I financed a vehicle 10 mths ago from this company. I put a 2900 down payment and find out by the mailed receipt that only 1600 was recorded as sent to the finance company. Since day 1 it was a bad sign. No gas in car. 2nd week one of the dual mufflers fell off. I paid to get it welded back on when car was lifted there was nothing but rust damage underneath the vehicle from sitting in flood waters. I MADE ALL PAYMENTS ON TIME with the finance company automatically debited from my account!! I called finance company reported everything that I was going through sending proof of pictures and receipts. Then 1 month later a tire blew out. Had tire company check it and the tread was coming apart on 2 tires in the middle you could see wires. Not too long after the back up camera stopped working then the front seat motor went out ! I tried to adjust and leaned it back to go forward and it stayed in the back position never returning forward! I took it to a shop every time something happened. There was also an apple tracker on my vehicle tracking my every move that pinged to anyone who got in car with an iPhone. I had the police department search my vehicle and find it which was the first week I got the vehicle !!! Then I was reimbursed by the finance company for all the car payments that I made and it was mailed to RPX to give to me and they signed the back forged my signature and tried to cash it !! These people pocket 1/2 my down payment as well. I returned after some time back to this dealership for them to mail back for another to be reissued and still have gotten it !! They blocked my calls!! I am pressing charges since the manager never not once has called me through anytime wont return my calls that Ive left with the secretary and ****** I have text messages after messages. Dear Better Business Bureau (BBB),
In response to the complaint filed by Ms. ******* ******* we would like to clarify the events in accordance with the records and facts surrounding the transaction and financing of the vehicle purchased.
Payment History and Financing: Ms. ****** purchased a vehicle from us, which was financed through ******************. The customer made payments on only three installments out of the six months she had the vehicle, as shown in the bank statement provided by the customer herself. According to Florida law, failure to meet payment obligations can result in the repossession of the vehicle, and after several months of non-payment, the finance company decided to cancel the contract and initiate a Buyback of the vehicle, returning it to our company.
Vehicle Sold "AS IS": The vehicle was sold in compliance with Florida law, which stipulates that used vehicles are sold "AS IS," meaning without warranty, as indicated in the documents signed by the customer. Ms. ****** was informed of this term at the time of purchase, which is confirmed by the signed contracts.
Attempts to Resolve Amicably: After the finance company returned the vehicle to us, we contacted Ms. ****** to request the vehicles return, as the contract had been canceled and the financing was no longer being paid. Ms. ****** informed us she was traveling and, upon her return, stated that the vehicle was hidden and only she could deliver it. After waiting for over 30 days, we hired a professional company to locate and repossess the vehicle. However, due to the customers background, which was flagged as high-risk, we decided not to proceed with the repossession.
Vehicle Return: Eventually, Ms. ****** contacted us and suggested a meeting point to return the vehicle. We went to the location in good faith and received the vehicle, although it was in poor condition. We explained to the customer that due to her non-payment, the amount she had paid was forfeited, as stipulated by Florida law, and that returning the vehicle was the only viable option to avoid further issues with the finance company.
Forgery Allegation: Ms. ****** accused our company of forging her signature on a cheque related to the Buyback. However, all documentation and transactions were carried out according to legal and contractual procedures, with the customers signature confirmed on all relevant records. The bank issued a cheque to us that, by law, was rightfully ours, and we deposited it into our account. Upon comparison with the document provided by the customer, there is no evidence of forgery, as can be seen from the analysis of the documents.
Next Steps and Legal Guidance: While we have made every effort to resolve this matter amicably and within the bounds of the law, we understand that Ms. ****** continues to dispute the facts. Therefore, we suggest she consult with an attorney so that the matter can be resolved through the legal system, as we are fully prepared with documentation proving that we followed all applicable laws and fulfilled our contractual obligations.
We would like to reaffirm that our company acted legally throughout the process, and unfortunately, we cannot refund Ms. ******* as there was no fault on our part, and the terms of the contract and Florida law were fully adhered to.
We appreciate the opportunity to clarify the facts and remain available to provide any additional documentation, if necessary.

