The transaction began on Oct. 15 when we gave Lacy Lampkin of AAA Concrete a down payment of $4,500 for a $12,000 concrete job (including materials and labor) for removing damaged portions of our driveway and replacing them with new concrete. A succession of errors began resulting in a grossly inferior job and damage to our property and to our neighbor's metal fence. The major complaint is that Oct. 31 we received a letter from SRM Concrete , Murfreesboro, TN, stating that we are liable for the concrete and a lien may be filed on our property. No money amount that we supposedly owe was stated in the letter. Jan. 20 we received a 2nd letter from attorneys Bogin, Munns, & Munns in Orlando stating that Smyrna Ready Mix Concrete has recorded a lien on our property, we owe them $4,673.03 for the concrete, and we have 30 days to pay this amount, plus interests, costs, & attorney's fees or face court action. When we call Lacy Lampkin, he says he paid for our concrete & SRM must have credited it to someone else's account or he has his lawyer working on the dispute and that we are not liable. We have no knowledge of how many yards were delivered, and the charge of $4,673.03 seems excessive. Also, while pouring our driveway, Lacy used our concrete to pour hastily and sloppily a single car concrete pad for our next door neighbors so we are being charged for our neighbors' concrete too, which they already paid Lacy for. We paid Lacy Lampkin for the concrete in the $12,000 we gave him (we have cancelled checks as proof) and are outraged by the threats and intimidation by SRM Concrete. They have been duped by Lacy Lampkin and are trying to make us pay for their sloppy business practices. Before the concrete was ordered or delivered, my husband went to SRM Concrete to check out Lacy Lampkin's business behavior, and Eric Poor, Plant Supervisor, vouched for him. He stated that at that time Lacy Lampkin was in good standing with his company and he had been doing business with him about 6 years. We want to be cleared of all charges by SRM Concrete, Lacy Lampkin to lose his A+ rating with BBB, to be compensated by Lacy Lampkin for the damage to our property and the repairs needed to repair his sloppy and unsightly work, and we want to know what recourse we have against SRM for their harassment and intimidation. In addition to the cancelled checks for the $12,000 we paid Lacy Lampkin, we have copies of the letter from SRM Concrete, the letter from the Orlando attorneys, the original contract with Lacy Lampkin, and photos of the damage to our property and the inferior workmanship.
