    On November 5, 2024, I entered into a signed agreement with SOMOS TUIA LLC, managed by **** ********, for the development of a custom software platform called Genius ************ Tracker. The agreement stated that the service would be delivered in 5 weeks, and I paid $10,080 USD via wire transfer.After more than 5 months of delays and excuses, the final delivery was incomplete, non-functional, and far below professional standards. A formal technical audit revealed critical issues: missing features, security flaws, lack of deployment automation, and unstable frontend code. Despite sending a formal legal warning and requesting resolution, the company failed to comply or offer a refund.I have submitted complaints to the ************************ (***), ************ (their payment provider), and I am in the process of filing a Small Claims Court case. This report to the BBB is part of my effort to hold this company accountable for unethical and fraudulent business conduct. I am seeking either a full refund or immediate delivery of the complete, functional software as specified in the original agreement.

    SOMOS TUIA LLC is not legally registered in any U.S. jurisdiction.
    There is no certificate of formation, EIN, or any state recognition of this entity.
    This confirms that the company has been operating, advertising, contracting, and accepting payments under a false business identity, without legal authorization to do so.

    Following the initial complaints, Mr. *** **** ****** Daz, acting as a representative of SOMOS TUIA LLC, contacted our team expressing willingness to resolve the situation. Despite this outreach, the company has failed to deliver the required corrections or fulfill any obligations outlined in the contract. Over five months have passed without resolution, and the minimal commitments made have not been honored.
    3. Current Status of the Dispute:
    Continued evasion of contractual responsibilities.
    No corrective actions implemented despite multiple requests.
    Official closure of all extrajudicial settlement options.
    Legal action has been initiated.
    4. Escalated Demand:
    Due to material breach of contract, direct business loss, reputational damage, and the need to contract a second technical team, our updated financial claim is as follows:
    Original refund requested: $10,080.00 USD

    Update on Case #******** Formal Legal Action and Financial Reclamation Steps Initiated
    Dear BBB Representative,
    We are writing to provide an important update regarding case #******** filed against "Somos TuIA LLC".
    Despite a final attempt to reach an amicable resolution with the company, they failed to accept full responsibility for their contractual breach. We issued a last formal notice granting them a chance to address the situation within a limited timeframe, but no satisfactory response or corrective action has been taken.
    As a result, we are formally proceeding with the following:
    Filing a lawsuit in Texas Small Claims Court for the full reimbursement of $10,080.00 USD and an additional compensation for damages caused by breach of contract and loss of business.
    Filing a report with the IRS regarding the company's income and tax declaration irregularities.
    Our bank (Truist) has officially submitted recall requests for the five wire transfers made to the account associated with "Somos TuIA LLC" and is in contact with the recipient financial institution (************) to investigate and potentially reverse the transactions due to contractual fraud.
    We have requested from ************ verification of the legitimacy and registration of the receiving entity, as no legal registration of the company exists in public records.
