On 1/30/2024, Brooks septic replaced a failed drain-field that was under warranty installed by them 3 years prior. The inspector requested an excavation due to foam pieces from the original drain-field being in the soil which could have caused this failure. I was instructed that the soil from the original septic should not have been used when they installed the drain-field. Observing them during this repair, they were pulling up domes in sections and pushing the same dirt back into the drain-field again. When I approached them they said they were not excavating. After communication with the inspector and the office they began the excavation. Upon taking the dome pipes out all the liquid came up with a tremendous amount of foam pieces inside. Which proved the installation 3 years prior was done wrong, as suspected. ******* from Brooks septic called me to let me know he would not pay for the new dirt the inspector requested. He spoke with explicit language and screaming at me on how I dont do this work every day and he does. Very unprofessional and unacceptable behavior. After the inspector left is when they started putting the old dirt they had piled up back in over the drain-field instead of hauling it away as they were told. When I approached them they left and came back hours later when I was not home and finished. They left the yard unleveled and a mess. The other issue is they destroyed the county right of way by piling all the contaminated dirt in there and allowing dump trucks to drive to unload in that space. Now the county has issues with this. I was told he needed to pull a permit for that and he did not do that. Next he would have to put it back just as it was. Which he is refusing to do when I have asked and the county has asked. We have tried to schedule meeting with him to try to resolve this and he doesnt show up. He blames this on my laundry soap which was proven false by the foam floating everywhere.Initial Complaint

We had our inspection in October 13, 2021 to purchase a home where the worker couldn't find the cover so the owner had to come and show him where it was - and then passed our system with flying colors (and said they pumped it) only to find out, it was NOT pumped or even opened. We had to find the cover for the yard to be worked on and found that not only was the tank full but the two covers were never even opened or inspected and that the worker that did the initial inspection no longer works for them and that the owner would come out to see it and let us know when. He came when we weren't home and failed it and pumped it saying he didn't know what we have done since October and has not sent us the failing report or answered any of our calls, which are quite a lot nor has he come back to talk to us or show us anything. We ultimately had another septic company 3/18/22 (Advanced, which is amazing) who inspected it and failed it due to the root balls, which take years to form and also noted that whomever pumped it last did a lousy job and showed us all the 'stuff' in the tank. On 3/22, a worker from the pool company was walking to the back yard and fell through the cover as it was so warn, which further supports the cover was never opened originally as it would have been recommended to be replaced. We have no recourse now that it has failed since we purchased the home and can't have seller assist in cost or lower price and the owner of Brooks will not respond to us or provide a report and left us high and dry. please help.Business response

Business Response /* (1000, 17, 2022/06/09) */ We did the original inspection on 10/13/21 and the system passed inspection. Upon receipt of Mr. ******'s phone call there was another inspection performed on this system on 03/14/22 with different results. Also, Mr. ****** advised that another tank was located and it had not been inspected. Majority of homes of that size only has one tank and drainfield area. When the tank serviced was found, the Technication did not search for another tank. Mr. Brooks was working with Mr. and Mrs. ****** until she continued to threaten to sue Brooks Septic LLC. At that point Mr. Brooks advised that if that was her decision, then he would not be able to go further with this issue. Consumer Response /* (3000, 19, 2022/06/09) */ (The consumer indicated he/she DID NOT accept the response from the business.) There is only one task and neither of the two covers, which we found the second buried, we're ever touched. So the systemwide above is false. The system never would have passed had either of the covers were open. Mr. Brooks asked that that employee was a "bad seed" and is no longer with company and probably didn't conduct the proper inspection as he was disgruntled. Mrs ****** asked me brooks what could be done and could we meet in the middle and he said no so I said, jeez I guess we have to call an attorney. I said that one time Only and asked if he would work with us at which time he said if we called an attorney, we would be paying for his too. Mr brooks is not telling the truth and never responded to our multiple pleas to assist in making this right. And threatened us about calling an attorney. All pictures and reports were submitted, which is proof of all this.
