Contract to repair roof, fence, gutters, siding, and garage doors for $27,000.00 (7-11-24) paid half with check. Roofing, solar, gutter subcontractors botched the job and it is still not done. The company promises to get it done and get back in contact with me. I'm frustrated as explained below that the company represents a top rating with BBB but has failed me, my neighbor, my daughter, and my grandson as all of us signed a contract and nobody is satisfied.

I was approached by ***** ****** in March of 2024 after a recent hail storm to work on my property (siding damage). A contractor bailed and I contacted Mr. ****** in August 2024. *********** and I completed the contract in September 2024. The proposal for the sum of $12,341.68 was presented to me. I paid *************** Notch Roofing) $6,300.00 by check date posted 10/02/2024. Mr. ****** requested additional funds from the ************. Top Notch was supposed to send the insurance the request or supplement information. After several text messages from me inquiring about the process I would get 'they're working it, they (Top Notch) is waiting on respond from the insurance *** etc. Mr. ****** and I communicated by text message back and forth for months. I took the initiative to called the ************ following up to see where they (insurance ***) was in the process. The ***************** hadn't received nor communicated with Top Notch. I requested the insurance agent reach out to Top Notch and CC me on the email. I believe the contact person name was ******** for Top Notch. I continued to contact ***** via text and now email only to receive 'we should be out next week, we'll be in the neighborhood, something came up etc. only not to have any work accomplished. I had my attorneys send Top Notch a letter to return the $6,300.00 in December/January 2025 - Top Notch has not complied or responded to the Attorneys request (10 days) or communicated with me during this entire process. I don't even want top Notch to start the job because of their inability to communicate with me in a timely manner or began the work and completed it while they were allegedly waiting a a supplement from the insurance. I'm now receiving compliant letter from HOA threats of fines because the work isn't finished as of January 29, 2025. In addition, I am in the process of suing Top Notch in small claims to recover the funds, and succoring a loan just to get the work finished by new contractor

    Customer Answer

The clarification on my account: I did state I was in the process of suing Top Notch based on attorneys' instructions/direction. The documents haven't been submitted to the courts as I was awaiting to see if BBB would be able to bring resolution. The documents will be filed upon resolution of BBB findings unfavorable, and I have to sue. I would like to avoid the entire suing process and have the money returned. This is totally unnecessary and cannot dispute they received the money, cashed the check. To make matters worse they won't even respond. Depending on the outcome from BBB, I will proceed with suing Top Notch, and asking for pain and suffering along with the return of the funds distributed to them for home repair, in which for whatever reason they hadn't even been close to starting the job and it's been almost a year since the damage.
