I purchased a TYM tractor in December 2023 from the sale representative ****** Boilean. During the purchase, I explained my intent to use the tractor for business. ****** sold me the tractor but he never told me they cant not maintain, or service the tractor in a time manner. That means whatever happened to the tractor, minor or big problem, The tractor stays months in the shop to be fixed. That is because the business model is really bad. Products come from overseas and they never have enough stock in the store. And there always find something to blame. He never disclosed that the customer service is really slow and inefficient . He made me believe I could have the tractor and use in the business. But the first time any little thing happened, like a banding a bracket, the tractor stays in the shop for months on end. No business can survive without working for months. I was mislead. I was made of fool. He put me on a had spot when my tractor is broken for 8 moths. Since Jully of 2023. I lost all my business and a lot of money. Nevertheless, with no money coming in, was still responsible to make the Tractor payment. Today, I dont have a business anymore consequently No need for the tractor. I know for a fact, if he disclosed this information to every buyer, no one would buy tractors from them. I feel like they wronged me. I feel like I was lied to. I pushed against the corner . This is a money, hungry dealership that tries to shame the customers and always screwed the customers. They never told me, I bought a ***************************. however, the tractor is from 2023. The entire inventory is at least two years old. They are doing really bad business and must be stopped right now in their tracks before they hurt more people, I hope my story serve as a warning. I will pursue every channel legal channel to bring this absurd scam into a fair resolution.Business Response

We have reached out to the customer. The customer has his ********************** back. Some of our manufacturers are still having issues with supplying some parts. We have worked with the customer and explained the issues. Since April 2024 we have new management and take feedback from customer very seriously. Ocala Tractor picked up my TYM tractor for repair in May of 2023. This is the third time it has been in for repair. It is now January of ****. I receive No phone calls or updates. When I call them myself Im told something new is wrong and they are waiting for parts. In august of 2023 I was told the bill was over *******. They have done other repairs since (solenoid, etc.). I cant burn up a solenoid if I dont have the tractor. I am still making monthly payments on a machine I dont have and had to purchase a different machine to help with farm work. I feel this tractor has had major problems since day 1 and even if it comes back Ill buy another brand from another dealership.Business Response

Attached are details of the conversations and notes with the customer.
Service Writer sent an estimate to the customer through regular email three days after the tractor arrived. The customer did not respond. The service writer then sent an estimate through our CRM system on 6/26. Customer still did not respond. Service Writer reached out to the customer 2 days later and was finally told to go ahead with repair and " I don't want any more communication until the tractor is return to my home." This request was honored apart from one response to let the customer know that their proposed time frame would not be possible without *************** ordering. Parts took over 4 months to arrive from the manufacturer. These parts fixed the complaints that were on the original repair (dash not functioning, spindle, 4wd). The new dash worked but there was a light found to be on for the glow plugs. Due to the length of time it took for the parts to come in, we tried to fix the glow plug light issue at no charge to the customer. These were the new parts that the customer speaks about in the complaint. Unfortunately, when a customer says not to reach out to them, we are forced to honor that request. Due to the customer now requesting that we communicate with them again, we have reached out to the customer and sent them an estimate for the further repairs. The tractor is in proper functioning order, apart from the glow plug light. Replacement requests must be done through the manufacturer, not the dealer, as warranty time has elapsed and the tractor is registered with the manufacturer.

I am rejecting this response because: ************ has Lied. I have paperwork that shows the date the tractor was picked up. 8 Months, not 4. The solenoid repair was not mentioned in the response. Just spoke to **** who said estimate was sent yesterday then told my husband it wasnt even completed yet. I guess I will have to settle for so-called repairs, however, once it is home it will Immediately be traded for another brand and service department.

