I entered into a written contract with this company on June 19, 2022; to install a new roof at my residence and I paid $14,374.00 for the new roof installation. Building Permit number BD22017211001BR001 and Folio number ************ was issued on September 2, 2022. The company has failed to fulfill its obligations under the contract due to negligence and breach, and now I am forced to incur unnecessary expenses to stop /repair the recurring leak that the roofer attempted to fix a couple of times since the new roof was installed. I made several attempts [via phone, text messages, and email] to resolve this matter directly with the Nessco Construction Production Manager and the owner of the subcontractor [********************] who was hired to install the new roof, and I provided photos of the roof and water damage to the interior ceiling to both parties. However, after being told [during a phone conversation] by the subcontractor that they would come to my residence to perform an assessment of the recurring leak, they never showed up nor have they contacted me regarding the missed visit or to reschedule. And since that time period, the production manager and subcontractor have ignored my many attempts for resolution.Customer Answer

I have attached some additional information concerning the roof damage and repair work. This was a material damage and a recurring issue. The roofer failed to resolve the leak issue on multiple occasions. The cost of the repair work was $400.00. Additional photos of the damaged area and repair work are available.

My name is ***************************** On March 24th 2023 I met with a sales person for the company named Avi of Nessco construction LLC, in regards to a re roof of my home. We agreed on getting the roof replaced with them. The cost for the project came to $19,352.00. I was promised by ***** the project manager that they will have all hands on project and I would not have to lift a finger. The project got approved by the city on August 24th 2023. The project started and I got zero notice from Nessco that they subcontracted a company called Victory roofing and associates to do the job for the price of $10,450.00. This company didnt finish the job correctly , the roof panel surrounding the whole house was not replaced as was promised and disappeared with no answer to phone calls, I went to their location listed and the place was empty. On December 10th I got notice of being sued by the vendor they got the material from , for not paying for it. They took $3,076.94 in materials and did not pay. The vendor took legal action and has a lien on my home until balance owed is paid. *** tried visiting and calling both Nessco construction LLC and ******************** and associates and Ive got no answer. I will be attaching the lien on home from vendor for money owed to them. And proof of Nessco giving victory roofing half the amount they charged me to do the roof.Business Response

We entered into agreement with Nessco in Feb. 2023 for a full reroof. The work was to commence in the next month or so and was to be completed by July 2023. Permits were pulled. Great start so far. It is now at the end of Oct. 2023 and the work has yet to start. I wanted to cancel the work due to no work starting and the roof is detoriating even further. I was reminded per the agreement stated contract can only be canceled within 3 days of it being signed. Nessco has provided many excuses as to why the work had not started as agreed per the contract. They use 3rd party, materials were not ready/available etc. I signed a contract with Nessco not the 3rd party they are referring to. About 2 months ago, I received a call from ***** and she said my file was being moved to someone else. She gave me the number, I don't where that person lives/works but the phone line was very distorted. I was never able to speak to her. After calling Nessco and complaining and asking for this contract to be cancelled they gave me another phone #. Some materials were dropped off 3 weeks ago. Start state was to be 10/23 but no one showed up or called. This home is my main residence. I have been more than patient and understanding. Permits have expired per the County. The roof continues to sustain more damages. I want this agreement canceled, come pick up the materials, and let me move on to another company willing to complete the work. I have emails and call logs if needed. The customer service provided from this company is unprofessional and has been delayed long enough.Business Response

Client is correct about the time line and I am very sorry for the experience this client has had to this point, There so many 3rd parties involve in getting a roof loaded and having workers available, especially during hurricane season that it becomes challenging and unfortunately this project was victim to all three things not correlating at once. Normally this is not an issue, however for this project it was.
We have been communicating with the client the whole process and have been extremely apologetic all thought-out, as late as yesterday when the City did not accept our Inspection request, we advised the client that we would start tomorrow 10/26 in the morning.
All of our lines of communication have been open for the client at anytime she have reached out, we have been fully transparent about our processes and anything that has hindered us from moving forward with this project. Transparency has been the our main goal here and even though it might seen unprofessional to the client, I believe it have been our best attribute in this project.
In Regards to cancelling this project, I'm afraid that this far into the project, it would be impossible without cancellation fees and restocking fees, plus man hours paid to employees for deliveries, permit running, etc. This clients project is being funded through *************** and therefore, No Down payment was obtained, nor progress payments were made in the process. Nessco Construction and it's fulfilment partners have sponsored this project until now. With these *************** pace loans, funds are not released until the project is complete with City approval and client Signing the Certificate of Completion. Therefore cancelling this project is not feasible.
Once again we are so apologetic to this client for the long waiting, there is always that one in a hundred project that becomes challenging, this is not our intent. We have worked in the office tirelessly touching base on a weekly basis to push this project forward.Customer Answer

It took 9 months to start the work. There would've been no restock fees as according to the delay given it was due to the materials. I would like for a reduction in price. There is damage inside the home due to the roof leaking which was not present at the time of signing the agreement.Business Response

We appreciate the customer respond, unfortunately not all the moving parts is in our control. the issue with the stain we will check it and address it if needed, as all roof projects, we performing re roofing because roof is either old or have leaks or life spam so this is natural to have in some cases leak ETC,
In regards to price reduction, we are still in the middle of the project, as a fact this week material deliver and we are few steps before finishing the project.
Customer was aware to delays that might come, with years of experience, sometimes there are delays, short in material, deliveries that get delayed, inspection cancelled, inspection reviews and leg time for response ETC.
We hope that at the end of the project., the customer will enjoy its new roof for years to come.

