Klingbeil Capital Management professionally manages an apartment building called ************************. My lease agreement with ********** ended 6/2/2024. I notified property management in writing 60 days prior to 6/2/2024, of my intent to vacate. On 10/1/2024, I received a notice from a collection agency called ****** ********. This notice stated that I owed ********** $836 with no explanation as to what for. Klingbeil Capital Managment and ********** never notified me in writing or electronically of any outstanding charges after I moved out and my lease ended on 6/2/2024. Additionally, I paid all outstanding balances owed to ********** prior to my lease ending. On 6/4/24, I had an email conversation with the property manager related being incorrectly billed for the month of June. An outstanding balance of $836 was not mentioned at that time. I am requesting a full explanation of charges owed to ********** and a billing adjustment to remove all outstanding charges as I was not notified properly. I am also seeking a correction to my credit report as this outstanding balance was sent to collections.Business Response

Our team at Klingbeil Capital Management***** has reviewed the complaint(s) submitted to your organization by our previous resident Ms. ******** **** who resided in 2500 Boca on Federal. Based on our findings, we understand that a discrepancy regarding final move out charges has been discovered. Since identifying this discrepancy,our team has updated ******************* of Deposit Account (SODA) reversing the charge of $445.41 for paint, and reversal of the flooring charge of $428.30 resulting in a credit refund of $37.71. This refund check will be mailed directly to Ms. **** via certified mail to the forwarding address provided. We believe this matter to be resolved, with no further action required.

In May of 2023 I signed a lease with my son's biological father and we all moved in together. Shortly after moving it I was being harassed and recorded without my consent in my own home. The safety of myself and my son was compromised and the other lease holder was also filing a lawsuit against me while living under the same roof as us. I kept asking him to move out and I would keep the apartment and make sure the bills were paid, etc. He refused to leave and made lots of threats if I tried breaking the lease. I was informed by the leasing office I would be able to break the lease if I paid 2 months rent penalty. I was willing to do this so we could separate and my son and I could go somewhere safe, but the other person on the lease with me refused to move out and continued to threaten me if I tried to break the lease. June 30, 2023 my son and I went on vacation to visit family in MA, upon returning all of our personal and private belongings were all taken out of the apt without my knowledge or consent(never recovered) and the locks were changed and not even the leasing office knew that. I have a police report but unfortunately they weren't able to do much. I have a bill for $7,100.99 that I have tried DOZENS of times to pay and was working with the leasing office to pay and THEIR website was not working for payment. Now I have a bill in collections-I have a 800+ credit score and this will hurt it so I am disputing it. I turned in my key and told them I was not returning to that apt on July 31 and they refused to allow me to break my lease even if I paid to break it because they could not force the other lease holder out. But he refused to pay and just left one day with the key in the door. In summary-I was willing to pay to break the lease, and I was denied even though there was an issue of safety. Then I tried paying the outstanding balance and they gave me no resolution to pay it. Now I am in collections and will be disputing because this is bad business!!Initial Complaint

I'm renting an apartment with my room mate, and we only qualified for this apartment due to our combined incomes. He (Service Member) recently submitted he's PCS orders to break the lease, and instead of writing up another lease for me to sign, he was simply taken off the lease, kind of a work around to the law. Now, with my 59k a year salary, I'm forced to stay on this apartment which requires a MINIMUM of 85k a year to be approved for. I've been speaking with my JAG (I'm also active duty military) currently, awaiting to hear back, but I can't believe the apartment would try and pull some stuff like this. I explained to them, in detail, that I alone cannot afford this apartment, which is **** a month. They told me "well you qualified for this apartment when you applied, so we're not worried about whether you qualify or not". Yeah, I qualify with DUAL INCOME, not the 59k a year I make now. I told her i wont be able to pay next months rent in total, she told me id get evicted and have to pay those fees, i told her i cant afford the 6k to break the lease, she told me itll go to collections, destroy my credit, and reflect poorly on my rental history. If this needs to go to court, so be it. I CAN NOT reccomend any property managed by KCM, and I hope this can be fixed before April 1st, because I CAN NOT afford to live here anymore.Business Response

I've lived in this apartment complex for six years. Never late on rent, even during the height of COVID-19. Ongoing disputes with new neighbors in the next door apartment (F2) since they moved in February 2022 including very loud music and dog feeces on the adjoining patio for days at a time. They refuse to answer the door to discuss the matters. Rule enforcement my the management has had limited and temporary success only. The *********, ** police department advised they can't have to answer the door to them either, and that moving is often the best next step. After seven incidents the Klingbeil Capital Management company has denied me request for permission to break my lease without ANY penalties.Business Response

We take great care to ensure that important matters such as this are processed and managed. I understand that the matter in question was not handled in a manner in which you anticipated. I had spoken with the on site team regarding this matter and the ongoing nuisances involving your neighbor. The on site team had sent legal notices to your neighbor demanding to cease all nuisance activity in/around their home. If this continued, a complaint would be filed with the court. It is my understanding that the nuisances had ceased and thus, may not be necessary to pursue legal action against neighbor at this time. We also did not find it necessary to ***** a 'no penalty' lease break at this time.
Please let me or the onsite team know if the nuisances occurring around your home have in fact, continued and we are willing to discuss a 'no penalty' lease break. Our goal is to succeed in meeting your expectations. Again, we take all resident matters very seriously and strive to ensure a positive outcome.
