    Came home from vacation to check on our family home and found that N&D Tree Service had come onto the property and removed all of our trees in the backyard except for two. Ive called the city and **************** Utilities. They stated the ************ was under contract with them to trim back trees off the utility lines and after speaking with the city, they have that N and D ************. Did not have permission to come onto my property nor did they have permission to remove my trees and that they would need to come to a compensation conclusion. I have attempted more than half a dozen times to call them so Has The city they refuse to call back. Sidenote, the next-door neighbors trees are still in the powerlines when their story to us was that ours were in the powerlines and they decided to remove all of them

    We are a contractor for ***. The complaint in question refers to removing trees while out of town

    Per our contract with CSU -  all material within 10' of the primary conductors is to be cleared in safety zoned of the power distribution system and overhead primary conductors, nearly 824 miles. This includes trimming trees and removing "brush". When the power is out during storm or wind events due to vegetation we are here to help, as well as keep the system safe to our contract requirements set forth by ***

    The specification or brush per contract: Brush - All material under 4.0 inch diameter at breast height (DBH) - This measurement takes place 52" above ground. We have video and images prior and post brush removal at this property on August 20th with GPS start and location and time at the property. Most elm sucker stems were between 1.1 inch and 1.8 inch DBH, two were between 2.8 and 3.2 inch DBH. Brush was removed from the property and chipped. Old garbage and trash were are not part of our contract. Customer filed a complaint and insurance claim with the *** extension, once this approved or denied by ***, can the customer put a claim into insurance; if approved.

    *** notifies all customers prior to arrival by mail and door knocker. The property in question was a rental. We are not part of this notification process, and are not certain where a breakdown of communication took place with the tenant and or owner. We attempted on 3 different occasions to establish contact at the front door prior to brush removal.
