    I went to aces motorcycles website to look into financing options for a powersport vehicle. After reviewing the website application there was no information exposing this application as a hard inquiry on this application nor did I give my consent for a hard inquiry. I was under the impression, until told otherwise after the fact, that these were soft pulls until we were preparing a deal. The sales members at the dealership stated they are not familiar with the websites application process and what it discloses. They also stated that this is standard practice at this dealership. This seems to be a predatory practice to me as they have effected my credit score so significantly that I will no longer be able to look into loans from other financiers at other dealerships, essentially, trapping me at aces motorcycles for my purchase if I should choose to do a loan.

    To whom it may concern,

     

    Mr Jaron willingly and unsolicited visited ACES Motorcycles website on 6-14-2024 and completed a secure online credit application in effort to purchase a 2002 Honda VT750 Shadow. The credit application that he completed requires a digital signature acknowledging that the applicant has read and understands the 'Statement of Consent' that is promptly displayed at the very top of the credit application. (Please see attached screenshots of our Finance Page as well as the Credit Application Form).

    For reference, the applicant MUST sign the Statement of Consent in order to submit the application. 

    Once Mr. Jaron read, signed and completed the application, our finance department received notification of the pending applicant. 

    Our finance department got Mr. Jaron approved on the motorcycle he applied for. Our sales associate reached out to the customer to tell him he was approved at $230/month. Mr. Jaron expressed that that payment was out of his price range and that he wanted to be at $100.00/per month or less. Our sales associate then explained that we would have to try another lender in order to get a longer term loan that would lower his payment. Mr. Jaron was ok with this. 

    Our finance department got a 2nd approval through a different lender for a longer term loan that dropped the payment to $101.50/month.

    Our sales associate reached back out to Mr. Jaron to tell him the good news. Mr. Jaron responded by saying that he was no longer interested and that he was "pissed off" that we pulled his credit. He stated that ACES website isn't compliant and that he was going to turn ACES into the Attorney General. 

    For reference, our website and online secure credit application are hosted and monitored by Dealerspike, one of the nations largest auto and powersport website providers with 10's of thousands of dealers using the same finance platform. It is fully compliant and we just updated our site less than 3 months. 

    I have attached the following documents for reference

    b) ACES Secure Online Finance Application which clearly states the 'Statement of Consent' and shows where the customer must sign after reading and acknowledging it. 

    c) The credit application that Mr. Jaron submitted showing that he signed the 'Statement of Consent', completed the application and submitted it to ACES finance department. Please note I have blacked out Mr. Jaron's personal information to protect his privacy. 

     

    It is also worth noting that Mr. Jarons credit was not "ruined" nor is he being held hostage to only shop with ACES. Mr. Jaron submitted multiple credit applications to other dealers (Harley Davidson 6 days prior, and Honda 1 day prior) the same week he completed one for ACES.
