    We contracted with Palm Beach Pergola to build an almost $50,000 pergola in our back yard. After all the permits were secured (which took almost 8 months), the company never showed up to install the pergola. Repeated calls/texts/emails/Fedex demands were met with poor excuses and no refund or pergola. Its been over a year and no contact.

    In December 2021, I entered into an agreement with *** **********, a business owner and contractor, to build a pergola on my property. The total costs were outlined in a contract, and I paid an initial deposit of $50,000 to *** to mobilize the project.During the project, *** was responsible for obtaining necessary permits and completing other required paperwork. However, there were continuous delays from him in completing these tasks. He frequently provided vague or empty excuses for these delays, causing significant frustration. Communication was extremely challenging; simple requests, such as making small changes to agreements, often went unanswered for days or even weeks.After so many months, he finally completed the submission of the necessary paperwork. He then sent another agreement and requested a second deposit to mobilize the project (this was on January 9, 2023). At this point, due to the ongoing delays and poor communication, I decided not to proceed with *** and requested a refund of the initial $50,000 deposit. He later agreed to provide a refund but has since stopped responding to communications.I sought legal assistance, and a formal letter was sent to *** requesting the refund. He has not responded to this letter. The last text I got from him was June 5th where he promised he would call me on Saturday. There's been no update since.I am filing this complaint to seek assistance in obtaining a refund of the initial deposit from *** **********.

    *** from Palm Beach Pergola, built a pergola in our back yard without permits & did so with shotty work at best. The structure collapsed & is not up to code, the current structure if it collapsed again can seriously hurt somebody. *** continues to give use excuse after excuse on why he can not complete the job or why he has no engineering plans or permit.Tried uploading contract but it is to large.

    On 12/31/21, I signed an agreement to have a Pergola built. One 6/9/2021, I paid another$17,217.80 for the materials to build the Pergola. The company never got a permit for the job and the ********* us remove the Pergola. The company took the materials and put it in storage. I had to pay the town of OR $3000, for two variances, as well as another $2500 for an electrical permit. We got a permit from the Town in August. The company has still not started my job and every week I reach out and get another excuse. I have been more than patient and at this point, I would like to be refunded, so I can hire another creditable organization to restart the process.

    Here is the timeline:


    I saw an ad on ********* and I reached out to the ****** office to learn more information.  ***************************, the ** of the company sent me a digital marketing piece, and they recommended Palm Beach Pergola to me at this time.  I met with *** for the first time, in the summer of 2020, and I got a quote for the Pergola.  I didn't have all the money, so I put it on the back burner.  At the end of the year, I saved enough money to build the Pergola and I reached out to ***, and told  him I was ready to move forward.  My Mom and I met with *** again, in early March, 2021, at a client's home and he showed us a job he had just completed.  It looked great.  At that time, *** felt we did not need a permit, as this was just a sun structure. He told us he built them all the time in Palm Beach and we didn't need a permit.  What a mistake.


    I met with *** on March, 31, 2021 and signed the contract.  At that time, I gave him a check for the first installment, $21,522.25, which was a 50% deposit.


    I had the Pergola delivered into my garage on June 8th.  My whole garage was filled to the brim.  The next morning, June 9th, 2021, *** demanded the second payment of $17,217.80. I got fired from my job that Friday, when the gear was delivered, and I shared this with *** and asked him if he could wait until I figured out my next steps, as this was the height of the Covid pandemic.  He went crazy screaming at me in my garage, and had me sick in tears.  So, I cut him the check.


    *** hired some guys to remove two trees from my backyard, where he wanted to install the post for the Pergola.  I paid $500 to the guys for the mess they made in my backyard.;  It is still a mess, all these years later.  He never paid me back for that charge, and he told me he would take it off the bill at the end.  


    After that, *** sent his installers at the end of the day, or on Saturdays, to do the job.  These guys brought their dogs to my property and tied them outside, with pickup trucks parked all over outside my home and driveway.  They were not what I would call trying to hide the fact that they didn't have a permit.  On Saturday, June 28th, the ******************* came over and they had us shut down the job.  I was told I had 5 days to remove the Pergola or I would be in Code Violation and would be fined daily.


    *** and his team took apart the Pergola and put it back into my garage.  At that time I was informed I do not own my backyard, but the Town owns 25 feet back from the water way.  I was informed that I need to get a Variance if I wanted to use the space.  


    I paid $1,500 for the Variance, which we received in Nov, 2021.  I also had to pay another $500 for the 12 Binders I had to create (12 Copies) for the City.


    Unbeknown to me, *** then went to the city and filed for the Permit.  I found out later that he used a company called ****************, *****, as the Contractor on File in the City.  I only found this out when I was copied on Emails and *** was not!


    After *** filed for the Permit, we got notification that the expansion of my deck that the Pergola wraps around was not disclosed in the last Variance, and I would need another Variance for the Deck.  I went ahead and I paid another $1,500 and had to make another ************************* a total of $2000.


    *** submitted what was required to the town on June 6th, 2022.  We were then invited to have a meeting with the Building Inspector after that to review what was submitted.  
    We had a meeting with the town, we were told we needed to supply a book of calculations on the Wind speed to ensure my deck was built to the Hurricane Codes.  We were also told we needed an electrical drawing and an electrician to install the low voltage electricity, though it just plugs into an outlet that is already installed.


    I then paid the electric company $2500 for the drawings and work so they could pull an electrical permit.  We still needed ***'s Engineer, De ******* Engineering Group to do the wind Calculations,   *** informed me that ********** wanted another $6000 to perform the calculations.  This took over 6 months, and I had to call De ******* to realize nothing was being worked on.  We got the calculations within 48 hours of my call to **************************** office.


    We have had a permit now since August of this summer, but *** has a different excuse weekly for not restarting the job.  First, he needed to clean all the materials, then he told me pieces were missing, and he had to replace the parts.  Then he couldn't get a trailer and waited a week,  Lies, after lies.  This has cost me close to $50,000 and I have a deck that I cannot go out on, a backyard that is a mess, and holes in my home from where they had the pergola installed.  I don't know what to do at this juncture.  I realize that *** is a con-artist and a *****.


    I plan to go to the BBB and file a complaint, and the Attorney General of the ****************.  I also plan to call WPTV and inform them of this incident.  


    My sister found this website:  WWW.PalmbeachPergolasucks.com where I found out I am not the only person *** has scammed!  I would file legal charges, but I think I would just be another person who loses more money, as I would be waiting behind all of these folks that have lawsuits.


    I would like to see if I can get my materials back, and find a reputable installer to help me complete this job.  OR, get a REFUND.....
