    A.S.P.M.G. collected a special assessment for painting the Building + repairing the parking lot on the **************************** located at **********************************. The assessment amount was based on the size of each unit, and the painting project is currently in progress. I recently discovered that they are only painting the front of the Building G because the back (exterior walls + balcony) was not included on the project, and I will have to pay an additional $300 out of pocket to get the back of my unit (part of the Building) painted. However, some other units (same size as mine) are getting the back painted, and I don't know why. It's my understanding that the *****************/Property Management is in charge of all repairs/maintenance of the "whole" building (not only the front). I've reached out to the Property Management but they refused to resolve the issue. I'll be paying the extra $300 tomorrow to get the work done but I'm expecting a reimbursement from the *****************/Property Management.

    this letter is submitted in response to the complaint regarding the painting and parking lot project at ****************************, located at ***********************************


    We would like to respectfully clarify the following:


    Special Assessment Approval:
    The special assessment referenced was not imposed by *****, but rather approved and authorized by the duly elected Board of Directors of **********************************************, in accordance with Florida Statutes and the Associations governing documents. The management company does not have the authority to create or approve assessmentsthis is solely the responsibility of the Board.


    Assessment Purpose and Allocation:
    The funds collected under this special assessment were strictly designated for Phase 1 of a larger improvement project. Phase 1 includes partial painting of the buildings (as outlined in the contract) and repairs to the parking lot. The scope of the painting project was defined and approved by the Board and applies equally to all buildings based on the community budget and engineer/vendor recommendations.


     No owner was charged for painting services beyond what was approved in Phase 1.


    Payments and Funds Management:
    To further clarify, A.S.P.M.G. does not collect or hold association funds for its own purposes. All payments are made directly to the **************************** Associations official bank accounts, and all expenditures are made in accordance with board-approved contracts and budgets.


    Regarding Individual Unit Arrangements:
    Any owner who chooses to have additional painting work done beyond the approved common area scope may do so at their own expense, directly with the contractor. Such optional work is a private matter and not managed, charged, or reimbursed by the Association or ******


    We remain committed to transparency and accountability in all community matters. If the complainant would like additional clarification or documentation, we encourage them to attend the next Board meeting or submit a written inquiry for official review.

    I am rejecting this response because:
    The painting project was not applied equally to all buildings: back of Buildings A, H and I was included while the rest of the Buildings (also part of the **********************) was left out. No written notification was received with the specifics that it was a partial painting. If the Property Management is not responsible for the special assessments and the execution of the painting project, then I would like to redirect my complaint to the responsible party, Is it the Board of *******************? Please confirm.