No one said the unit was picked up four months ago, the original parts took four months to arrive due to nationwide parts shortages. The solenoid was to repair the 4wd. The tractor will be repaired per estimates given as soon as the parts are able to be located.Customer Answer

The estimate is likely more than the tractor is worth. It has never run properly. I suggest the company sell tractors that have more accessible parts so no one else gets burned. I will be paying for repairs and trading it for a more reliable brand.Customer Answer

12/21/2022 Purchased a used tractor 2015 B3350 ****** Tractor with a front loader on it. Salesman said it just came in on trade. He said it was in great shape and runs great. It has only 760hrs on it. I purchased for $23500, and it was delivered late 12/22 Wednesday. It started and drove OK in the morning of Thurs 12/23 and the next try it would not start. Thought it was me because after dinner it started fine. I called Ocala Tractor, but no one was there to answer question. The tractor did not come with a manual. Ocala Tractor was on leave for the holidays. I had an issue starting Monday 12/27. I called and reported the issue. I explained the process I looked up on ****** website and it was that tractor. They picked it up and after having for a week they finally say the "No Crank" issue. They said I had to pay $951 to fix it. I received a defective product from them. In their panic they tried to tell me that it was a consignment and it not their responsibility. The bill of sale is from Ocala Tractor, it is not listed as consignment. The deception from them is bad and folks should know about it. I would like the cost of repair so I can bring it to a reputable repair shop.Business Response

The tractor was a consignment piece and was not our property. It is also not a brand that we sell. Since the unit was a consignment, the lack of a manual is not something we can help with. For the couple of days that the unit was here, it worked with no issues. Customer clearly states in his complaint that the unit worked when he first used it at home. There is apparently an intermittent issue that is unable to be predicted. Customer was offered extended warranty and declined. Customer signed multiple times that he was purchasing the unit "as-is". Our Service Manager reached out to the customer and offered to ask the consignor if he would split the cost of the repair. Customer refused this solution. No further remedy is available.

The salesman Eric said it was a trade in for a bigger tractor. He sold me on a used tractor that he indicated it may have a year left on the factory warranty. The unit was sold by Ocala Tractor with an Ocala Tractor Bill of sale. Ocala Tractor did see the problem on the day they were going to return it to me. They issued me a bill for repair. So, there are 3 discrepancies in their response.
There extended warranty was overpriced and had a clause that stated I have to pay their lawyers if someone gets hurt and sues them for fault. Kind of suspicious. They stated that was covered by ****** dealership. It is not covered by ******. I spoke with ********* ****** 01/10/2025. The warranty they were selling was 84mo but was only covering the unit till 12/17/2025. Not 84 months. I have chosen another extended warranty company. However, they require a functional unit just as I do, and thus require a ****** dealer inspection.
The "as is" clause is for "as advertised" good working unit. It was not functioning after it was turned off and needed to be re-started. That would be Day 1. The service department or anyone in sales (Eric) never said anything about this being consignment. On 01/10/2025, Joe in service said it was consignment. I was sold a used tractor by Ocala Tractor with their Bill of Sale. I was not notified that they reached out to the previous owner, I was not even told whom the previous owner was. The only seller here is Ocala Tractor. Don't let them sell you a load of manure.

There was no warranty on the unit. Customer signed as-is forms multiple times as is standard practice on used equipment that is out of warranty. We have reviewed all documentation and found nothing stated that there was any warranty left on the unit. The "extended warranty" offered at the time of purchase was an insurance policy that should be accepted at any dealership.
There is no clause in the warranty that states anything about having to pay Ocala Tractor lawyer fees if someone is injured.
The "as is" clause states that the unit is sold "as-is". Again, the customer stated that the tractor was functional when he took it home. It was functional while it was on the lot. The fact that there was an intermittent issue was unknown to us. We even went and picked the unit up for free and couldn't replicate the issue immediately. The fact that the unit was a consignment only became an issue when the customer demanded to get out of the contract we had all agreed to and asked for a discount on a tractor he had knowingly purchased "as-is". Customer was given ample opportunity to protect his purchase at the time of purchase. He declined them.
