    I made the winning bid on a ******** print I dearly wanted online through liveauctioneers on Aug. 17th. I called ********* ******* house the next day to let them know I would pick it up in person the following week. They said to give them a call the day before so they can have it ready for me. I called the next week told them I would be there the next day, 3pm at the earliest and the woman I spoke with said they would have it ready. The auction house was three hours away from me. When I arrived the woman at the counter did not know I was coming, she called another employee responsible for collecting items to be picked up and he asked if I was sure I had an appointment for pickup. He went back to look but couldn’t find the print. Another employee was recruited for the search. The owner was called out. They apologized and said they would keep looking and let me know if they find it and ship it to me at their expense or they will give me a refund. I asked when I should call if I haven’t heard from them and she said a couple of days. I left frustrated and perplexed. No call from the auction house. I called 2 days later. The woman I spoke with was not familiar with the situation and put me on hold. No, they have not found the print, she said. No idea what happened to it, it may have been lost before the auction, she said. She said she would contact liveauctioneers to find out how to initiate a refund and cc’ed me on the email to them. I have a hard time understanding why they were not more concerned that they lost an item that had been part of their most recent auction and purchased. How does that happen? I was at the auction house to pick up the print on the 23rd. They told me they would give me the refund over the phone on the 25th. They sent an email to the web hosting service on the 25th asking how to initiate a refund (Please find it attached). And I received a following email from liveauctineers sending the responsibility for the refund back to ********* *******.

    I have contacted Dave Johnson, owner of Greenwich Auction four times – by email and text – since December 2022 regarding a Chinese painting I inherited from my parents asking him to return it to me. To date, he has NOT responded to me: he has NOT returned my painting. I entrusted my painting to him to auction or sell privately on my behalf. I understand he put it in one auction. It did not reach its reserve: it was not sold. As I noted above, I subsequently contacted and asked him to return my painting. He blatantly disregarded my emails and text. Mr. Johnson’s action(s) or rather lack of them are unconscionable. His keeping my painting, to my mind, is tantamount to thievery.
