In December, 2021, I purchased 4 Blizzak snow tires from Action Jackson and also purchased a storage plan under which they would store my regular tires when the snow tires are on and vice versa. My snow tires were in storage with Action Jackson when they closed. They have made no attempts to contact me and tell me how I can retrieve my tires, which are worth over $1,000. I have not been able to find any way to contact them. My desired settlement is that I would like my tires to be returned to me.Initial Complaint

I purchased new tires from them Nov 2022 and they have a tire storage plan. In April 2023 I stored my 6 month old studded snow tires and now they are closed. They never attempted to contact me and I have no way to contact them. I am out 1200$ for the tires and the cost of the storage plan.Initial Complaint

4/12/23 Traveling cross country on military orders with my daughter and had to replace water pump and thermostat. Quote rec'd was only for parts at around $500. When picking up the car we were told bill was $2253.46 . After feeling like we were on "lets make a deal" INITIATED TOTALLY BE THEM we settled and paid $1200. Continued on our journey and made it to southern CO about 4 hours away the next morning when car overheated. Went to a service center to find out the service was performed incorrectly and when fluids were added back into the car there were air bubbles left in the line to cause engine to overheat. The coolant was bubbling out of the reservoir tank before we even left Action Jackson and we were told by them that was normal. Needless to say-that is not normal! When contacting Action Jackson they offered if we brought the car back they'd be happy to look at it but that was not an option because the car was not drivable. They reassured us they would work with us and wanted to make things right for us. After finally making it to Arizona I reached out to them and they gave totally bogus excuses about how due to elevations in Colorado these issues happen all the time. I have 2 sons that live in CO so I know that is not true! After receiving an email back (attached) I was told they would offer a settlement of $200 and after several follow up emails and unanswered phone calls we have still not received our promised refund. Now they won't even answer the phone when I call, it goes to voicemail with no return calls. Unfortunately with me living in PA its not possible to show up at their location or I surely would. This lack of communication and no refund for our trouble and their negligence is unacceptable. With traveling the rural roads between Vail and Ft Huachuca we were at very high risk of being stranded. We were truly blessed that when we broke down next day we were only 2 miles from a great service station. Stressful situation that could have been avoided!Initial Complaint

On 1/19/2023 we brought our vehicle to Action Jackson, Avon CO, for an estimate for repairs. From a home diagnostic test, we were aware that the vehicle required spark plug and injector replacements. We received a verbal quote of around $500 from the mechanic or sales rep. They also stated they needed to replace all 6 coils. Later that day, we were told the work was complete and would cost over $4800. When we questioned the cost the company demanded payment, placed a boot on our vehicle, and informed us that payment must only be a debit card or cash (they would refuse credit card). They ultimately charged $4000. I informed them in writing that I did not consent to this charge and was paying only to have my car released. An estimate from another mechanic in town for this work was $1700-2100.
This transaction was a violation of the Colorado Motor Vehicle Act because we were not provided a written estimate and did not validly consent to this cost.Business Response

To Whom it May Concern:
We clearly communicated the parts and labor costs for this repair work. We would have never quoted you anything near the amount you are suggesting - $500 - and even the evidence you provide suggest that such auto repair work would be 5x or more than the $500 you suggested.
The reality is parts and labor costs may seem expensive, but we only use the best quality parts and we proudly pay living wages to our hard-working team.
We take pride in our work and the work completed on your vehicle was successful.
We wish you the best in the future.

I am rejecting this response because: 1) The quote was outrageously over a typical quote for similar work, 2) I have now been told by 3 automotive repair shops that it would be exceedingly rare to require all 6 coils be replaced at the same time, and 3) we never received a written estimate, as is mandatory by Colorado law.

I am rejecting this response because: This is not a helpful response and does not remedy the issues. I am confident that I have sufficient evidence to prove that 1) The company did not follow the law by providing me a written estimate, 2) The work they performed was worth between $1700-2100, not $4000, 3)I have proof they overcharged for labor, due to the time they called to let me know the car was done vs. the hours they charged that day. A settlement of $1900 would be reasonable, which would be the higher end of the value of the work. Short of that, I will continue to pursue this legally.

On November 8th I called this shop because I was having a problem with my power steering pump. I brought the car in to have it looked at for 2 hours. The shop was not busy and they stated I needed a new thermostat which the worker (Fransico) convinced me to buy even though it was not broken. The part and labor cost $1,500 and my car is not fixed. I have tried getting a hold of the owner and there has been no response.Business Response

We worked with this customer to assure he was taken care of from the moment he walked into our shop. Upon full inspection, either the customer or another shop had put coolant in his power steering reservoir.
In this case, we recommended replacing his entire system, and he only approved a portion of the work, i.e. the thermostat. This went against our processes and recommendation, and thus his problems persist.
We are willing to work with you/him to ensure his coolant system is working properly, but there are other auto parts that need to be replaced to do so.
At no cost for further inspection, we can look at your system anytime this week, as long as you are open to approving other needed work.
_____
To be clear, because we do work on cars/trucks that have been driven substantially before arriving for inspection, we cannot guarantee anything is going to make the car run new again. In fact, we highlight this in our terms of service which are readily available on our website and in-person at the check in.
Here are our terms and conditions:
"In the event that you believe the original problem(s) persists, you agree to bring the vehicle back to the shop location (***** *** ** ***** ** *****), and that you will not bring the vehicle to any other auto repair shop or facility, until our Shop has made a final assessment and diagnosis. If the vehicle is brought to any other facility after any problem has persisted or a new issue has arisen, the Shop will not reimburse, refund, or perform any more services on vehicle(s).
Due to the cost of running an auto shop, we do not offer refunds for service. Additionally, the Shop shall not be responsible to correct: (i) any condition which reasonably could have been prevented or minimized by Customer, (ii.) any condition constituting normal wear and tear; (iii.) any condition caused by acts of God; (iv.) any condition caused by abuse or misuse; (v.) any damage or loss to the vehicle as a result of its parking or storage at our Shop facility; (vi.) any problems with the vehicle after it has been driven more than three miles from the Shop location after Service is completed. Quotes are an approximation of charges to you for the services requested. They are based on the anticipated details of the work to be done. It is possible for unexpected complications to cause some deviation from the quote."Your vehicle has greater than 200,000 miles and is more than 17 years old. To suggest it's simply a thermostat isn't what we would do; in fact, our system and processes at that many miles is to repair and replace the whole coolant system as needed.
Please contact our shop and we can apply some of the existing work to replacing the whole system.
