    We agreed to a new project with Henry's Tree Service after some initial tree removal. On August 11 we paid a 50% deposit via check to Henry to complete the excavation of a hill in our backyard. He initially requested almost the entire contract amount as a deposit and we refused.
    For the project, he would remove trees, create a flat portion of yard that went to a new slope, fix the slope to ensure it was stable, replant evergreen trees already in the yard, install a 3ft wall with concrete blocks, plant new arborvitaes, spread topsoil, and plant grass seed. He was also going to remove a shed on the property and move stone stairs to a new location. Henry indicated the work would take two weeks and work began on August 12. By the end of August, he was not done with the work and requested additional funds. After much discussion we provided a small advance that took our total payment to Henry to approximately 63% of the contracted amount but a similar amount of work had not been completed.

    We are now in October and Henry has requested more money. We have refused except to pay as work is completed. He has stopped responding to us. As a result of his work, we have now been left with dead or dying trees, additional trees that could potentially fall, and a yard with an incomplete hill that will require additional funds to ensure it is fixed properly. We also have no grass on the newly cleared area or on areas previously damaged by him (that he indicated it would fix at the end of his work), broken stone steps and broken sprinkler heads.

    We tried to file a claim with his insurance based on a Certificate of Insurance received from his insurance broker on 5/27. The Insurance Company just informed us that the policy was cancelled on 6/12 for non-payment. As such, all of the work he did for us was while being uninsured. We also learned that while Henry's is registered with the state as a business, he is actually not licensed to do any of the work he did or began for us.
