Date of transaction was May 18th 2023 in the amount of $11,540.45 as a %50 down payment.I was to purchase custom entry doors for my home in ********. I spoke with ******************** of FBS which operates under ERCOLE USA LLC. I signed a contract and he said he would send me engineering drawings for my approval and that once signed and approved by me they would move to the manufacturing stage. After sending his engineer to my home and taking measurements with Lase 3D mapping to ensure accuracy I received a drawing that was not at all what I ordered there were 17 points of contention and inaccuracies that if manufactured it would not have fit my home. The design was not as described or as we had discussed. furthermore, his contract states the following:3. Construction/ fabrication of all doors, windows and/or other fixtures and equipment subject to this agreement shall not begin until Client approves, in writing, the drawings, plans and specifications for all items included in this agreement. Once fabrication/ construction of the custom doors and/or windows begins, Client shall be responsible to pay all sums due to FBS pursuant to this Agreement.(for all items included in this agreement includes Item 5 which means since I did not sign off on design drawings then item 5 is now void as well).Item 5 States the down payment is non refundable Which is void if the drawing is not signed as he discussed with me.******************** has refused to refund my $11,540.45 deposit and has produced nothing to keep that money. Here is a list of issues with his design that I rejected.(17) FBS Door Drawing Issues of which (10) are Not as advertised. ****, just went through the design drawing and I am having some issues with the design. 1.There is no front view of Active deadbolt side lock mechanism view or Passive side bolt receiver door view.2.The door is only double hinged and weighs over 600lbs? my current door is triple hinged. this concerns me. You and I discussed 4 hinges on each door. This is not what was advertised.3.The milled panel is 1/4W x 1/4D this is too basic I thought it would have more contour to it instead of just a straight milled wall. This is not what was advertised.4.You and I discussed 16 deadbolt design (4) on active door hinge side, (1) at header active side, (1) at threshold active side, and (4) at locking mechanism.(10). Plus (4) on hinge side passive door, and (1) at header passive side, (1) at threshold passive side. (16) total. This is not configured on the drawing. This is definitely not what was advertised.5.Door jamb width appears to only be 88/3.464 which is half of what I currently have. This is not what was discussed or advertised.6.Section View B1-B1 is not shown on the drawing. It should be drawn in the elevation view through the top of the transom.7.My current Transom is actually offset (toward the exterior) from the centerline of my door. Your drawing shows it right on centerline with my door which will leave a gap on the interior when the door is installed. This not what was advertised Merchants 3D mapping would have shown this but service was never completed.8.Your drawing shows mounting this design to a cement substrate which I do not have. This not what was advertised.9.In Detail C the transom width is dimensioned at 495/**** this number 495 is incorrect. This not what was advertised.10.All Metric conversions to Inch Standards are incorrect as in previous example 495 is not (****) its (******) this is every dimension.11.In Sect. A-A you present a view of the front leading edge of the Active door when I should not see this because the section is actually past this edge.12.There are not any manufacturing notes as to how many mounting fasteners and their locations around the transom and door frame.13.There are no installation leveling screw/jacks to adjust the door in R/O to true and square the door. This not what was advertised. (R/O is rough opening)14.There is no insulation in this steel hollow core structure only the *** skin on either side of door. This not what was advertised.15.Door frame thickness is actually only 50/1-15/16 (*****) each veneer is then 19/.748. This not what was advertised.16.There is no SCALE to the drawing all it says is N/A. Additionally there is no weight associated with the design.17.I also requested a copy of the 3D laser mapping of my entry way as was described by ******** the engineer involved in the laser measuring my entry way. I was later told by ********, after his resignation, that it does not exist. Attached you will see supporting document ******** Door Laser Report. This was a crucial feature to mapping the arched transom correctly so the new transom fit properly, again this was never completed and not as advertised.I am seeking a complete refund from this dishonest/deceptive business practice at FBS/ERCOLE USA LLC.I have many pages of supporting documents as well as other complaints from customers and another BBB complaint to your ***** from last year as supporting evidence.
