      Good afternoon,

      Douglas Realty has attached documents and would like to comment on ********************** complaint.

      ****************** left the property of 246 Peerless St, and our company received her surrender notice on 3/11/2024 not on the date of the notice, she did not return the keys to the home as she stated she lost them in her move.

      **************** did not give us prior notice to her moving out which was required, so it was deemed she abandoned the property because of her inability to continue to pay rent.  She left on the 11th of May which was fine we would always rather someone move out then stay and not pay rent, but she did not pay rent and moved, so that months' rent was due to the owner of the property.  ********************** lease transferred to a month-to-month lease which requires her to give us notice before leaving.

      As explained to ****************** the additional charges due to the owner will not be sent to collections, as I have explained in numerous emails - she is being charged for the full months' rent of $1850.00 for March as no notice was given, the charges on her lease for cleaning, keys etc. are stated as minimal charges so the charges indicated on the settlement statement were not misstated.

      I explained to ****************** that she was in a contract with the owner of the property, and she did not abide by that contract.  Our company would not seek to collect the funds owed to the owner for the additional charges on her settlement statement, but that she would not be receiving a refund.  The owner of the property should not have to financially suffer because she moved out because she could no longer pay her rent.

      I am rejecting this response because: Ms. ********************* has fabricated her entire defense. My contract expired end of Feb. 2024 AS PER LEASE. I was not in any binding contract in March. As per my lease, after the annual term was over, and my lease automatically renewed into a MONTH to month basis. I left first week of March, march 4th to be exact. In November the year before 2023 I inquired with Douglas realty about the status of renewal MANY times and they REFUSED a renewal. ******** said he is withholding on account of my behavior! I never caused any issues with the unit, any company that managed the home during my stay, inspected the home many times. Home was always kept clean, and in great condition. From November all through January the office even discussed transfer options, to move me from this unit managed by Douglas, to another.

      I did not vacate because of an inability to pay rent. I vacated because the landlord used two companies to manage the unit during my occupancy, and even the last company ******* Realty could attest the landlord refused ANY repairs because he was being cheap. I was without an oven door for weeks. I moved into the unit and the tub were painted blue with THE wrong paint. This paint bubbled every time my young children bathed. I asked many times to have the paint fixed. Both tubs master and guest! Owner refused because of the costs. I spent my own money and 10 hours removing the paint and rust from the tubs that were left behind because my kids were otherwise being exposed to poison from the bad paint!! 

      The sliding door and all windows were sealed shut with silicone by the previous tenants or perhaps the owner making an effort to pinch pennies! Douglas Realty, ****** office representatives, ***** and *** discussed a month to month term and many times with me by phone and in person even by email also about me vacating this unit first week of march. I did also mail the notice which I was not going to continue occupying at the end of my term. ******** served me 3 day notice on the 1st!! 

      If they want to charge me for the time I occupied the home, charge me for the 4 days I was there! My deposit was $2,300! I am rightfully owed these funds in FULL! Or minus the 4 days! 

      FINALLY, my lease, which ********************* has clearly never read said lost keys would cost me $65, they charged me $200! My lease said cleaning with carpet would amount to $350, the unit has no carpet and they charged me $400! I removed everything from the home which was mine. Even swept! All a cleaning crew had to do was perhaps wipe the walls! Douglas also charged me $2000+ to paint and spackle entire home!! This was not a term in my lease, walls are well within normal wear and tear and should be considered beyond landlords expectations! 

      It was a representative from DOUGLAS, in fact I believe ***** herself was at the house 3/4 and saw the entire home empty and clean! She even suggested we lease again with Douglas because it was just this landlord that was terrible. Come to find out the company is owned by this terrible landlord. Conflict of interest!! They are trying to scam me! A negligent tenant would have left the home in bad condition!! This is bad business! I am perusing them legally! Please beware!

      THE OWNER IS NOT SUFFERING FINANCIALLY! This is an outrage! He jumped my rent almost 400$ the first year I renewed!! I was paying 1850 FAITHFULLY! Even if I was late, he always got him money!! How dare they take advantage of tenants like this! This man and his whole company is bad business! They are slumlords!

      We have received the response email from BBB.

      As much as our company does appreciate ********************** response it has nothing to do with the actual security deposit claim.

      Leases are contracts, if a contract is not abided by there are always consequences. I will mention again a full month's rent of $1850.00 was charged as our office did not receive written notice that she was vacating the property as was required in her lease.  The additional charges for cleaning, keys etc that are mentioned in the lease were minimum charges.

