or outside. Yet still listed it. The commission rate on the listing ***** stated is completely not the same as on my paperwork. Nor are the descriptions of the flooring or features in my home. They refuse to let me out of the contract until Aug 16,2024. The have been nothing but unethical, dishonest and extremely unprofessional from the time they came to my home on Aug 15th. I feel they wanted to list my home low so it would sell quickly for them.

She reached out to ***** & **** after signing the agreement to raise the price which they did, even after providing her with viable comps of comparable homes.  ************** has refused to allow access for photos to be taken to complete the agent's obligation per our MLS rules to properly market her property.  Therefore, she is in breach of contract.

      I am rejecting this response because:
      The paperwork I signed I never received a copy of until 2 days later. The papers were signed on Aug-15-2023. They are required to be in my possession at the time of signing and a copy within 24 hours. In addition the commission rate is shorting the buyers agent at 2.5% not the 3% as noted on the contract. Not sure what the actual commission rate is. Seems to be 5% according to the mls listing.

Agreeing to all the terms included- If she was not in agreeance, she had no obligation to sign.  She later notified ***** she wanted to cancel his contract because she knew someone who would list it for less.  ************** is in default of her listing contract and will be passed over to our legal counsel.  The agents have complied with their contractual obligations.

      We signed with *********************, we had a price in mind, but he said that comps were at a lesser price so we allowed him to tell us what to sell the home for. After that we were pawned off to **** an could not contact *****. We responded to every request for a showing positively but there was only two before we called an ask to please have an open house to try and get some eyes on the property, we had to ask them to schedule an open house, and the response was as if we were asking for world. Then we called again asking to lower the price to try an get more interest. Once again ***** said to ask more than we were asking so we agreed based on him supposedly knowing the market. When a cash offer came in way lower than ***** had said, we received a half hearted call from **** with the offer and an email. I asked what to do and was advised to counter which was refused. Nowhere was ********************* to say the market was less than he told us or that this was a good deal, nothing at all from the realtor that was supposed to be selling our home. With only 2 more showings in 63 days, I requested to pull it from market and release the contract because I didn't feel comfortable with him acting in our best interest. His response was to refuse to end the contract, refuse to answer any questions posed to him. I know as a fact that an offer was made to him that was never brought to me, a clear ethics violation. I have never been as upset and purely disappointed as I am with his lack of action and lack of response. His only response is to keep lowering the price, he was the one who suggested the price and set it on the *** when we were asking it to be set lower. Now he's trying to blame us and will not end the contract we believe purely as a punitive measure against us even though he knows that because of his lack of response and our feeling very uncomfortable with his actions we will not sell this home as long as his contract is in place. I believe that he only his interest in mind.

      On 12/15/22 after meeting the seller on **** Pellam they were disappointed to hear that the prices were lower than expected however they agreed to list the home for $339,500. That price was much higher than the $315,000 that I suggested (please see attached). 

      As of 1/9/23 we had not had any showings I suggested we reduce the price in order to gain interest. The sellers stated they could only reduce to $329,000 and would rent it if the home couldnt be sold for more than $325,000. We reduced the price.

      On 1/10/23 we received an offer that was presented but we did not come to terms on the price. This was the only offer we received on the home.


      1/14/23 the seller requested an open house to which we accommodated.

      On 2/17/22 we only had a few showings and the seller voiced his frustration. I suggested that we either reduce the price of the home or rent it. Per the sellers request, the home was placed *** while he reached out to rental agencies.

      On 2/22/23 we received a call from a ***************************** agent named *********************************** who called to state she was going to be listing the home for sale for the sellers. She was informed that we have a listing agreement in place and that the home was placed *** while the seller looks for a rental agent.

      In the time since we have received a number of negative emails from the sellers family members (please see attached). These emails did not pertain to the listing and did not come from the seller on the contract.

      I am rejecting this response because: There are several blatant lies in this response. The fact is that the initial price was the was what was suggested by the agent. He said we were by following his suggestion, pricing it slightly below market and that it should sell quickly. Then due to only 2 showings in over a month, we suggested to lower the price to ******* and the agent said to price it higher and HE set the new price. We had to ask that they please hold and open house to try and get eyes on the property. I told the agent that we were going to rent the home because he was not willing to release us from the 12 month contract that he had a blind man sign without reading the contract out loud to him and the fact that I was not willing to allow him to sell the house because we do not believe that he has our best interest in mind obviously due to him wanting to price the home at more than what we said to price it at. He also never provided us with any paperwork authorizing the price changes, he never provided us with paperwork authorizing the removal of the property from the MLS.  When speaking with dozens of other agents I have been told that any action such as these must be written and signed by the agent and client. I was also told that an offer from Opendoor was submitted to the agent and not transmitted to us, an ethics violation according to the ************** of Realtors. There were also several written over areas of the contract without initials and a hand written addition to the contract without it being initialed.
