I signed up for the Program on 09.06.2023 and was to call the company and set up an initial appointment for one on one consult and then I was to receive an email from musclemonkeyfunctionalfitness.com to set up my account. I called every day and received message mailbox full or left message and never received call back. so I emailed *************************** and ************************* on 09.12.2023 to cancel services and requested my deposit back. On 09.29.2023 received email from ******************************** to set up my account. I emailed musclemonkeyfunctionalfitness.com with question, Why am I receiving this email to set up my account when I cancelled this account. NEVER received anything else from this company until 11.29.2023 when I received another email from musclemonkeyfunctionalfitness.com, that my payment was due. I replied again to musclemonkeyfunctionalfitness.com, why am I receiving this payment request when I cancelled this account no response again until 01.22.2024 when I received an email from musclemonkeyfunctionalfitness.com, saying my membership will expire in 1 week. I replied to musclemonkeyfunctionalfitness.com again that this account was cancelled. No response again until 03.04.2024 from NATIONAL RECOVERY COLLECTION AGENCY saying I am in Collections from 047 FITNESS SALES.NET LLC for ****** dollars.Your cancellation was denied as it was sent outside of the buyer's remorse window. You signed the agreement on 9/6/2023 and your cancellation request was not postmarked until 9/13/2023 which is outside of the buyer's remorse window. We emailed you on 10/9/2023 advising you of the denial and advising you to contact our offices to put good billing information on file. We did not hear back from you, even after mailing multiple late notices to you. After over 90 days of delinquency your account was closed the unpaid balance of your 12-month agreement was placed into collections.

    Business Response

    Date: 03/18/2024

In response to *************************** complaint, we hired a third party consulting company that ran our ads and did sales for us. The name of the company is Gym Rescue. All contracts were signed with them. We have no control over that. Our policy at Muscle Monkey Functional Fitness is to release any client from any obligation if they no longer want to continue for any reason, without penalty. We are saddened by the fact that this third party company is pulling this nonsense with people.  We, however, have no control over it. It isnt our contract, not our debt collectors, nor our attorney that drafted this contract *************************** signed and agreed to.  Muscle Monkey Functional Fitness is not affiliated with Gym Rescue or NAC billing.  They are a completely separate entity and not connected to us in any way other than coming in and running some ads and doing some sales. They swindled us as well to the tune of well over $60k after all is said and done. We regret this unfortunate situation, both for the accuser and any other gym that has made the mistake of hiring this company.
