    The below message sent to MTCI on 1/23/2023 was never responded by email; however, Ms. **** called me to confirm receipt and that the *** authorized the refund but it would take a while. She or anyone ever contacted me again or my refund was issued. I resent the below twice adding a request for follow-up but no e-mail response. ______________________. January 23rd, 2023_______This correspondence is an appeal to the [attached] email from Ms. ***** Student Administrator, representative of Metropolitan Technical Career Institute **** FEI/EIN: 46 ******* at *********************************************************************************. The referred attached email message is a denial response to student **** request to withdraw the Basic XRay Machine Operator (BXMO) online 12-week program started on January 9th 2023. Moreover, student Ms. **** requests a prorated refundby Metropolitan Technical Career Institute MTCI in the same **** debit card ending in **** utilized for payment of the tuition amounting to $1,450.00 on October 24th, 2022 (invoice enclosed). Despite the educational institution allegations that the their reason for denial is that Ms. **** accessed confidential institution content, Ms. **** states her only access to the school rcampus.com platform was within the first week of classes. At that time, there was no confidential material posted. Specifically, the weekly PowerPoint is the ONLY material available for students to access. In addition, the student purchased books required for the program, which are public material from Elsevier, a commercial publishing company. Neither MTCI platform or books reveal confidential MTCI content, contrary to MTCIs email.In sum, Ms. **** will not be able or willing to attend a future MTCI class because of her health condition, as stated earlier. Notwithstanding, MTCI has not yet presented a syllabus for the program or a contract showing the institution cancellation policy. Please forward this correspondence to MTCI *** *************************.

    Complaintant registered for a self guided preparation course to sit for the ************* licensing exam in the vocation of Basic Xray Machine Operator.  

    Prior to registration as all potential students do, a phone call was made to the school gathering program information.  Details are given to each individual regarding tuition, length of course, books or study guides needed, policies including refund, school, individual class programs, layout provided of each program pertaining to scheduling of assignments, tests or exams and any other further information necessary or requested by a student to make an informed decision to register. It is also suggested that a individual come to the facility to speak with a Student Advisor to clarify any questions.  Should a student opt out of visiting the facility, all registration and acceptance of policies and practices are considered implied consent or implied contract by the issuance of tuition. With this consideration an offer of training was made and accepted by the party and mutual intent to be bound was implemented. After consideration of the potential student, any policies not acceptable will result in the registration process  not continuing and access to our *proprietary information will be withheld.

    On  Friday afternoon of January 20, 2023 the Complaintant sent an email to a Student Advisor requesting to withdraw from the program for health issues.  On Monday the 23rd of January the Advisor responded *attachment* the explanation of the policy was readdressed considering the refund policy and the potential to defer to another program or start date within 90 days. 

    After a phone conversation with the Complaintant later on that day, the Student Advisor, asked of her to supply the school with a documentation of limitations which would not allow this student the ability to work from home or any location deemed necessary by the student with wifi accessibility, on a flexible schedule or at their own pace.  The Complaintant refused submission of documentation.

    On February 27, 2023, an attempt was made by Metropolitan to contact the Complaintant by **** Registered, Signed receipt required delivery.  On that day *attachment* the delivery was refused.

    At this time this Complaintant's file is closed and all communication will cease regarding this matter.

     

    *Proprietary information refers to the ownership of curriculum created by Metropolitan Technical Career Institute and developed with the intention to train individuals in a career tutoring designation.

    I am rejecting this response because: Many truths are covering some not truths. Moreover, I requested the syllabus in written before withdrawing, which should include cancellation policy as any other education must provide. The syllabus was never provided nor any contract with cancellation and refund policy. I am not going to accept this response, and still request my refund as I was ensured by the advisor that without a doctor's note, it would take a little longer. That's all was said by the student advisor. The extend of the below explanation was never verbalized during the phone call. In sum, I paid $1,450.00 in full in advance. I requested to withdraw and be refunded, cancelled within the first week the program started for medical reasons. I was ensured I was going to receive the refund "but it would take a little longer because of no doctor's notice." I accepted that because of my HIPPA rights as a patient. I was never contacted again by mail, phone or e-mail. I have proof of my medical condition, which I would have provided if the argument was true that I "refused" to do so. if I need to hire an attorney, please let me know asap because there are other issues included now.

    After continued investigation into the complaint, MTCI stands on its prior response. 

    As documented, **************** was sent a first class,certified, signature required correspondence via **** which was refused on February 27,2023 at 4:06pm. Further communication in this matter is agreed by the counsel of **** and Administration to be discussed in ******* Small Claims Court.
