On August 1, 2022, as part of an industry-wide review of CBD businesses in our service area, Better Business Bureau Great West + Pacific contacted Elixinol, LLC concerning the following advertising claims found on their website, https://elixinol.com/:  

- “Shop by benefit. Everyday Balance, Sleep, Stress Support, Active Mobility, Immunity” 

- “CBD supports feelings of calm, a better night’s rest, relief of muscle pain after exercise and overall wellness.” 

- “CBD is not a drug. It’s a natural extract that does not produce a high like marijuana and is non-habit forming.” 

- “There are dozens of studies that demonstrate the outcomes of cannabidiol as a modality for various conditions. Most of these studies conclude that CBD is safe and virtually free of side effects.” 

- "...science suggests that up to 1500mg of CBD per day is acceptable (and perhaps beneficial) for adults. While CBD and cannabis have various side effects, using CBD long-term is shown to help with various conditions like insomnia and chronic pain.” 

- “While cannabis in general can affect memory, it’s suggested by some studies that CBD may actually help improve memory. “ 

- “The products are safe, effective and crafted with care to support the everyday health of your best bud.” 

- “CBD + Melatonin supports optimal sleep — and we all need more of that. It helps our minds de-stress, bodies heal and immune systems kick-in. We pair melatonin with CBD to help promote calm, relaxation and keep our circadian rhythms in tune.” 

- “Our bestselling CBD is the core of your wellness routine. The full-spectrum formula works with your body to promote relaxation and a healthy mood, and gives you whole-plant terpenes and flavonoids for a beneficial “entourage effect.” Just the balance you need to rise above the everyday and keep mind & body at their best”. 

- “Together, this body-focused formula helps support healthy joints and helps you bounce back from workouts or long days.” 

- “Our Calm Dog Chews promote calm and relaxation for adult dogs with occasional nervousness, stress or over-activity.” 

- Business website displays Customer Reviews that include health claims. 

- Native Advertisement. Elixinol in the News: Heavy. US Weekly, Purewow, InStyle.  

BBB requested that Elixinol, LLC review its advertising and provide substantiation based on reliable, recent, competent testing for each of the health claims made and to discontinue any advertising that is in violation of FDA and FTC mandates for this industry. 

Despite written requests, as of August 26, 2022, Elixinol, LLC has not responded to BBB’s request for revisions and clarification in its advertising.  

Advertisements should be truthful, sincere offers to sell. Advertisers have a responsibility to have substantiation for all claims made and should be able to provide that substantiation upon request. All advertising that may mislead or deceive consumers should be avoided.  

Claims relating to performance and results should be backed up by reliable evidence. 

Advertisers should ensure that testimonials and endorsements are not misleading and represent the current opinion of the endorser. A consumer endorser’s experience should reflect what users generally achieve, unless there is a clear and conspicuous disclosure of what the expected results will be. Advertisers should not include claims in testimonials that they themselves cannot make and support. 

Native Advertisements are created to resemble the design, style, and functionality of the media in which they are disseminated, which could make it difficult to distinguish between advertising and non-commercial content.
