I put down 12,900$ for a Corvette they have listed, that was the set down for the car. Two weeks have passed and to my surprise I was never approved for the car, going on forward they are asking for more money down to approve me towards the bank but Im just asking for my down payment back since they legally own the car and I have no possession of it. I just want my money back I put down and they are refusing to give it to me insisting either we go to court or cough up more money.

This customer had lied about his income on a credit application. His income is half what he stated. When the bank determined his higher date and true income days after he took possession of the vehicle, the deal was denied and returned. In order for the bank to approve a new loan with his true income, he must put more money down. We recently spoke with him at length about this, and he is agreed to new terms. We are hopeful that this complaint was submitted before our conversation and that he will remove it, knowing that it is his fault for exaggerating his income. Furthermore, this customer damaged the vehicle shortly after taking possession, and the vehicle has not been in possession of the dealership. It is at a mechanic and waiting to be fixed and paid for by his insurance company. This vehicle is legally his, and it his responsibility to pay the remaining balance owed. We look forward to finalizing a new contract with him and the bank tomorrow.

On August 28, 2023, I purchased a used 2016 GMC ****** **** from Nick ********************** in *********, *******. As soon as I left the dealership the car immediately presented a problem. It had a knock and soon after a sudden acceleration to the point that it scared us. The engine light came on. The dealership had closed, so I couldnt take the car back to the dealer. The day after, I took the car the at ****************************** dealership located at ***********************************************, where after an inspection I was told that the car has lifters, camshafts and the torque converter that need to be replaced. I have taken the car to a couple of mechanics in my area and they have all confirmed these defects. They have quoted $8,000-$10,000 to repair these defects. These grave defects were not disclosed before I purchased the car and may constitute fraud and deceptive trade practice under the provisions of Section ****** of ******* Statues.

Hello again - I am not sure why many fields of the complain are not populating. This is a complaint about fraudulent sales tactics, whereas the dealership concealed grave mechanical issues of the car I purchased from them. These issues manifested as soon as I left the dealership. I am requesting the nullification of the sales contract and the return of my money upon the return of the car to the dealership. As of 1:30 PM on Monday, September 18, 2023 I have not received any response from the dealer.

    Thanks,

On August 28, 2023, ************************* purchased a 2016 GMC **** from Nicks Motors and left with the vehicle in good mechanical condition. ************* assessed and test drove the vehicle thoroughly before purchasing.  ************** was aware of the AS IS agreement on this vehicle, and he has never returned to this dealership to review these claims.Furthermore, ************** has changed his story and the cost of the repairs on multiple occasions.

    Customer Answer

Hello again - I sent the dealer a text message as soon as I noticed the problem with the car, but I got no response. I also sent him an email on September 6, asking him to nullify the contract and return me the money, since the failure to disclose the grave problems with the car constitute fraud and deceptive trade practice under the provisions of Section ****** of ******* Statues. He ignored me and never acknowledged the receipt of any of my emails/messages. I have taken the car to 3 different dealerships/mechanics and they have given me different repair estimates, because in order to accurately describe the repairs needed, they need to open up the car and thoroughly inspect the damages. However, they all confirmed the car has grave issues the repair of which will amount into several thousand dollars. I am hoping to solve this issue via BBB, otherwise I will be forced to hire a lawyer to pursue this case.

I am rejecting this response because:
I sent a text message to the salesman as soon as I got home (I live in ***********, quite a distance from Hollywood), the same day of purchase, in which I complained that the car had had a blowout as soon as I left the store and the check engine light had come on indicating the anomaly. He never responded. I left the car parked in my parking space because I feared further engine damage, and two days later I took it to ************************ on ***** to have it checked. From an initial analysis they detected a missfire in cylinder No. 3 and assumed a failure of the lifters and torque converter giving me a rough estimate of the damage (about $10000 for the engine alone!) which I promptly reported to the seller, but again he did not respond to my messages. Then I took the car to another mechanic who gave me a more accurate estimate claiming that the cost of the damage would be very high and that it would be better to replace the whole engine. The transmission is also damaged and needs to be replaced, which is why the costs changed several times because I gave other estimates.
If the seller claims that the car had no problem at the time of sale, I demand to be shown the preliminary inspection document, otherwise he is lying and sold me a car with hidden problems that only emerged by driving the car on the road. The seller filmed me during the test drive, which lasted too short to assess any hidden problems. He has the video in his phone. When I told the seller, "I hope the car has no problems," as I signed the agreement he replied, "you drove it." What a great transparency, eh?
    Sincerely,
