    I was involved in a class action settlement but never got my settlement. I was incarcerated and they sent it to the wrong address. It's three months after disbursement and they are telling me there is no money left to dispurse my part of the settlement. I would like them to pay me my portion of the settlement. They went to no means to contact me or my family.

    This is in response to the complaint ID ********. American
    Legal Claim Services, LLC is a Class Action Settlement Administrator bound by
    the Court-ordered class action Settlement Agreements as defined in the final
    approval order for cases.

    American Legal Claim Services, LLC followed and implemented
    the plan as laid out in the settlement agreement and final approval order for
    the We provided notice, we provided points of
    contact within the notice for class members to reach out with any further
    questions and we distributed the settlement funds as laid out in the final
    approval order.

    In the checks were issued
    on September 11, 2023, to the updated last known address, as indicated in the
    defendants’ records, and went stale (expired) after 90 days on December 10,
    2023, per the Court-ordered final approval order. This timeline was noted in
    section 8 of the settlement agreement approved by the court.

    American Legal Claim Services, LLC did respond to Ms.
    *******, and we provided the details of the court-ordered settlement agreement
    and the final Approval Order issued by the court in this case.  The Class Council responded to the inquiry
    and provided their input on this matter.

    Based on the Final Approval Order of the Court, any uncashed
    funds after the stale date were sent as follows, 50% to the National Consumer
    Law Center, a consumer advocacy non-profit organization, and 50% reverted to
    the defendant ** *********** in January 2024. 
    No funds remained in the settlement fund after that period.

    As outlined above, Ms. ******* was issued a check on
    September 11, 2023, and went stale (expired) after 90 days on December 10,
    2023.  We followed the process as
    outlined in the settlement agreement. 
    The check provided was valid for 90 days before proceeding with the
    donation of uncashed funds to the Court-approved entities.  Ms. ******* contacted ALCS in May of
    2024.  This date was after the date
    provided within the Settlement Agreement that laid out the date to distribute
    the uncashed funds to the Court-approved entities.

    We appreciate your follow-up with us.  We take our fiduciary role very seriously and
    can assure you we followed the outline approved by the Court.

    The reason I am objecting to this response is that I never saw our signed anything that said the check would go stale in 30 days. This time frame is unacceptable. You also state online that you are a business that really cares about your clients. I do not believe that you took every reasonable effort to contact me. You received my check back in the mail. An easy ****** search would have led you to my family. You are a business that takes in a revenue of almost $10 million per year, yet I was told on the phone that it was too expensive to keep that bank account open any longer to make sure everyone got paid. Please make this right. I put so much time and effort into fighting this at the beginning when they garnished my wages. I was filing my own motions, etc. This has caused so much stress. Please do what you can and help. Thank you.

    This is in response to the follow-up complaint ID ********. American
    Legal Claim Services, LLC is a Class Action Settlement Administrator bound by
    the Court-ordered class action Settlement Agreements as defined in the final
    approval order for cases.
    Below are the details defined
    within the Court-Ordered Settlement Agreement concerning the process to be
    followed for payment to class members and the process after the Check
    Expiration Date.


    8.3 Limitation Period
    for Negotiation of Settlement Check: The Refund Class Members
    shall have ninety (90) days (“Settlement
    Check Expiration Date”) from the date of issuance of the
    Settlement Check to
    present such Settlement Check for payment. After the Settlement Check
    Expiration Date, such
    Settlement Check shall be void, and of no further force and effect, and the
    Parties shall have no obligation to honor
    or reissue any further Settlement Check that is not
    presented for payment
    within said ninety (90) day period.
    8.4 Refund to Defendants: Within thirty
    (30) days from the Settlement Check
    Expiration Date, the Settlement
    Administrator shall refund to Defendants fifty percent (50%) of all
    sums remaining in the Settlement Fund and
    shall pay the other fifty percent (50%) of all sums
    remaining in the Settlement Fund as a cy
    pres award to the National Consumer Law Center, subject
    to Court approval (“Cy Pres Award”).
