If the consumer would like a copy of his contract, he will need to request it directly from us. We have made many attempts to reach the consumer to discuss the account but have not been able to reach him. He has not contacted us to request the contract at this time.

I am not aware of this account. I have reached out to 3 credit bureaus and MG CREDIT INC. to have this account removed from my file and they always say the same excuse, which is no longer acceptable. I have filed an FTC complaint because I believed this is an outcome of identity Theft. Regardless of all actions done on my end, there was no action from 3 Bureaus. Thus, I am reaching out to seek assistance to have MG CREDIT INC. that I have no account with them and 3 credit bureaus can simply remove it from my credit.

I am not liable for this debt with MG credit. I do not have a contract with the collection agency trying to collect and report to my credit report. They did not provide me with the original contract as requested

      Business response

      08/08/2023

We are not required to "have a contract" with consumers to collect a debt that they owe. It is in the contract she signed with our client that if she defaulted it would be placed in collections. We spoke with Mrs. ****** 1 time in December 2021. She told the representative she could not pay and refused to make any arrangement. We haven't spoken with her since and she has not requested we send her any proof either. We will be happy to provide proof of her debt and she can contact us to resolve the balance. As you can see she has 2 addresses listed on this complaint. She will need to provide a valid address or email in order for us to provide the contract. We are not going to guess which address is correct.

i have attempted to contact this company for exact questions in regards to this collection. When I called the company had No recognition of this collection I called February 2023. At this point this collection should no longer be on my credit. When I called I asked what the collection was for, and original contract. MG credit could not provide neither.

This is actually false. We only spoke with Mrs. ****** 1 time and that was on December 27 2021, at which time she told us "she was broke from Christmas', It was agreed that she would call us the first week of January to discuss payment options. We never heard back from her. We attempted to reach her for another 7 months only to be hung up on when anyone answered her phone. As i stated in my previous response, at no time did she request the contract. I have the contract and have attached it to this complaint since she has not provided a valid address yet.

I had a gym membership with ******. I canceled this membership at the gym, where I signed up, because I moved. I moved to PA, where there isn't a ******. I provided them with all the information I could. There was no paperwork from a landlord, or the sale of a house, because I was living on my sailboat. I believe at the time I provided proof of payment for my dock slip, which I can provide again. As further evidence, I have the canceled FL driver’s license, the address is the physical location for a digital mailbox. My new drivers license is in PA, it's clear that I move a bunch, because the new address is a motel. I provided all the information I needed to get out of this contract to ******, and yet I was turned over to collections, and now M G Credit will not review my information. I do not owe a year's premium. How can we come to a resolution?

      Business response

      04/20/2023

We tried to discuss this matter with Mr. ***** and he restricted our communication by telling us not to call him or send him anything else.I have already reviewed this with my client and there was no indication he provided anything proving he moved. His membership was canceled for payment declines. There is nothing we can do if he can not provide the required proof of relocation. Filing a complaint is not going to make this go away, restricting our communication is not going to help resolve the matter either. Technically his dispute isn't even with my company. I am surprised he filed this complaint against us. He told us we were "harassing him", we were simply providing him with the facts.

We are unable to accept this offer to settle the account. We do not buy the debt. As I mentioned before, the best offer we can give is $493.08. That offer still stands.

       Complaint: ********

I am rejecting this response because: MG Credit and their Client, ******* gym, did not provide proper documentation when they were notified of my relocation. Further more, when later requested where to send the appropriate documentation, they provided nothing, not an email address, not a fax number, not a physical address. Simply by being uncompliant with their own contract, they think they are entitled to  $493.08, instead of the $50 cancelation fee. This is a predatory practice of getting people to sign up for a gym membership, then not allowing cancelation without excessive costs.  MG Credit and their Client, ******* gym, should be embarrassed that their business model is based on fraud.

      Regards,

      ****** *****

I am a retired veteran who also suffered three nervous breakdowns. I joined a gym in Florida which is therapeutic for me, and my condition. When I moved out of state I provided proof of termination to the gym with required paperwork. The paperwork i turned in was never recorded. I was then contacted by the collection agency MGCREDIT requesting dues i didn't owe. I explained the account was sent by mistake and the gym waived all the fees. MGCREDIT still insisted that I pay them the fees. I spoke directly with the corporate office for the gym. They assured me if I paid the collection agency fee that they would have MGCREDIT remove this collection from all credit bureaus. MGCREDIT was told 3xs by the gym management to do so. MGCREDIT told me it refused to have it removed from the credit bureaus without an explanation . When I tried to speak with a MGCREDIT representative they were rude and obnoxious, spoke over me. When my fiancé saw me shaking, she told them of my health condition and that I was a retired veteran. She asked to speak with a manager he said he was the manager. This person also stated he also had health conditions as if he was making light of the situation. We paid the fee simply because I was applying for a mortgage and needed it off my credit report. However, as if that wasn't bad enough we were promised we would have a letter from the collection agency and they would not report it as satisfied, but would totally remove this from all credit bureaus. ***** in the corporate office at Baily's gym stated she spoke directly with MGCREDIT, and they would remove it once we paid the false fee. I tried to explain this, but the representative simply didn't care, spoke over me. When I pointed out he was being rude he got very defensive and extremely nasty. When I pointed out my condition he made light of it and became even more obnoxious stating he had medical issues also in a very condescending way. I want this removed from my credit as promised.

When *** ******** moved in October of 2020 he did not provide proof to our client in a timely manner. Our client gave him 7 months to provide proof before they sent his account to collections. When we spoke to *** ******** on 5-10-21 he told us that he did not have a lease agreement or utility bill in his name because he moved in with "a friend and his girlfriend". We explained to him this is why his account was not canceled and if he could not provide these items the account would not be canceled. 2 weeks later he produced a signed lease (that he previously said he did not have). Our client did agree to cancel the account, but he was required to pay $150 because he did not provide the proof required as per the contract with in 30 days of moving. When we contacted him to explain the account would be canceled once he paid the $150 he refused to pay anything. We did not hear back from him until this week. Now that he is trying to buy a house it is affecting him and the only reason he has agreed to pay it. The Credit Bureau's policy is not to remove anything that is paid. This is not our rule but theirs. I did speak with our client today and the person he spoke with did not understand this rule. She did say that he was told it would be removed if the $150 was paid. I will have the account deleted when we do our next reporting.

As for the insinuation that anyone was making light of his medical condition, that is simply not true. His medical condition has nothing to do with the reason his account was not canceled. He was not canceled because he did not follow the proper guidelines to cancel his membership to begin with.

I have been a victim of identity theft. My information has been exposed in the Equifax data breach. The account is not affiliated with me nor received any money, goods, or services as a result of identity theft or authorized by me and I would like this to be removed from any affiliation with me immediately.

This is not a "complaint" *** ****** needs to file a dispute with the Credit Bureaus. In the meantime, I will pull a copy of the signed agreement and mail it to him. Also, if *** ****** still thinks this is fraud he will need to file a police report and provide it to us.