Although, I am familiar with working with contractors and understand all the possible delays that does not excuse the company to not provide timely updates. I am not satisfied with the work thus far or how it has been handled. Since the work has started finally I am still requesting for a reduction in price. I understand there are contractors to pay. However, due to delays on the roofers end damages sustained will need to be repaired. A week ago *****, production manager came to the house to see for himself the reason behind my complaint. He was not happy with what he saw. Garbage, nails were left exposed, we have small children in this house. Any one could be hurt. I do appreciate him coming over. However, the issue still remains. After the work had commenced we received 24+ hours of rain. We have new damages in the interior. The roof was leaking in. The day he visited the home he assured me the roof was safe and we would have no issues if it rained. To our surprise that was not the case. While I do appreciate them sending someone the next day, the contractors advised there was not enough material to properly address the issue. This provides no vote of confidence or trust in them. I am praying they have used the correct and new materials to complete this reroof. They are being reactive to the issues rather then proactive. If they have been doing roofing for years their experience should dictate that they should be able to anticipate any possible issues that could arise and prepare for it. They also threw away 3 new tarps, which I have asked about and have not received a response as of yet.*******

In August 2022 we went into contract for roof and windows installation, they just completed the work in February and now it is March 15 and they have not mailed me my keys he claim that he caught COVID but now they see squatters in the house, took a picture of nobody but just a wide open door. As a result my electrical panels and my ceiling is down. When they installed the roof they doubled the price from 15k to 30k. When they installed the windows they cracked more of my stuccos and got paid 28jk.Business Response

Let me start with apologizing for any inconvenience this project may have caused, I sympathize with your concern with squatters on your property.
I want to start from the beginning to fully explain the challenges of this project and paint a full picture of this situation:
The Roof: Contract signed Aug. 26th 2022. - Final city inspection Dec. 16 2022
This property is not the primary residence for this client - let it be noted the client resides in ******** and was not available for any of the walk throughs from the beginning of the project to the end of the project. This property was left abandoned for many years or months and we faced many obstacles as we worked on the property, including damaged rafters and lots of rotted plywood. Please see the attached photos. We were able to complete the project and along the way we advised the client many times of the additional cost that was being accrued from all the unforeseen damages sustained by abandonment and miss care of structure.
The Windows: contract signed Aug 24 2022 - final inspection Feb 6 2023. permit approval for Nov 16th 2022 - window manufacturing timeline 6 - 10 weeks / manufacturing delivered early and we were able to schedule installation early.
As previously mentioned this property was abandoned and miss cared for many years, as well as installing the Impact windows on the ************** some stucco began to fall from moisture detaching the adhesive from the concrete walls. This occurs from leaks on the roof and water finding its way between the stucco and concrete, again from many years of miss care. Our contracts DO NOT cover this level of unforeseen damages and when we consulted with the client, she did not want to accrue any more cost to this project.
The Keys: We are very hesitant about mailing the only set of keys of the property since we cannot guarantee they will not get lost in transit. I personally spoke to the client via telephone and explained I would rather hand the keys in person to her or someone she trusted then mailing the only keys to the property. The squatters did not enter the property through an ajar door, they forced open a window and caused damage to the frame of the window, glass and locking mechanism of the window.
Again to be clear the cost of the roofing contract was honored as promises however the additional cost were accrued by the significant damage to the structure of the property. As far as the cost of the windows and doors contract. No additional cost was accrued since the client denied any additional services.
I apologize for any inconvenience, and I hope you understand the squatters in the property are not our fault and in any way could have been prevented by Nessco construction. We have your Keys and they are safe, please make arrangements for the keys to be picked up or dropped off to you personally or someone you trust. Remember these products impact windows and doors and they are not easily opened without causing damage to the frames and running the risk of damaging the glass.Best regards,

Through the ****** program (November 2020) ** construction (*************************) which is now Nessco replaced my roof as well as impact windows and door.The door was a little off when using the deadbolt and top and bottom locks. The guy said "yeah it sometimes has to work it's way"? Over the next year it didn't get better...in fact three months ago it was no longer lockable on all three locks. I called them and ************************* himself said to call him if the problem didn't get corrected.I was given to **** to take care of it. He told me the door warranty expired and too get a locksmith, which I did.********* does his thing and tells me the door was initially hung wrong, misaligned...and showed me where, which got worse over time. Ok, I understand. Sent the bill and explanation to **** and didn't ask for reimbursement...just to rehang and fix the problem. He told me they needed to send somebody out to look....again I understand.Never heard back, three phone calls over a month and told he'll get back to me....nothing. Called for *************************, nothing again. Called last week one last time....a bit stressed and bordering on angry as their recording will show. BTW they chipped off/ruined the concrete around the new windows and had to pay someone else to fix their poor workmanship. Also had to withhold final sign off until they actually did what they promised they would do in my carport or else in hindsight it seems they never would have completed it. Everything is hunky dory with communication until they actually get paid and then nothing but the sounds of crickets from the company....after the state's $67,000 was paid to them.Business Response

Good morning,
The customer did called and we told him that labor warranty is over- it is 2 years ago project.
Nessco is not owned or any connection to ************************* or H.K Contractor.
The owner of Nessco use to work with HK Contractor but there is no connection between the two.
Once that said- if the customer had a problem , why he waited so long?
We are guarantee our labor for1 year after installation ,but we do not give lifetime warranty on labor- if something is wrong- we should know about that and we will address at the warranty period.
Since we appreciate our past customers, we will do the extra mile and send someone to inspect the door-
if we find it was a normally wear and tear - there is nothing we can do about that. if we will find it was "wrongly " installed- we will defiantly fix it- something that we are really doubt about .
We will coordinate with the customer to perform inspection visit