I am rejecting this response because:
these are definitely not the facts to what really happened. Im very shocked to read these false accusations. My payments were on time I was not behind. Under negotiations I was told I could give the car back and cancel the contract due to all the issues with the car since I bought it. The muffler fell off, which I have a receipt for the motor in the driver seat died on the second month of having this vehicle. I am the one that reached out to United auto credit and file a complaint. They had to go back-and-forth with RPX auto to come to an agreement that I could cancel this contract due to them selling me a lemon. ******* also offered me to see if I wanted another vehicle off their lot and that they were returning me my car payments incase I wanted to with the dealers name on check as an option This is why both names are on the check. I showed proof that is my money from my payments. There is no reason for a finance company to refund my car payments to give RPX. They have fabricated reasons to withhold my money saying its about my credit because I was not at high risk. There was nothing on my credit but a low credit score. Ive never had a repo and I did not have any outstanding amount of debt either as a matter fact I am currently driving a 2024 *****, which is my third ***** directly from the dealership. I only went to the buyer pay here and intentions to buy a vehicle for my college daughter, and it has proven to me not to be safe. I have proof of my car payments coming out of my bank account paid directly to US auto that amount of money was put on a check to be returned to me and RPX auto is holding my money after cashing the check. Also, I have bank statements of the down payment that I put on the vehicle and these down payment amount of money does not match with the paperwork that ****************** sent me. I have worked 15 years in a law firm. I have no issues with being able to provide evidence and I do know what monies belongs to me. I also have several text messages back and forth on several conversations. United auto credit told me not to give them the car until the check was given to me the day that I met with them and they had the check on hand. My name had been forged scribbled out and they also endorsed it as seen. They told me to bring the check back up to them and they will get another one re-issued. I have been waiting for months for it to be re-issued. Which I also have proof of this. I was given excuses after excuses that the manager was not in office or traveling . If my monies are not returned before end of this month then yes I will have to persue what legally belongs to me. I will present additional documentations, saved voicemails and messages as well on how they even reached out to meet me and stated they were bringing me my check.

I bought a 2013 Volkswagen Passat from RPX CARS on or about 8/24/22. I was given a 30 day warranty on the engine. The owner directed me to go to his mechanic to do the work 1 day after purchasing the car the mechanic and I sat in the car as he performed a diagnostic test where he eventually saw that the car needed a new Cam Shaft because the car was not accelerating. The mechanic told me to drop the car off to him the following day and he would keep the car for the day to change out the Cam Shaft. Fast forward to 6/14/23 I received a call from my son stating that the car is not accelerating so I took it to 2 different reputable mechanics and each mechanic stated after doing a diagnostic check that I needed a new Cam Shaft. I explained to the mechanics that I just had one replaced and was told that NO CAM SHAFT HAS EVER BEEN CHANGED IN THE CAR. I went to speak with the RPX Owner and was told that my 30 days have passed, and he could not help me. I spoke with the original mechanic, and he states that he was told by the owner to just fix the cheapest way, so I was never informed that there was more work that was supposed to be done. According to other mechanics the Cam Shaft would cost close to $1400. and would take at least 48 to 72 hours to fix it is my belief that the owner new this but basically put a band aid on the issue. So I would like to be made whole by having the car fixed properly considering that the job was not done as it was reported to me at the time.Business Response

We are a used vehicle store, all our vehicles are revised and inspected before going to the sales hall.
In Florida, used vehicles do not have a warranty, but even so, we offer a 30-day engine and transmission warranty (even though it is not mandatory), but we value the guarantee and comfort of the customer, as we guarantee our product.
In this case we are talking about, this gentleman bought the vehicle, questioned the problem and it was solved, we are talking about 10 months that this gentleman bought the vehicle, he was given a 30-day warranty as mentioned, why did he not contact us sooner? He had 30 days, why didn't he search with 60 days? It would be a pleasure to help you.
But with 10 months it is impossible. We are here at your disposal and we want the best for everyone, but in this case there is no basis for this situation.
If you are interested in buying a new vehicle, it will be a pleasure to give you a discount for a new vehicle, we can even pay the price on the used vehicle as it is in perfect condition to help you, but guarantee is impossible to give.
