Dear Kingston Data & Credit,
I am writing in response to your reporting of an alleged debt on my credit file. I formally dispute the validity of this account and request full validation under the Fair Debt Collection Practices Act (FDCPA).
I do not recall entering into any agreement with Anytime Fitness in ******, CA, and I am not liable for this debt. I request the following:
1. A copy of the original signed contract including full details (date, location, IP address if signed digitally).
2. A breakdown of how the alleged amount was calculated.
3. Any payment history associated with this account.
4. Proof that you have the legal right to collect on this debt in ***********
5. Documentation showing you have verified the debt with the original creditor.
If you cannot provide this documentation, you are required by law to cease collection activity and remove this account from any and all credit reporting agencies.
This account is damaging my credit and I demand that it be removed pending proper validation.

I have reviewed the document provided by Kingston Data & Credit International ***** and I continue to dispute the validity of this account. The attachment provided does not confirm that I entered into this agreement or that I am legally liable for this debt.
I have requested full debt validation under the Fair Debt Collection Practices Act (FDCPA), which includes:
- Verification of the original agreement with verifiable proof of authenticity (including digital or in-person signing details),
- A complete account history showing how the amount was calculated,
- Proof that Kingston Data & Credit International **** has legal authority to collect this debt in ***********
Until proper validation is provided, I maintain that this account is being reported inaccurately and is damaging my credit. I am also submitting disputes to the credit bureaus and considering an identity theft report.

My Initial Complaint to BBB:My identity was stolen by this company. They are attempting to collect a debt and I have no legal written or binding contract with this company. Consumer law code 15 USC 1681 (Q) and 15 USC 1681 (A)(2) If any person uses my information without permission that is identity theft. There must be permissible purpose provided by me. I am rejecting this response because: According to the Fair Debt Collection Practices Act (*****), consumers have the 'RIGHT' to dispute a debt and request validation from a debt collector. Section 809(a)(4) of the ***** states that within five days after the initial communication about the debt, the debt collector should provide the consumer with certain information including the amount of the debt, the name of the creditor, and a statement notifying the consumer of their right to dispute the debt. I have yet to receive this data.On June 5, 2025, I, ******** ********* had sent through certified mail a written letter of VALIDATION OF *** REQUEST PURSUANT TO 15 USC 1692 and I have not received a response to this request and do not solely hold any signed agreement with Kingston Data Credit International **** Kingston Data Credit International **** you are clearly breaking Federal Law and violating my rights as a consumer.
Further, Consumer law code 15 USC 1681 (Q) and 15 USC 1681 (A)(2) If any person uses my information without permission that is aggravated identity theft. There must be permissible purpose. I did not give permission for Kingston Data Credit International **** to report this or any account on my consumer credit reports.This is also violation of my consumer rights and causing me mental anguish,inability to obtain credit, unable to obtain other employment, and is putting a blemish on my United States Security Clearance as a *************************************** Member Employee, to include defaming my character.
This is my final demand to the furnisher to delete this invalid collection account from my *************************************************** Data Credit International **** has failed to show me a signed contract agreement displaying the alleged amount between Kingston Data Credit International **** the furnisher, and myself ******** ********* the Consumer and will proceed with legal action and sue for damages against Kingston Data Credit International **** if this is not resolved through the BBB and said requests in this letter are not adhered to.

In the letter, you, Kingston Data Credit International *** had provided IS proof that I DO NOT owe Kingston Data Credit International any debt. As there is no contract signed between myself ,******** ********* and Kingston Data Credit International ***. Send me a bill that shows I owe you the amount you are requesting as proof and ensure my signature is on the document as well as someone from your office. This will validate as proof, I owe this debt to Kingston Data Credit International ***.
Further, in said letter you provided as proof of my written consent for Anytime Fitness to pass my information to Kingston Data Credit International ***., I must state again, there is no contract signed that exists that states I owe any money to Kingston Data Credit International ***.
At this time I demand all collections cease and desist and any furnished information to any credit reporting agency be removed immediately. If this data is not removed within 10 days then I will push legal action against you.

Anytime Fitness in ****** reactivated an old membership of mine then proceeded to attempt to collect on said debt. I have made numerous unsuccessful attempts to explain the situation to both the management of the gym and to these collectors. I had a later membership with the *********** location which was canceled by me due to relocating outside the area where gyms were easily accessible. I sent a dispute letter to Kingston which arrived on 5/12/25 but I continue receiving emails from different agents attempting to collect. They just do not seem to understand the situation. I do not owe anything to Anytime Fitness or ABC Fitness or to the family that owns the ****** gym.Business Response

I am rejecting this response because: I never received any formal communication from Kingston Data & Credit International **** All received was annoying calls claiming I owe them and wanted me to provide them with a payment method. For a matter of fact I do not owe Kingston Data & Credit International *** neither do I owe Anytime Fitness. I have never worked out at any of their facilities. That record they provided was from ****************. Per Bluemoon Fitness policy if you wanted to cancel your policy you would stop by the facility and make that known. I was sick back in 2023 and did not work out for months. Instead having them charge my card continuously I went in with my mom and we both canceled our membership. I kept seeing charges from **************** even though I had previously requested my membership be cancelled and I was told my membership was cancelled. I therefore contacted my bank and had them block every transaction from Bluemoon Fitness. Im not how all this turn out that I owed Kingston Data or Anytime Fitness.
