      I am the developer for a tear-down, build-up new construction duplex project in ******. I am trying to recapture my losses due to negligence on behalf of the environmental/asbestos inspection company (Boulder Environmental = "BE") that was responsible for identifying asbestos on the old structure that was to be torn down. BE inspected the property and supplied me with a report that identified exactly where asbestos was located on the structure. I then hired an abatement company to remove the asbestos which included tenting of the entire structure for containment purposes of the toxic material. BE was then sent back out to inspect the abatement work done and signed off on the work stating that all of the asbestos was removed. The abatement company then removed the containment and I received approval to demo the structure. Meanwhile, the city of ****** sent an inspector out to my job site who noticed that a large portion of asbestos had not been removed. My demolition permit was revoked and I was required to send the abatement company back out to remove the rest of the asbestos that BE had missed. This cost me $19,430, in which a large portion was for re-tenting the property and supplying diesel generators for power (24/7 needed for containment fans) as the electricity had already been cut by that time. BE was fined for this negligence by the **************************************************** ******************************* but I believe that my company is owed by BE for this negligence.
