    I lived at Via Tuscany Apartments from August 10th, 2023 to August 9th, 2024. The entire time living at this complex my apartment was ***** infested, as were my neighbors. We continuously asked for pest control to come to our apartment because we paid a monthly fee and they never came for the entire 12 months I lived there. Shortly after moving out, I received a bill for $8,047 dollars because they were claiming all appliances (microwave, dishwasher, and refrigerator) were damaged. We contacted them for weeks trying to resolve this issue since all appliances were working when we moved out. We spoke to apartment manager *** in the office and she said you are being charged for all appliances due to your ***** infestation because all appliances had to be taken out. I paid for a service for 12 months that I never received (pest control). *** then said if you refuse to pay I will just ding your credit, it is what it is. I am extremely upset and they are taking advantage of us since we moved out of the state and they think we are unable to do anything about it. We tried to resolve this issue with *** and the rest of the office staff and they were disrespectful, unprofessional, and continuously said it is what it is and then disconnected the call. This apartment complex needs to be investigated because there are reviews all the way back to 2021 for the ***** infestation. Its really upsetting that they give new renters two free months rent and a free garage, so they make their money to stay in business by charging outrageous fees to their tenants that moved out. Via Tuscany was upset when we said we were moving out and tried to convince us to stay. I really hope you can investigate and save other people from the emotional stress this has caused me and my family.

    We have addressed your concerns multiple times and have provided you with documentation along with move out pictures along with the lease contract backing up the condition of your apartment at move out. Should you like for us to provide photos along with the vendor charges and lease contract, we would be more than happy to do so

    The manager *** sent me to collections for the ***** which is fraud.  This has not been resolved.

    I have been paying rent in time since Sept 2022. I requested an addendum to the lease agreement as I have been paying rent but unable to sleep at my apartment due to the excessive noise levels. Management has not been willing to do anything in the past. My lease is up Dec 15, due to my lack of sleep over the past year, this has definitely impacted my daily functioning to the point of exhaustion. When I filed the intent to vacate and reasonable accommodation letter in late October. My calls and visits were evaded for over two weeks. FINALLY, I received an email on Monday, Nov 20, 2023 around 5pm:

    Good evening *****

    After speaking with the regional manager, unfortunately we will not be able to waive any fees regarding your lease termination.

    What I can suggest is that you is letting your lease roll over to month to month and then put in your 15 day notice. However, that will mean you will have to pay a prorated rent from 12/1-12/15 along with a prorated month to month fee.

    If you would like a break down, I will be more than happy to create one for you.

    I replied that evening, please do and sent a second response that evening that read as follows:

    Also please explain why the disability accommodation request was denied to amend the current lease arrangement, where notification of move-out was provided 60 days in advance of Nov 30, and the accommodation letter was received by your office 22 days ago yet you informed two days prior to Thanksgiving.

    Tuesday, Nov 21 office staff did not reply, although Ana was there. I am filing a BBB as today I read through Via Tuscany reviews to find this is typical behavior from management. I have paid on time and am extremely concerned if this company taking advantage of my kindness. These unethical business practices must be stopped to protect others. I plan to leave my apartment cleanser than I found it but am fearful of losing most of my deposit around the holiday season when I need it most.

    Good morning, 

    Per my conversation with the staff at Via Tuscany the resident **** ***** never submitted any noise complaints to the office (Written or Verbal)

    We have no record that the resident was experiencing these issues during her residency at Via Tuscany Apartments. 

    Upon checking the account, we did not charge any early termination fees, However, the resident has a final utility bill which was applied on her security deposit at move out.
