Evas Best Travel (EBT) is a small husband/wife travel agency that is supported by a larger travel "host" agency, Outside Agents (OA) for a fee and commission agrmt. EBT then utilizes a wholesaler (*****) accessed through OA. Under contracts between EBT/OA and wholesaler, the client (we/us) can not communicate with the wholesaler. The wholesaler puts together the actual itinerary. We planned a moderately detailed trip to ***** for June 2023 that included 3 cities, ******** being one. Decision to purchase was made on Sat 2/4 and deposit & paperwork submitted. Although this took place on a Sat/weekend EBT indicated to me everything was "held" until Mon 2/6 when it would all be finalized. I did not hear from EBT the days following so assumed it was confirmed. I then heard from EBT on Thur night 2/9 that the hotel in ******** was sold out. Meanwhile I later learned EBT had been notified by ***** of the sold out hotel on Tues 2/7. EBT waited 3 days to inform us. They offered alternatives in the package price range. One was not as nice w/ bad reviews and the other 5 or so were NOT IN Positano. Being IN town was the requirement and in the original itinerary/contract with deposit. Since ***** could not find a comparable alternative EBT went to another wholesaler and found a hotel (not as a "package" price) that was $1000 additional on top of our package itinerary. We feel had EBT not waited 3 days to communicate this we would have had a better chance to find a comparable hotel. Apparently things were selling out very quickly for this destination this time of year. We feel EBT should absorb the cost of the additional $1000 through her commission as it was her fault for waiting and we missed possible opportunities. In addition, EBT has been very uncooperative in giving reasonable explanations, blaming ***** and not admitting or taking responsibility for her mistake. She has not been truthful with details of the reservation and has misled us. We feel trapped with no recourse.
