      I would like to officially lodge a complaint against Mark D********, the owner of MJD Builders, LLC and also the owner and builder of ** ******** ******** *********** ** *****.

      On May 23, 2024 around 2pm, a heavy trailer from ******* ******* of ******* with an excavator onboard hired by Mark parked on my lawn, apparently lost. Before I could engage the driver, Mark’s truck pulled up. He rolled down the window and yelled at me: “Don’t be an a******.” He limped off the truck and took a quick look at the damage and declared: “This was nothing. Call 911 if u like. I will call it for u.” With that, he sped away. The trailer also drove off. I had to chase after it to take a picture of its plate.

      I did call 911 immediately and Sgt. T***** showed up. He listened to my account of the event and drove to ** ******** to speak to Mark. There is no dispute about the facts.

      This is the second time Mark / his hired vehicle caused similar damage to my lawn, the first time being 9/8/2022 (police report also filed). Same as today, Mark showed zero remorse and made zero effort to repair the damage back then.

      Mark’s construction has been a nuisance to the peace and tranquility of ******** *******, an absolute menace to my front lawn and a total disaster to the forests that used to occupy his lot.

      Thank you for your consideration and attached is also a complaint I filed with my HOA almost two years ago. I have all the photo evidence but am not able to upload given the 5MB file size limit.

      The right front tire of the delivery truck that rolled onto Mr *** lawn was NOT my truck, so I deeply apologize that this situation happened, but this delivery truck was out of my control

      I am rejecting this response because:

      1. Mark neither apologized nor repaired the damage. 

      2. Mark hired the truck for the construction of ** ******** ******* down the road. 

      3. The damage was caused by the truck while the driver was working for Mark.  Therefore Mark should be responsible for the relevant actions of that driver during that period.
