Dear BBB,I am submitting this complaint regarding Pro Garage LLC, located at ****************************************On 27 March 2025 I entered into an agreement with Pro Garage LLC to sell my vehicle through their dealership. Approximately three weeks ago, the vehicle was sold, but as of the date of this letter, I have not received the payment owed to me for the sale.They never told me my car got sold until I had to ask them why it was not on their website anymore. Despite repeated attempts to contact the dealership by phone and email, I have not received clear communication, confirmation of sale details, or any indication of when I can expect payment. This lack of responsiveness and failure to honor a financial obligation raises serious concerns about the dealerships business practices.I am requesting the following resolution:Immediate payment of the full amount owed to me from the sale of my vehicle.A written explanation of the delay.Documentation of the sale, including the sale date and amount.I am filing this complaint in hopes of resolving the matter without escalation.Thank you for your attention to this matterInitial Complaint

On 12/1/24 my partner and I visited Pro Garage LLC with the intention of purchasing a vehicle by financing the entire loan. When asked multiple times how much we were able to provide as a down payment we repeated that our intentions were no down payment and finance the whole amount. We felt pressured into agreeing to $3000 with $2000 up front and the remainder over 2 months. We ended up returning the vehicle because of an oil leak and the credit application not getting approved. We have been calling for over a week and no one provides information on the status of the return of our down payment.Business Response

When our customers have ok or bad credit we try with a different banks, some of them approved it, some other don't , for the customer protection the bank who don't approve the deal send letter to let the person know..... i have the one who approved the deal ..Customer Answer

Thank you for reaching out to us. We understand your concerns and appreciate the opportunity to address them. you purchased the truck on 12.01.24, and shortly after, you brought it in due to a leak. As we discussed, we agreed to repair the issue, which required keeping the truck for at least 2 days. You agreed to this and we proceeded accordingly. Now you have expressed that you no longer want the truck due to financial reasons after selling and then reacquiring your previous vehicle. While we empathize with your situation, the purchase agreement remains in effect, and we are unable to reverse the sale based on a change in personal circumstances. I am rejecting this response because:this is an unsatisfactory resolution. After being pressured to provide a deposit, mind you we used 3 different debit cards. Then dealing with a leak which we were told would take a week to fix, NOT 2 days. Being lied to about where the car came from, we specifically asked if it came from *********** and were told no which we found out was a lie when we ran the carfax report. I reject this response as it is not satisfactory.

On 7/12/24 I saw the ad of a ********** Outlander. I asked the dealer how much and she replied ad price plus taxes (printscreen). Same day onsite, the finance guy (***** ******) told me the seller doesnt know nothing, the price raised $4000 (Bite and Switch Fraud). I asked what was included and he said, dealer fees and taxes. He deceived me when I asked to see the final price, he didn't show the contract nor the itemization. He sold me a warranty saying the finance price would increase if not pick it, but it is not in the contract (Ad-on concelament fraud). He just sent the contract later by email with a ***** of me I didn't approve. During the testdrive I asked about a problem with the car and they said it was normal. The car broke in less than 24h. They induced me to buy a problematic car. They fixed but didn't give me a report and receipts showing what broke. I felt even more suspicious and decided to do not stay with the car. They denied to give my deposit back. With no choice I chose another car (2019 *** forte) on 7/27/24. They knew I had no choice and increased the price (from the ad) even more than the first car. They told me the finance was simple interest. Again I asked what was included and he said dealer fees and taxes, again didn't show the contract nor the itemization, and just sent the contract by email later. I just saw the contract next day (on both cars), and realized the dealer fees and taxes were not included and the price increased by almost 3k of what we had agreed. Calling ******** financial I discovered another lie, the interest actually was precomputed. I concluded this was an auto dealer fraud and decided to return the car, so I did it at 6pm of 7/30/24. They don't want to give my money back saying they're already out of pocket because some fees after cancelling the contract. The thing is, I was frauded, induced to get into this situation, so I don't think it is fair to pay these fees. A detailed description with and evidences are attachedBusiness Response

We are writing in respond to the claim filed by **** Enrique ****** regarding to the down payment for the purchase of a vehicle at our dealership. He purchased a vehicle from us and agreed to the terms of the purchase, which included the non-refundable nature of the down payment. this agreement was confirmed via text message, where the costumer clearly acknowledge and accepted these terms. for your reference, i attached the relevant communication showing the costumer's agreement. Our dealership is committed that all transactions are conducted transparently, and we make sure that all costumers understand the terms and conditions of their purchase. In this case the costumer was fully informed that the down payment would not be refunded in the event of a cancellation or dispute, and this was agreed to by the costumer before the transaction was finalized. I am rejecting this response because:I agreed while I thought what you were saying was the truth, I trusted you and signed that, but on the contrary you replied, you was not transparent, and I have evidences of it. I asked what was included in the final price and you replied dealer fees and taxes. I asked to see this on the papers you printed to me to sign, you indicated to me, but that was not the contract, nor the real final price. You didnt show to me the contract with the itemization. This is mandatory by law. This would be transparent and in accordance with law, but you just sent the contract to me later after I leaved, on the email, with a forged eSignature of mine. On the contract was a final price higher of what I agreed, where dealer fees and taxes were actually NOT included in the final price. How could I agree and sign that contract if I didnt even see it? The eSignature is even different of the real one I use everywhere. If you had printed the contract and presented it with all the other documents you printed and asked for my signature, if I had seen the itemization, I would not agree and would not sign the other documents (any document, nor the receipt of deposit saying it is non refundable). These all are evidences you deceived me, induced me to buy the car and sign some documents. I still agreed until certain point, but during the course of events I kept discovering more and more lies, for example, that the interest was actually precomputed. So I decided to return the car only because I noticed all of this was a scam! The fact I agreed and signed the receipt of deposit, does not nullify the fact this is fraud, that you induced me to make the decision to take the car and consequently sign some documents (not the most important, the contract you should had presented it first), does not nullify all the lies. On the contrary you replied, this was NOT transparent, and it is NOT in agreement with industry standards and legal practices. I am COMPLETELY sure about it!

Everything I signed was electronic where? I signed by hand in papers, all were papers you printed and gave me to sign. The only one that has a (false) eSignature of me is the contract about the finance. I didnt give you permission at any time to force a eSignature in a document I even didnt see, how could I eSign something I didnt see? Now you have to prove where this permission is! My eSignature is different of my entire name and I can provide several examples where I really eSigned showing it is different.Sincerely,

The document for Westlake about the finance, you putted an electronic signature of me, I didnt signed that, not in person, nor electronically, I even didnt see that document before leaving the dealership, and you know that. I live very far away, I dont have a car to go there, and wont have one for a long time because of you. You are with all my savings since I moved to the **. This is not fair at all! I will send an email to **************************************************************** showing my electronic signature is different than that you putted there. If you dont want to refund me, what other solution could you provide?
