Due to lack of responsiveness, work not started or completed, inaccurate statements, and multiple safety and quality issues, we terminated the work orders and demanded immediate return of down-payments for work not delivered, a violation of Colorado’s Construction Defect Law of Colorado Consumer Protection Act. A refund of at least $25000 of the total $35515 payments made was demanded via cashier’s check by 5p5/23/22. This amount was providing for extremely generous hourly wages for the work half complete. (Not one of the five invoices have been completed to its intended value, and I will need to hire someone else to finish the jobs.) Mr. Velarde has not responded to a certified letter/Return Receipt request. The request receipt was signed and returned to me; however, my calls now go directly to voicemail with no response. When phoned and texted on 4/22/22, Mr. Velarde said the money was already used for the product and product is being set aside at ****** Park. ****** Park of Loveland, Colorado, has reported on 5/2/22 that there is no open or running account open for Anthony Velarde or Velarde Landscaping. This is a violation of Theft by Colorado Contractors – 38-22-127 – the Trust Law. Further, on 4/7/22, Mr. Velarde informed via text that he completed a fast-track building permit through the City of Loveland. A fast-track permit usually takes three days to approval. I have an email from Morgan Hurla on 5/2/22 that no permit has been completed. This violates the Elements of Liability of Colorado Consumer Protection Act 29.1 Deceptive Trade Practices. Mr. Velarde continued to text that he “is going to complete the work;” however, he will not commit to construction dates or a completion date more specifically than “maybe next Wednesday,” nor does he arrive when he says he will. Mr. Velarde informed me that the work would be done in one week as soon as the snow melts which is what was written on the Homeowner’s Association request documents. Please help me.
