I have provided a very detailed account of the case along with evidence attached to it. To make it very short, I sold a house to a company who flips houses and his blatant breach of contract and failure to try and rectify it has brought me to file a complaint and seek reimbursement from him in lieu of small claims court. Hello! I am writing in response to crystal la dukes comment on my page. I had a contract to purchase this house and send the sellers old vehicle in need of repairs. I agreed to do it like the contract says. I hired a company (vehicle shipment company) to come out and ship the vehicle. When the company showed up to ship the vehicle they said that they were not able to ship it because it wasnt functional and needed to be moved to a better location for pick up. I advised crystal of this and that it would be more time to wait because we dont know anyone with a tow truck.
But that I would still ship the vehicle to her.
She immediately hired another tow truck company to move the vehicle and hired another company to come in and ship the vehicle and now she is attempting to get me to pay for the shipment regardless of what it costs. If I am paying for the shipment I reserve the right to get the best deal possible. My bid to ship the vehicle was $800 of which $150 I had to put a deposit down on. Well since she went ahead and shipped the vehicle she took my deposit with the company I hired and now is attempting to come after me for damages. I never once said that I would not ship this vehicle. I asked for a few days more time to find a tow truck but she decided to pay any price necessary to get things done and she wants to bill me for it. I do not agree with this. And if this does go to court me and my attorney will fight it if we must.