      I ********************* have never been to the property of *********************************** nor was ************************ opinion asked for whether the owner is suffering financial hardship as she knows nothing about the owner's circumstances. I have never had a conversation with ****************** regarding her renting another property with our company, I believe she may be confused on the facts.

      Our claim remains final, and as I have stated to her on numerous occasions our company will not pursue her for the balance owed to the owner.

      I am rejecting this response because:

      Clearly my response was beyond ms. ********************* comprehension. The only part I am unsure was which representative from Douglas served final 3 day notice in person. I was served in person and that representative saw my home was already empty and clean. I have photos to support this claim. Finally, I submitted notice required and also had MANY discussion with both ***** and *** at ************* about my plans to leave unit first week of march or possibly rent another unit. It appears this company lacks transparency and accountability! My annual lease was over end of Feb, March I automatically renewed into a month to month contract. As per said binding contract,  owner or tenant was only required ***************************************************************************************************************************************** unit.

      In 2022 *** destroyed ( partial ) of the roof of the duplex I have rented for the past 7 years. I have been asking the homeowner to get the inside repaired from the mold and mildew damages and he still hasn't come up with a solution. Both sides of the duplex have families living in them with children under the ages of 14. This is not good for their health. I had told the homeowner mulitple times about the damages to our side. The only thing that has been repaired from Hurricane *** was the roof. I had multiple issues that were fixed faster than the **** and I have included those screenshots as well. There will be a case number in one of the photos that will has a case number with ******************.

      To whom It may concern,
      After a discussion with our client, we would like to respond. 
      Our client and owner of the property of 311 **** Ave S.would like to complete the repairs needed in his home, he has not been able to gain access to assess the situation and have estimates completed to get the work done.   The owner of ************************ S had an agreement with ************* that her father was going to complete the repairs (which were not done)and had reduced her rent by $300.00 a month in September of last year to help alleviate a financial situation she was going through.  Our client the owner of ************************ S is a man that does complete the needed repairs on his rental units and has just completed a water system repair for ************** at her request to her satisfaction.  (this was an outside repair so no access was needed inside the unit)
      Our client has tried to enter the property to assess the needed repairs and was met with pushback, as well as the police department being called because he was at the unit.    An owner of a property has to only post a 24-hour notice to enter a home to do emergency repairs.  Our client would like to have the opportunity to enter his home to do the needed repairs that is required to make ************** comfortable and his home safe.  Our client will need to have access to assess with his vendor/vendors of chose for estimates of what is needed.
      ************** is currently not in an active year lease but is residing in the home on a month-to-month basis as stated in her expired lease,our client would like to have ************** continue to reside in his home rather than non-renew the residency if access is not given as repairs need to be completed.
      My client wishes to schedule an appointment to hire a contractor to address the tenants concern he wants to fix the issues but he will need assess to the inside of the property to do so.

      This property management company has not fixed anything since the hurricane. It took over a month after to get a refrigerator. Thats a long time to live out of a cooler with two kids. The company feels this is acceptable. The property is a health hazard as it took on water. The house, pool area and yard with power lines still in it was of no concern to them. Everything has been every one elses fault but theirs. The negative reviews I see on this company are EXACTLY what I have been dealing with. ********************* informed me that I chose to stay. Given the market, my employment and my childs schooling it was difficult to even find a new property. I did and now Im getting the run around about my security deposit. I just want to be done with Douglas Realty.

      Douglas Realty has provided the owner of the property the condition reports after Hurricane ***, and the owner has been to the property as well.  As a property management company we do not do repairs without an owners consent nor do we  have the availability of a vast amount of vendors and companies to rectify the situations that we are now facing due to the devastation of Ian.  Do we feel that this is acceptable no, but we also have no control over the situation.  Our company can only contact and send out requests for repairs, estimates and time lines for repairs that are needed.  The refrigerator issue from what I understand was an issue with the availability of appliances due to the mass building that is and was taking place in SW *******,  which is also not in our control.

      *************************** notified us that the property took on water during the Hurricane, I informed her to move out and provide us with her forwarding address so that we could refund her security deposit.   Our company as well as other have had a number of client/tenants that moved out directly after the Hurricane with no penalties because of the condition of their properties.  If the property was a health hazard she should have vacated the property, if she remained, that was her decision and she should have to pay rent for the time she chose to stay.  ******* is two months behind in rent and I do suppose she feels the owner is not entitled for compensation for her living and keeping her belongings in his home.  

      The Market, her employment and her Childs schooling is not ours or the owners fault, its an unfortunate circumstance in which she needs to work out not blame our company.  If she chose to stay, she chose to have to pay rent.  We are a understanding company that is why when she did not pay any rent at all for 2 months we did not take legal action.
