    I am disputing the $120 cleaning fee deducted from my deposit as this is not in compliance with my rental lease as stated here. I contacted and discussed this with All County 3 times prior to this complaint with no resolution. All County also attempted to charge me for carpet cleaning despite the owner of the property who was taking the unit back over replacing the carpet. Per lease terms, I am due full security deposit, as this unit was left cleaner than when found and I spent several hours cleaning. Charging a cleaning fee is in direct violation of my lease terms. "Resident shall pay Landlord such damages upon demand. Residents legal liability to Landlord shall not be limited under any circumstance to the amount of the Security Deposit. Resident contracts to pay reasonable cleaning charges if Resident fails to make the Premises as clean as when Resident moved in, and Landlord may withhold or deduct reasonable charges for cleaning from the Security Deposit"Photos are attached of clean unit on move out. I also can submit photos of a dirty refrigerator (dried brown liquids) on move in that i had to clean, also demonstrating a violation of this lease term.

    Good morning,

    We certainly appreciate that the tenant left the property in good condition and made a good effort to leave the premises clean.  Cleaning bills are not punitive...they're just part of the lease. The lease (which the tenant signed and agreed to) is explicit that professional cleaning will happen after move-out, just as professional cleaning was performed before they moved in.  Per Section 4 of the lease, "Upon move-out, professional house cleaning and professional carpet cleaning shall be performed at the Residents expense, unless otherwise agreed to in writing with Landlord."  Section 4 goes on to say, the "Resident can potentially reduce (but not eliminate) the costs of the professional move-out cleaning by maintaining a generally clean household prior to the move-out, removing all of their personal items, and leaving the property broom clean at the end of their lease term." 

    Leases have to be this way because one person's definition of clean will often vary from another's, and we need to be able to tell incoming tenants with confidence that their property was professionally cleaned.  In this case, the cleaners were at the property for just one hour (two techs for one hour at $60/hour).  This small bill for cleaning reflects the good condition in which this tenant left the property (as you can imagine, if a tenant leaves the house dirty, the move-out cleanings can easily cost $600 or more), but it does not eliminate the need for professional cleaning at move-out.  

    At the end of the day, we sincerely regret that the tenant was unhappy with the charge. It's not uncommon for tenants to be upset that there were deductions from their deposit. I would also note that All County hires third party vendors to perform all maintenance and cleaning, so there is no profit in this for us. We have no incentive to perform any work that wasn't necessary and dictated by the lease.  While we understand the tenant's frustration, we did not violate the lease, and do not believe this transaction justifies a complaint to the Better Business Bureau.

    I am rejecting this response because:

    Again, there is no argument that can be made for justifying that the lease terms were not violated. 

    Im attaching the following for your reference for the third time -

    Section C

    Resident contracts to pay reasonable cleaning charges if resident fails to make premise as clean as when resident moved in. 

    That is very clear. Unless you can show that I left it less clean than move in, and I have attached photos showing otherwise, then All County did was in breach of lease.

    Lack of Response time with appliance issues , including broken refrigerator. Code violation with vents/ air quality Only replaced / fixed when lease was up for renewal. 3 months for vent work & 6 months to replace refrigerator. Tried to meet with management company several times to discuss but have not been successful.

    Good morning,

    We have been in ongoing communication with Mr. **** for several months regarding his concerns, and have been negotiating a resolution that will soon be completed through the reconciliation of his deposit. We've been friendly and cooperative throughout the process. While there was miscommunication and confusion regarding the repair to the water supply to his refrigerator during his tenancy, it's unclear how our actions rise to the level of a complaint with the Better Business Bureau.

    We are currently finalizing Mr. ****** deposit reconciliation, and look forward to having this matter resolved.
