    I ordered a tiny home from Tiny Custom Homes of Colorado. Put $58,500 down Aug 17th,2022. Paid 2nd payment in Jan 2023 of $28,750 and they have stopped responding to my calls and emails. It’s been over a month now. Home should have been done in March. They have just vanished.there are several other families in the same situation. I am out $85,000. Police won’t help. I hear they might go bankrupt so an attorney won’t help either and they just keep doing this over and over with new LLC

    Please see attached for a detailed complaint/timeline of our interactions with Tiny Custom Homes of Colorado.

    On July 27, 2021 my husband and I entered into a contract with Tiny Custom Homes of Colorado (TCHoC)
    to build our tiny house. At this time, we wrote TCHoC a check in the amount of $43,512.00 as our down
    payment on said home. We were told by Will SREMOVED(of TCHoC) that if we put down our deposit and
    signed the contract promptly, we would be able to utilize another client’s steel package already in
    TCHoCs possession to ensure our timeline would be met. Prior to signing we had met in person/emailed
    with Will SREMOVEDon several occasions to discuss our needs. Specifically, our plans to sell our house in
    Montrose Co. and relocate to upstate N.Y. residing full time in the tiny home. As we would have a long
    move ahead of us it would be important that the completion of the home would be in early to mid

    October before winter weather. SREMOVEDassured us an October finish date was achievable and that our
    build would be speedy with no delays as our requests were very standard. Over the course of the next
    month things appeared to be progressing. SREMOVEDtold us our walls/roof were going up and pluming the
    next week (none of which proved to be true). There was no mention of delays in product or otherwise.
    8/31/2021 we reached out to TCHoC via phone seeking answers to time sensitive questions and an
    update. We would receive no word for a week. We made numerous attempts to get in contact with
    TCHoC during this time. While we did not want to be bothersome, our move was fast approaching and
    there were so many details to be addressed.
    9/7/2021 we received a return call from Mike UREMOVEDof TCHoC (from this point UREMOVEDwould become
    our contact for TCHoC). UREMOVEDtold us they were on vacation but returning to work shortly, and asked us
    to email our questions so that he may answer them immediately. Two days later we received an email
    from UREMOVEDwith a partial answer to one question but promised that he would get in touch with us the
    next day when he was in the shop.
    9/17/21 After no communication from UREMOVEDmy husband visited the TCHoC shop for answers and
    hopefully to see the progression on our house. At this time, he was made aware that COVID had affected
    the shop but was told by an employee that work was still progressing with no delays. My husband was
    also shown our home which was still simply a trailer bed with a little steel framing. No roof, no walls, and
    no plumbing (as had been told to us by SREMOVED).
    10/3/21 Having had no communications from UREMOVEDsince 9/9/22 we reached out via email voicing our
    concerns about the lack of communication and searching for some honest answers so we could proceed
    and plan our future. The same day we received an email back from UREMOVEDseemingly upset at us voicing
    concerns while he was dealing with COVID in his family. A fact of which we were completely sympathetic
    to. UREMOVEDsaid that they had been shut down for 3 weeks, COVID had stifled all deliveries and that he
    had been waiting 3 weeks prior to this for our steel to arrive (This was the first we had heard ANY of
    this). He scheduled a meeting to call us on 10/6 to discuss our finish date and if we were still unhappy
    other arrangements could be made.
    10/6 Came and went with no word from UREMOVED.
    10/7 UREMOVEDemails to say sorry he missed our meeting and that he is waiting for the steel for our house
    that has been delayed for 4 months. 3 weeks or 4 months these delays were never discussed with us! On
    10/7 we email UREMOVEDto illustrate our concerns, distrust, and anxiety about the lack of communication
    and honesty. Beyond not being able to trust them it has also becoming increasingly apparent that they
    will not be able to deliver a home by October (as we had already entered the month of Oct.) or any other
    reasonable time after. Due to these reasons we wished to terminate our relationship with TCHoC receive
    our deposit back and move on.
    10/11/21 As we had received no response from TCHoC we sent an email asking for some kind of
    response so that we could all move forward. On 10/11 we received a response from UREMOVED/TCHoC
    stating that our only options moving forward would be to have
    • TCHoC finish our home and pay them the remainder of the money upon completion.
    • Or TCHoC would finish our custom home to our specifications and upon completion sell the
    home to another client. Any/changes that the purchasing client wanted would be made and
    charged to us and we could then receive what would be left of our deposit.
    Considering that they refuse to communicate, give honest answers or a realistic timeline neither of
    these was an option we could hinge our future on. As we deemed both options unfair and frankly felt
    like a form of intimidation, this is when we hired a lawyer to help us navigate this situation and know
    our rights.
    10/12/21 -10/5/22 During this time there have been numerous communications from our attorney to
    TCHoC. Each interaction with them has been a struggle costing us time, mental stress, and lawyer fees.
    As TCHoC continues their pattern of false promises and poor communication we have had to walk the
    line between patience and persistence. We have documents(email) with statements made that “TCHoC
    have always intended to pay back our full deposit” and “our home has sold and the money will be
    coming soon”. Checks have been “lost in the mail” or taken over a month to be delivered via mail.
    Although there have been numerous promises, we received only one check for $20,000 on 1/20/22.
    10/5/2022 After months of silence, I wrote a personal email to TCHoC asking them to honor their word
    so may both just move on. I outlined the actions we are prepared to take (that we had been trying to
    avoid) should this not be resolved. Those action included involving the BBB as well as telling our story on
    social media. Or if no other option resolves the matter taking our case to court.
    10/06/2022 TCHoC responded letting us know that they had received the money from the sale of our
    house and would send half of remaining balance the following Monday. The other half would be sent,
    “Just as soon as your attorney sends me a signed statement saying that once we pay the balance of the
    deposit there will be no more contact, liability and or bad press against us in any way (threat of social
    media) and bring this entire episode to an end, we will mail the balance of the money.” Though the
    check was “lost in the mail” for a time we did receive it. (Total amount of deposit refunded to date is
    $30,000).
    10/11/2022 Our lawyer had drafted up an NDA of which we approved and sent over to TCHoC. At this
    time our point of contact had now shifted to Angela SREMOVED(Owner of TCHoC). As was typical with TCHoC
    it took several follow up emails from our attorney to receive a response and then a few more to get a
    straight answer pertaining to the NDA.
    10/26/2022 SREMOVEDresponds that only thing that needs to be changed on NDA would be the removal of
    UREMOVEDfrom contact as he is not considered an employee of TCHoC. We made changes. SREMOVEDapproved
    and we sent our signed copy of the NDA to TCHoC.
    At this point we are still owed $13,512.00. We have not heard from TCHoC since our attorney sent them
    the NDA on 11/15/2022. The NDA is now null and void as they have not signed it or sent our final
    payment.
    We have copies or detailed notes of all communication mentioned above. We are not asking for attorney
    fees or damages from TCHoC. All we want is to recoup the remainder of our deposit; $13,521 and move
    on! We are hopeful that the involvement of the BBB can aid us in this before we are forced to file with
    the county courts.
