8-12-25 $400 but wants another $344 The business provided a 12-foot construction dumpster for $400, including a 3-ton weight limit. I specifically ordered it for heavy landscaping materials, including rock, dirt, and concrete. When the dumpster was picked up, the company claimed it was overweight and invoiced me $344 for an additional 4.5 ******* dispute concerns the lack of clear disclosure regarding weight limits and capacity. I had no reasonable way to measure the weight of materials, and the company did not inform me that filling the dumpster even halfway with such materials would exceed the 3-ton limit. I filled the dumpster as intended, using only landscaping materials, consistent with my stated purpose at the time of rental.I am disputing only the excess weight charge, as the magnitudemore than double the included limitwas neither foreseeable nor adequately explained by the company.Business Response

As stated above, the customer ordered a 12 yard ******************** with a 3 ton weight limit. He was more than welcome to give us a call to pick up his dumpster and have it weighed during his rental period. We are very upfront with what we charge per ton above his 3 ton weight limit. The customer is blaming us for his lack of knowledge. All dumpster companies run the same way and we have no idea how much a dumpster weighs until it is picked up and taken to the scale. We provide 12 yard dumpsters as these are specifically built for heavy materials. We are governed by the State of Colorado as to how much we are allowed to carry and therefore do not provide larger containers for heavy materials. There is no way for a dumpster company to provide weight information on how much dirt weighs by skid loader barrel. This customer used heavy machinery to load the ********************, this should have been a clear sign on the weight that being put into the dumpster. Different materials take up different space, so there is no way for us to know "halfway" would be over 3 tons. Again, if the customer called to have his ******************** weighed, we could have given him a weight before the final pickup and disposal. We have both written proof and verbal proof that we were fully upfront with how we charge and the charges for going over the 3 ton weight limit. I am attaching the first invoice that he paid off of, that states the weight limits and the charges for going over his weight limit.Customer Answer

I am rejecting this response because:There is no way for me, as a ********, to know how much my ******************** weighs without any guidance from the dumpster company. They never mentioned that filling a landscape specific dumpster with landscape materials will cost twice as much. I paid $400 and they want an additional $380. I feel this is purposely deceptive and it looks like based on the online reviews, I am not alone. When contacted about the overages, I agreed to the overages but asked them to call me first because I did not trust the company. I assumed an overage would be 1 maybe 2 tons not doubling the price of the dumpster. When I got upset and did not want to pay,they said they are going to put a lien on my house. I thought that was a very unfair way of doing business and a clear intimidation tactic. Below I will address the response line by line with ** as my response.

Is it listed anywhere on the invoice letting me know that you offer this service? Is there a cost to check the weight?
We are very upfront with what we charge per ton above his 3 ton weight limit. The ******** is blaming us for his lack of knowledge. I am not a dumpster company. **I was relying on your company to guide me correctly when specifically ordering a dumpster designed for landscape materials. I am not the first ******** to fill a landscape ******************** with rock and dirt. My dumpster weighed in at 7.5 tons. That means I would have had to fill the landscape specific dumpster about a 1/3 of the way up. I believe it is the responsibility of the company to inform the client specifically that the landscape specific dumpster cannot be filled with landscape materials. I mentioned exactly what I was filling the dumpster with when I requested a quote and you never mentioned only filling the dumpster a third.
All dumpster companies run the same way and we have no idea how much a dumpster weighs until it is picked up and taken to the scale. **The last time I used a dumpster company we actually filled a 30 yard dumpster with the exact same material all the way to the top. We did not pay any overage fees. The reason I did not use that company again was because I have been seeing Humpy Dumpster around town and thought it was a clever name so I reached out for a landscape material specific dumpster.
We provide 12 yard dumpsters as these are specifically built for heavy materials. We are governed by the State of Colorado as to how much we are allowed to carry and therefore do not provide larger containers for heavy materials. We were 3 men and 1 wheel ******. I will attach pictures of my lawn which will show the path they took the dumpster. We did not want to rip up our lawn with heavy machinery. This should not matter anyway, I told this company I was filling the dumpster with dirt and rock and ordered a specific dumpster for that purpose. The way we filled the dumpster does not matter.

Here are the 2 different sections of the invoice that address landscape materials. It is very vague. I contacted them and told them what I was filling the dumpster with before ordering the dumpster. Is it heavy or extremely heavy? They should inform me as the ********.
12 Yard **********************: For heavy materials such as concrete,dirt, rock and roofing materials. All materials with the exception of concrete will be billed at $80.00 per ton over 3 tons. Concrete will incure a $200.00 charge if there is rebar and must be free of any other material in the dumpster.
Extremely heavy material such as rock, dirt, or concrete.Please let us know and we can help you dispose of such heavy items in a more efficient manner. (failure to comply will result in weight overage charges as well as any applicable fees associated with unloading the dumpster.
Here is the quote response after inquiring about a dumpster. This is the dumpster they recommended. It says concrete only but then also mentions rock, dirt and sod. It is all very unclear. I should not be punished for my lack of knowledge when the company is so vague.
Hi ****, this is Humpty Dump! Our 12 cubic yard CONCRETE-ONLY dumpster is $400 for a 7 day rental (same for shorter). If you need more time, you can add an extra week for $75 at booking or $125 afterward.This dumpster is specifically for heavy materials like concrete, rock, dirt,and sod, and has a 3 ton weight limit. Please note that concrete with rebar will incur an additional $200 charge.

02/19/20223 i request a quote i didn't receive call or no email, so I figured they had not received it yet on 02/20/2023 around 7am i was not home. A friend said they dropped off the dumpster and that he had asked the person if it was paided for or if it needed to be paided for. The person told him it was paided for and already taken care of. on 02/21/2023 i contacted them to see what was going o and they said I owed $362.00 to which i never received an invoice or nothing I tried to see if they could drop the price because or work something out, they said no as there was no mess up on their end the person, I've been speaking with is ***** the only thig i have is text messages from *****Business Response
